HomeMy WebLinkAbout20092727.tiffRESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST KIRK CHRISTENSEN FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Kirk Christensen, ZCV #0900219, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 20th day of October, 2009, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Kirk Christensen, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until April 20, 2010, to allow adequate time for the property owner to remove the constructions materials from the property, in order to bring the subject property into compliance, and for an inspection of the property by the Department of Planning Services staff. I saw several piles of concrete forms and supplies. I also noted a flat bed trailer with a license plate of 982-MHU - CO. See pictures dated 07/28/09. Dwight Christensen (303-854-8119) (Kirks father) came to the Greeley Planning Office. He apologized for not getting back with us sooner. He stated his son (Kirk) has been in the hospital for about 2 weeks and just got out of intensive care about 2 days ago. He stated the property they used to be housed out of, was being sold and they had to remove their storage, vehicles, etc so they put it on this property temporarily. He indicated they have a new property in Denver they are working on getting ready (going through the zoning process). I explained that my letter granted until 09/06/09. I would then conduct another inspection. If the property remains in violation, I would then schedule them for the next available violation hearing (10/13/09). I explained as long as the property was in compliance by October 12th, the hearing would cancel. He said he understood and would try to keep me in the loop with what happens. Kirk Christensen (303-709-2365) called. He apologized for not getting back to me sooner, but he was involved in a major accident on the 5th of August and has been in the hospital. He asked how much time he could have. I explained that my next step is to schedule a violation hearing for October 13, 2009 @ 10:00 (915 10th St). I advised him that I would be sending out a letter early next week with the hearing details. He would need to attend that hearing and request additional time from the Board of County Commissioners. He said he would be looking for my letter. Upon a visual inspection of the property, the following items were noted: no obvious visible progress has occurred. No pictures were taken during this inspection.
