Central Weld Water District provides water to the site. There is an existing office that utilizes a septic system that was sized for 2 people (G19830182). If more then 2 people are utilizing the system, ari engineer review must be submitted to this department. The application indicates a new septic system will be installed for the expanded facility. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1 1. The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application from the Air Pollution Control Division, Colorado Department of Health and Environment, if applicable. 2. The applicant shall submit a dust abatement plan, for on site dust, for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. 3. The septic system serving the existing office, (septic permit # G830182) was designed to serve 2 persons per day. The application materials for 2nd AMUSR- 542 indicated that five persons per day would utilize the site, Therefore, the existing septic system was required to be reviewed by a Colorado Registered Professional Engineer. According to Environmental Health Services records, the review was never completed. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or EXHIBIT i 2009-0933 constructed the system shall be brought into compliance with current Regulations. 4. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirement be incorporated into the permit as a condition that must be met one month prior to construction activities: • • 1. The applicant shall submit evidence of a Colorado Discharge Permit System or CDPS permit from the Colorado Department of Public Health and Environment (CDPH&E), Water Quality Control Division, to cover stormwater discharges from construction sites (5 CCR-1002-61) Alternately, the applicant can provide evidence from CDPH&E that they are not subject to the CDPS requirements. (New rule effective 3/2/2001). We recommend that the following requirement be incorporated into the permit as a condition that must be met prior to the issuance of the Certificate of Occupancy: 1. An individual sewage disposal system is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 2 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan". 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan" at all times. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in Section 14-9-30 of the Weld County Code. 7. Adequate drinking, handwashing and toilet facilities shall be provided for employees and patrons of the facility. 8. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 9. Adequate toilet facilities (portable toilets) shall be provided during the construction of the facility. • • 10.The facility shall utilize the existing public water supply. (Central Weld Water District) 11.All potentially hazardous chemicals must be stored and handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). 12. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. 13. This project falls primarily under the purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS: 1. Weld County Road Classification Plan (FHU): (June 2002) • a. b. WCR 35 is a local gravel road and requires a 60 -foot right-of-way at full build out. There is presently a 60 -foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The most current road counts for WCR 35 are 145 AADT taken in July of 2006 WCR 38 is a local gravel road and requires a 60 -foot right-of-way at full build out. There is presently a 60 -foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The most current road counts for WCR 38 are 96 AADT taken in May of 2006 2. Section Line Access: to determine if a road right-of-way exists along your section line, determine the land patent date. Weld County may, if approved by the BOCC, grant a Nonexclusive License Agreement for the upgrade and maintenance of private improvement within this right-of-way. REQUIREMENTS: 3. In the questionnaire, the applicant identified that three employees will be utilizing the site in a 24 -hour period. These employees will utilize pick up trucks and semi truck traffic approximately two per day. If the use or volume dramatically changes at the site, dust suppressant on the County roads at the immediate area may be required. 4. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (23-1-90), the required setback is measured from the future right-of-way line. 5. The owner of the property shall pay for materials and the cost of installation for new road access culverts whenever the installation of a culvert is made necessary by the creation of a new access from private property to a County road, by any alteration of the natural flow of water across private property by the owner, or for any other reason created by any owner of private property. The culvert size will be • determined in accordance with standards engineering practices. The property owner shall be responsible for cleaning the borrow ditch to the extent required to accommodate the road access culvert and insuring proper drainage. The applicant shall utilize the existing access to this parcel. •' The new access shall be placed in such a location to have adequate sight distance in both directions and not below the crest of a hill or where physical obstructions are present. 8. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. 9. Off-street parking spaces including the access drive shall be surfaced with gravel, asphalt, concrete or the equivalent and shall be graded to prevent drainage problems. 10. The access width shall be a minimum of 30 feet and radiuses for the drive shall be 60 feet to accommodate large trucks. 11. The accesses to WCR 35 shall be an all-weather surface that shall extend into the site a minimum of 100 feet with adequate width to accommodate two-way traffic. 12. The internal roads shall enter onto WCR 35 at a 90° angle, for a minimum of one vehicle length to provide adequate sight distance in both directions. 13. Public Works normally requires that an access point to a road is a minimum of 75 feet from access points to adjacent parcels and a minimum distance of 150 feet from intersections of county or state roadways. 14. . Storm Water Drainage: a. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. b. The applicant is required to comply with all Colorado Department of Health and Environment, Water Quality Control Division regulations regarding storm water quality permitting and protection and construction storm water discharges. c. The applicant is required to comply with all Colorado Oil and Gas Conservation Commission (COGCC) rules and regulations including drill pad construction, storm water controls, and reclamation. 15. This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency Management Agency (FEMA). 16.
