Location: North of and adjacent to County Road 2 and 1 mile west of County Road 45 Size of Parcel: +/- 310 (USR site: +/ 29 acres) Parcel Number: 1473 33 000066 THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE APPROVED FOR THE FOLLOWING REASONS: 1. It is the opinion of the Department of Planning Services' staff that the applicant has not shown compliance with Section 23-2-220 of the Weld County Code as follows: a. Section 23-2-220.A.1 -- The proposed use is consistent with Chapter 22 and any other applicable code provisions or ordinance in effect. Section 22-2-20.G2 states: "Conversion of agricultural land to nonurban residential, commercial and industrial uses should be accommodated when the subject site is in an area that can support such development, and should attempt to be compatible with the region." The proposed facility is located on farmground. The nearest single family residence to the north is located approximately 1/8 of a mile north of the proposed vehicle/equipment storage area. Three (3) single family residences are located approximately 1/8 mile from the south end of the proposed facility (the proposed office shop and parking area). The applicant is proposing to berm around the equipment area for drainage and screening. Multiple residences are located to the south and east of the site. The site is located approximately 1 mile east of an existing industrial trade school facility (USR-1616 - USR-1721 LaCoe Page 2 of 10 • • • approved by the Board of County Commissioners in 2008 for an electric lineman apprenticeship trade school). b. Section 23-2-220.A.2 -- The proposed use is consistent with the intent of the A (Agricultural) Zone District. Section of the Weld County Code provides for Uses by Right, an Accessory Uses, or a Uses by Special Review in the Commercial or Industrial Zone Districts as a Use by Special Review in the A (Agricultural) Zone District. c. Section 23-2-220.A.3 -- The uses which will be permitted will be compatible with the existing surrounding land uses. The proposed facility is located on farmground. The nearest single family residence to the north is located approximately 1/8 of a mile north of the proposed vehicle/equipment storage area. Three (3) single family residences are located approximately 1/8 mile from the south end of the proposed facility (the proposed office shop and parking area). The site slopes from south to north toward the middle of the property and then slopes to the south again. The proposed vehicle storage area will at least be partially screened from County Road 2 due to the topography of the site. The Department of Planning Services is requiring a Landscape/Screening plan for the facility in order to screen the vehicle/equipment storage area from property to the north and to screen the office/shop and parking area from adjacent residences off of County Road 2. The Department of Planning Services is also requesting a lighting plan be submitted to ensure that lighting is downcast and does not shine onto adjacent properties and rights -of -way to mitigate impacts of the proposed use and to ensure compatibility with the surrounding area. Additionally, staff is proposing only daytime hours only daytime hours of operation for this facility, and proposes this as a development standard for this facility. d. Section 23-2-220.A.4 -- The Uses which would be permitted will be compatible with future development of the surrounding area as permitted by the existing zoning and with the future development as projected by Chapter 22 of this Code or Master Plans of affected municipalities. The site is located within the 3 -mile referral area for the Town of Lochbuie and within the 3 -mile referral area for Adams County. No referral responses have been received from the Town of Lochbuie or Adams County. e. Section 23-2-220.A.5 -- The site is not located within the floodplain or any overlay districts. Effective January 1, 2003, Building Permits issued on the proposed lots will be required to adhere to the fee structure of the County Road Impact Program. (Ordinance 2002-11) Effective August 1, 2005, Building permits issued on the subject site will be required to adhere to the fee structure of the Capital Expansion Impact Fee and the Stormwater/Drainage Impact Fee. (Ordinance 2005-8 Section 5-8-40) f. Section 23-2-220.A.6 -- The applicant has demonstrated a diligent effort to conserve prime agricultural land in the locational decision for the proposed use. The proposed site is designated as "Prime if Irrigated" and "other" per the 1979 Soil Conservation Service Important Farmlands of Weld County Map. The proposed USR site (construction business) will encompass on only 29 acres of the existing 310 acre parcel. Section 23-2-220.A.7 -- The Design Standards (Section 23-2-240, Weld County Code), Operation Standards (Section 23-2-250, Weld County Code), Conditions of Approval and Development Standards ensure that there are adequate provisions for the protection of g. USR-1721 LaCoe Page 3 of 10 • • • health, safety, and welfare of the inhabitants of the neighborhood and County. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. The Department of Planning Services recommends that the following Conditions of Approval and Development Standards be attached: 1. Prior to recording the plat: A. The applicant shall submit a Landscape/Screening plan to the Department of Planning Services for review and approval. The landscape plan shall indicate the type of screening and the type of landscaping (including the height and/or caliper size of the landscape material). The vehicles and equipment associated with this proposed business shall be screened by an opaque fence (or landscaping material) from adjacent properties and rights -of -way or shall be placed inside an enclosed building. The applicant is proposing a landscaped area off of County Road 2 to screen/buffer the office/shop and parking area from adjacent residences. (Department of Planning Services) B. A lighting plan, including cut sheets of the intended lights, shall be provided to the Department of Planning Services for review and approval. The lighting plan shall adhere to the lighting requirements for off-street parking spaces per Section 23-4-30.E of the Weld County Code and shall adhere to the lighting requirements in accordance with Section 23-3-360.F and 23-2-250.D of the Weld County Code. Further, the