RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION
ZCV #0900230 AGAINST DARLENE AND DAVE WILLBANKS FOR VIOLATION OF THE
WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Darlene and Dave Willbanks, ZCV #0900230, is allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 10th day of November, 2009, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Dave Willbanks, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners determined the property was in
compliance and deemed it advisable to dismiss said matter, with the clarification that Mr. Willbanks
cannot perform any commercial welding on the property.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that VI #0900230 be, and hereby is, dismissed due to the property being in
compliance with Weld County Code, with the clarification that Mr. Willbanks cannot perform any
commercial welding on the property.

REMEDY
As we have previously discussed, the Weld County Code is very specific that a Home Occuation shall
not exceed 300 square feet and shall be conducted entirely within the dwelling unit (house or attached
garage). Since your operation was so close to falling within the definition of a HOME OCCUPATION, I
presented your information to staff. As I indicated in an e-mail send on 10/26/09, staff did determine
that it does not meet the definition of Home Occupation and as such shall be reviewed by the Board of
County Commissioners.
If the Board agrees that it does not meet the intent of the Weld County Code, a Use by Special Review
(USR) permit shall be required. If the Board determines it does meet the intent they could dismiss this
violation case.
RECOMMENDATION
The Department of Planning Services recommends that this case be forwarded to the County
Attorney's Office for immediate legal action.

I presented your e-mail to staff this past Friday and as we had previously discussed because it does not meet the
definition of Home Occupation (specifically 'a', 'c' and `e' listed below), this case will be presented to the
Board of County Commissioners through the Violation Hearing process. If they determine this meets the
"intent" of Home Occupation and dismiss the violation case, my case will be closed. If they determine that it
does not meet the definition of Home Occupation, a Use by Special Review (USR) permit would he required.
The Board would then refer the ease to the County Attorney's Office, but delay legal action for a certain amount
of time. Staff would he asking for a delay of legal action for approximately 90-120 days. This should allow
enough time for a Pre -Application Meeting and submittal of a Use by Special Review application or the
removal of the business from the property entirely.
I will be sending out a Hearing Notification letter. I am looking at scheduling this case for Tuesday, November
10, 2009 (r7, I 0:00 am. I will be sending an actual notice in the mail in the next day or so.
HOME OCCUPATION: An incidental use of a DWELLING UNIT for gainful employment of the resident therein,
where:
a. Such USE is conducted entirely within a PRINCIPAL DWELLING UNIT and carried on by the residents
thereof and no others.
b. Such USE is clearly incidental and secondary to the USE of the dwelling for dwelling purposes and shall not
change the character thereof.
c. The total area USED inside the DWELLING UNIT for such purposes does not exceed three hundred (300)
square feet.
d. There is no advertising or other indication of the HOME OCCUPATION on the LOT or any STRUCTURE
located on or ADJACENT to the LOT, with the exception that one (1) nameplate shall be allowed which may
display the name of the occupant and/or the name of the HOME OCCUPATION where such nameplate does not
exceed one (1) square foot in area, shall be nonilluminated and attached flat to the main STRUCTURE or visible
through a window.
e. There is no exterior storage, display or sales of materials, goods, supplies or equipment related to the
operation of such HOME OCCUPATION nor of any highly explosive or combustible materials.
f. There is no offensive noise, vibration, smoke, dust, odors, heat, glare or electrical interference or other hazard
or nuisance noticeable off the LOT.
g. If a commercial vehicle is associated with the home occupation, refer to Section 23-3-30 M of this Chapter.
Ordinarily, a HOME OCCUPATION shall not be interpreted to include the following: clinic, HOSPITAL, nursing home,
animal hospital, HOTEL/MOTEL, RESTAURANT, mortuary, vehicle or boat repair (including painting), and organized
classes where more than six (6) persons meet together for instruction on a regular basis (does not include classes
sponsored by a PUBLIC SCHOOL).

Commissioners authorize the County Attorney to proceed with legal action to remedy the
violation. Our records indicate that you were made aware of the nature of the violation including
the action necessary to correct the violation, and that you were given sufficient time to remedy

I Have Told You In The Past I Am A One Man Business With Help From My Wife . We Fabricate Railings &
Misc.Metal Fabrications For Parks & Recreations , Schools & Bikepaths Which Ninety Percent Is Done In The
Field Since The First Of Year We Have Done A Park In Denver A Park In Highlands Ranch From June Until
September A School In Nederland & Now We Are Working On Two Schools In Denver. The Welding That Is
Done On Site Is Done in The Back Corner Of Our Garage Approx. 10' X 12' We Store No Materials Outside

Additionally as we discussed, you were going to send a letter specifically outlining your
use. Such as:
1.) How large is the area inside the shop (specific to the welding operation)?
2.) Is there any additional storage (outside - such as extra iron/metal)?
3.) Any employees? If so, how many?
4.) If you had to guess a percentage of work conducted on -site versus at another property
location, what would those percentages be?
5.) Can you list what types of jobs you have done recently?

As we discussed, the Weld County Code is very specific that a Home Occupation shall not
exceed 300 square feet and shall be conducted entirely within the dwelling unit (house or
attached garage). Your operation appears to be so close to the line, that I want to present
your information to staff to see if it is possible to waive at a staff level or if we have to appear
before the Board.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this violation. You have until
10/09/2009, to correct this zoning violation. Failure to do so will result in this office scheduling the
violation before the Board of County Commissioners to consider whether to refer the violation to the
County Attorney's Office for legal action.

The operation of Hudson Welding and Fabrication has once again risen to the level which
requires a Use by Special Review (USR) permit. A sign has been re -installed along CR 41
advertising the business, even though in a letter received from you dated January 23, 2003
it was stated "We Currently Have A Sign Which We Intend To Remove As We Do Not
Want Off The Street Business".
Additionally, the operation of a Home Occuation shall not exceed 300 square feet and shall
be conducted entirely within the dwelling unit (house or attached garage).

PRE -APPLICATION REVIEW REQUEST
The pre -application request is the preliminary review of a land use proposal. Pre -application reviews are required
prior to beginning the application process; however, this review is not an application.
Pre -application reviews are held with the Weld County Departments of Public Works and the Public Health and
and Environment. Pre -Application reviews are held Thursday and Friday of any given week in the Greeley office.
To be on the pre -submittal agenda, the request and required checklist items must be received one week prior to

This letter is in regards to your request received on January 28, 2003 for a Home Occupation. Your
request for a home occupation in order to close violation VI -0200520 was reviewed, and was
administratively approved with conditions at the staff meeting of January 31, 2003. However you must
show proof of compliance with the home occupation regulations found in section 23-1-90 page 23-13 of
the Weld County Code, notably 23-1-90.c which states "The total area used for such purposes does not
exceed three hundred square feet. Evidence of compliance shall be submitted to the department of
planning services and approved before your home occupation will be approved and your violation is
closed.
