RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION
BCV #0900065 AGAINST JOSEPH AND JUDITH TIMKO FOR VIOLATION OF THE
WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Joseph and Judith Timko, BCV#0900065, are allegedly in violation of the Weld
County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 14th day of July, 2009, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Joseph and Judith Timko were not present or represented at said hearing,
although all parties were notified of said hearing by Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to re -open the original Building Permit for a two
(2) year duration period to complete this project.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that BCV #0900065 be, and hereby is, re -opened for a two (2) year duration
period to complete the remodel and addition to the existing dwelling unit.

Joe Timko was in the office today. He brought in an
extension request. I explained that only one extension is
allowed per permit and the permit is now expired. He will
need to get a new permit and pay one half the original
fee. He said he cannot afford that so I told him I would
talk to the Building Official. I did speak with Tom Honn
and he agreed that, based on the number of inspections
left to complete, $600.00 fee is justified.
Left message for Joe Timko. The Building Offical
determined the $600.00 fee is warranted based on the
number of inspections left to complete. He needs to

It has been determined that the property located at 7095 County Road 26.75 is currently in violation of the following

To bring your property into compliance with the Weld County Code:

Dear Mr. and Mrs. Timko:
On June 5, 2006, the Weld County Commissioners voted to change Section 29-8-40 of the Weld County
Building Regulations. The new version of that section states that permits are given a utilization period based
on the valuation and will expire on a specific date unless an extension is requested and approved prior to that
date.
Your permit was issued prior to June 5, 2006, when the code allowed for an automatic 180 -day extension
upon completion of an inspection and documented progress. It has been the County's practice to notify you
30 days prior to each expiration date to advise you the permit will expire unless an inspection is completed.
We are no longer going to be sending these courtesy notification letters. From this point forward, it will be
your responsibility to know when your permit expires and failure to complete inspections by that date will result
in expiration of the permit and a violation initiated. At that time, it will be necessary to submit a new application
and all applicable documentation for a new permit plus all fees per the current code will be assessed which
could include road impact fees, capital expansion fees, and storm water fees. Please take note of your new
expiration date so your permit does not expire.

work; and provided further that such suspension or abandonment has not exceeded five (5) years.

In an effort to bring all building permits to current status, the Weld County Building Department is
requiring that a new permit application be submitted to replace permit number BCS-020660 for an
addition and remodel to your home. This permit was issued on September 22, 2003, and there are
numerous inspections to be completed.
As of June 5, 2006, all permits have a fixed expiration date based on the valuation. If the permit has
not received final approval and/or a certificate of occupancy by that date, the permit will expire and a
new permit will be required. Any extensions granted will be assessed a processing fee of $50.00.
This department has approved a one time permit fee of $21.00 in this case. If that permit would
expire, a new permit would be required and all applicable fees would apply. I have enclosed a permit
application for your convenience. We will transfer all information from your current permit file as well
as all inspections that have been completed. Please submit this information within 15 days from the
date of this letter.

action by the permittee for a period not exceeding one hundred eighty (180) days upon written request by
the permittee showing that circumstances beyond the control of the permittee have prevented action from
being taken. No permit shall be extended more than once. In order to renew action on a permit after
expiration, the permittee shall pay a new full permit fee as established by the Board of County
Commissioners.
