HomeMy WebLinkAbout20090123.tiffRESOLUTION RE: GRANT REQUEST FOR EXTENSION OF SUBMITTAL OF SITE SPECIFIC DEVELOPMENT PLAN AND PLANNED UNIT DEVELOPMENT FINAL PLAT, PF #1102 - TRINITY PROPERTIES, LP WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on April 5, 2006, by Resolution #2006-0752, the Board approved the application of Trinity Properties, LP, 356 Foxenwood Drive, Santa Maria, California 93455, requesting Change of Zone, PZ #1102, from the A (Agricultural) Zone District to the PUD (Planned Unit Development) Zone District for 17 residential lots, two (2) non-residential agricultural outlots, and 0.8 acres of open space, along with oil and gas production, for a parcel of land located on the following described real estate, to -wit: Part of Section 7, Township 6 North, Range 63 West of the 6th P.M., Weld County, Colorado WHEREAS, on October 13, 2006, the Department of Planning Services administratively approved the application of Trinity Properties, LP, 356 Foxenwood Drive, Santa Maria, California 93455, requesting a Site Specific Development Plan and Planned Unit Development Final Plan, PF #1102, for 17 residential lots, two (2) non-residential agricultural outlots, and 0.8 acres of open space, along with oil and gas production (Deer Meadows PUD), and WHEREAS, at a hearing on November 7, 2007, the Board approved a one-year extension of the submittal of the Planned Unit Development Final Plat for recording, as required by Sections 27-8-60 and 27-8-70 of the Weld County Code, with said Final Plat to be submitted by October 13, 2008, and WHEREAS, Ed Flynn, on behalf of the applicant, has requested an additional three-year extension of the submittal of the Planned Unit Development Final Plat for recording, indicating said Final Plat will be submitted by October 13, 2011, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, studied the request of the applicant and the recommendation of the Department of Planning Services, and, having been fully informed, finds that a one-year extension shall be approved, with said Final Plat to be submitted by October 13, 2009. COLORADO Memorandum TO: Board of County Commissioners DATE: December 24, 2008 FROM: Brad Mueller Department of Planning Services RE: Deer Meadows Final Plat Extension Request CC: Bruce Barker, Dave Bauer The Deer Meadows (PF-1102) Final Plat was administratively approved by staff on October 13, 2006. The plat has not yet been recorded, pending the required Improvements Agreement and surety. The applicant is requesting an extension to the normal 1 -year deadline for recording a PUD Final Plat, as required by Section 27-8-60. The same Section allows for the Board of County Commissioners to extend this deadline, if the Board finds that the PUD has not been abandoned and that the applicant possesses the willingness and ability to record the plat. The Board has previously extended the deadline one time, from October 13, 2007, to October 13, 2008. The applicant indicates that finalizing the subdivision at this time may not be in their best interest, given the softened real estate market. They would like to re-evaluate the market and decide at a later time whether to complete the subdivision or abandon it. This is a reasonable explanation, and, as such, staff believes an extension is warranted. The owner is requesting that a 3 -year extension be granted. However, the Board has in the last year limited similar requests to a single year, so staff recommends extending the deadline for recording the final plat to October 13, 2009. 2009-0123 1 Pt 123 I Page 1 of 1 Brad Mueller From: Flynn [nlyk.flynn@verizon.net] Sent: Wednesday, October 15, 2008 12:48 PM To: Brad Mueller Brad as per our phone conversation last week I am requesting a time extention for final sign off and recordation for the Deer Meadows Cluster P U D. The current economic situation does not all any development at this time, or any time in the near future. would like to request a 3 year extention if possible.