approved lighting plan shall be indicated on the plat. (Department of Planning Services) C. The plat shall be amended to delineate the following: 1. The attached Development Standards. (Department of Planning Services) 2. All plats shall be labeled USR-1721. (Department of Planning Services) 3. The approved screening plan for the vehicle/equipment storage area. (Department of Planning Services) 4. The approved landscape/screening plan for the office/shop and parking area. (Department of Planning Services) 5. The approved lighting plan (with light locations indicated on the plat). (Department of Planning Services) 6. County Road 2 is a collector road and requires an 80 -foot right-of-way at full build out. There is presently a 60 -foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23- 1-90), the required setback is measured from the future right-of-way line. An additional 10 -foot of right-of-way parallel to the WCR 2 labeled future "County Road 2 Right -of -Way" for future build -out shall be indicated on the plat. (Department of Public Works) 7. Identify the water quality features on the plat. Label the features as "Water quality feature — no build or storage area". Please remove trees and other types of landscaping from the water quality features. Please show the volume of the water quality features on the plat. The applicant shall indicate on the plat the type of easement and indicate the 60 - foot wide non-exclusive access and utility easement to provide adequate access to the parcel. Each parking space shall be equipped with wheel guards or curb blocks when necessary to prevent vehicles from extending beyond the boundary of the space and from coming into contact with other vehicles, walls, fences or planting. These shall be indicated on the plat. (Department of Public Works) 11. A stop sign prior to entering County Road 2 shall be indicated on the plat. (Department of Public Works) 12. A tracking pad (concrete or asphalt) running from the access into the facility off of County Road 2 to the north for a minimum distance of 300 -feet shall be indicated on the plat. Written evidence of Public Works approval shall be provided to the Department of Planning Services. (Department of Public Works) E. The applicant shall attempt to address the requirements of the Hudson Fire Protection District as stated in their referral response received October 14, 2009. Written evidence of such shall be provided to the Department of Planning Services. (Hudson Fire Protection District) F. The applicant shall submit a dust abatement plan, for on -site dust, for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. Written evidence of Health Department approval shall be provided to the Department of Planning Services. (Department of Public Health & Environment) G. The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application from the Air Pollution Control Division, Colorado Department of Health and Environment, if applicable. Alternately, the applicant can provide evidence from the APCD that they are not subject to these requirements. Evidence of such shall be provided to the Department of Planning Services. The applicant shall submit written evidence to the Environmental Health Services Division of the Weld County Department of Public Health & Environment, from the Colorado Division of Water Resources, demonstrating that the well is appropriately permitted for the commercial use. Evidence of such shall be provided to the Department of Planning Services. (Department of Public Health & Environment) In the event that 1 or more acres are disturbed during the construction and development of this site, the applicant shall obtain a stormwater discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and Environment. Evidence of such shall be provided to the Department of Planning Services. (Department of Public Health & Environment) J. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: USR-1721 LaCoe Page 5 of 10 • • • 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). Evidence of Health Department approval shall be provided to the Department of Planning Services. (Department of Public Health & Environment) K. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the Weld County Department of Planning Services. (Department of Planning Services) 2. Upon completion of 1. above the applicant shall submit a Mylar plat along with all other documentation required as Conditions of Approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services' Staff. The plat shall be prepared in accordance with the requirements of Section 23-2-260.D of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty (60) days from the date of the Board of County Commissioners resolution. The applicant shall be responsible for paying the recording fee. (Department of Planning Services) 3. The Department of Planning Services respectively requests the surveyor provide a digital copy of this Use by Special Review. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files format type is .e00. The preferred format for Images is .tif (Group 4). (Group 6 is not acceptable). This digital file may be sent to maps(o.co.weld.co.us. (Department of Planning Services) 4. The special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. In accordance with Weld County Code Ordinance 2005-7 approved June 1, 2005, should the plat not be recorded within the required thirty (30) days from the date the Board of County Commissioners resolution a $50.00 recording continuance charge shall added for each additional 3 month period. 6. Prior to release of Building permits: A. A separate building permit shall be obtained prior to the construction of any structure. (Department of Building Inspection) B. A plan review is required for each building for which a building permit is required. Two complete sets of plans are required when applying for each permit. Commercial building plans are required to bear the wet stamp of a Colorado registered architect or engineer. (Department of Building Inspection) C. Buildings shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2006 International Building Code; 2006 International Mechanical Code; 2006 International Plumbing Code; 2006 International Fuel Gas Code; and the 2008 National Electrical Code, 2006 International Energy Conservation Code and Chapter 29 of the Weld County Code. Each residential building will require an engineered foundation based on a site -specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. (Department of Building Inspection) E. Fire resistance of walls and openings, occupancy type, construction requirements, automatic sprinkler requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Weld County Code. (Department of Building Inspection) F. Building height shall be measured in accordance with the 2006 International Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. When measuring buildings to determine offset and setback requirements, buildings are measured to the farthest projection from the building. Property lines shall be clearly identified and all property pins shall be staked prior to the first site inspection. (Department of Building Inspection) G. Provide letter of approval from Hudson Fire Protection District prior to construction of any structure. (Department of Building Inspection) 7. Prior to issuance of Certificate of Occupancy: A. An individual sewage disposal system is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. (Department of Planning Services) 2. Approval of this plan may create a vested property right pursuant to Section 23-8-10 of the Weld County Code. (Department of Planning Services) 3. The Special Use Permit shall not be transferable to any successors in interest to the prescribed property and shall terminate automatically upon conveyance or lease of the property to others for operation of the facility. (Department of Planning Services) 4. Hours of operation (hauling hours for vehicles and equipment) shall be from 6:00am to 6:00pm Monday through Saturday. This restriction shall not apply to operation of administrative and executive offices or repair facilities located on the property. (Department of Planning Services) 5. The site shall be limited to no more than thirty (30) employees on site. (Department of Planning Services) 6. The easement shall be a graded and drained road to provide an all-weather access. (Department of Public Works) 7. Each parking space shall be equipped with wheel guards or curb blocks when necessary to prevent vehicles from extending beyond the boundary of the space and from coming into contact with other vehicles, walls, fences or planting. (Department of Public Works) 8. Weld County is not responsible for the maintenance of drainage related structures. (Department of Public Works) 9. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. (Department of Public Health & Environment) 10. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. Any vehicle or equipment washing areas shall capture all effluent and prevent discharges in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. (Department of Public Health & Environment) 14. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. (Department of Public Health & Environment) 15. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in Section 14-9-30 of the Weld County Code. (Department of Public Health & Environment) 16. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. (Department of Public Health & Environment) 17. Adequate toilet facilities (portable toilets) and hand washing units shall be provided during the construction of the facility. (Department of Public Health & Environment) 18. Bottled water shall be utilized for drinking during construction of the project. (Department of Public Health & Environment) 19. Adequate hand washing and toilet facilities shall be provided for employees and patrons of the facility, at all times. (Department of Public Health & Environment) 20. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. The facility shall utilize the existing commercial well. (Department of Public Health & Environment) 21. All potentially hazardous chemicals must be stored and handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. (Department of Public Health & Environment) 23. This application is proposing a well as its source of water. The applicant should be made aware that while they may be able to obtain a well permit from the Office of the State Engineer, Division of Water Resources, the quantity of water available for usage may be limited to specific uses, i.e. domestic use only, etc. Also, the applicant should be made aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment. We strongly encourage the applicant to test their drinking water prior to consumption and periodically test it over time. (Department of Public Health & Environment) 24. The operation shall comply with all applicable rules and regulations of the State and Federal agencies and the Weld County Code. (Department of Public Health & Environment) 25. Should noxious weeds exist on the property or become established as a result of the proposed development the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code. Sources of light shall be shielded so that light rays will not shine directly onto adjacent properties where such would cause a nuisance or interfere with the use on the adjacent properties in accordance with the plan. Neither the direct nor reflected light from any light source may create a traffic hazard to operators of motor vehicles on public or private streets. The property owner shall allow any mineral owner the right of ingress or egress for the purposes of exploration development, completion, recompletion, re-entry, production and maintenance operations associated with existing or future operations located on these lands. The property owner or operator shall be responsible for complying with the Operation Standards of Section 23-2-250, Weld County Code. 33. Personnel from Weld County Government shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County regulations. 34. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing standards and all applicable Weld County regulations. Substantial changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 35. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Although we can add a condition of approval I think since this is a violation we need to get that figured out up front. They will also need to apply for a building permit as they say they are not going to use the house in this usr. This is the same situation we ran into with the salvage yard on SH 85. I do not feel comfortable sending this application forward without knowing that they can obtain a commercial well permit and they will be able to get a building permit immediately.
