Board of Assessment Appeals: You have the right to appeal the County Board of Equalization's (CBOE's) decision to the Board of Assessment Appeals (BAA). Such hearing is the final hearing at which testimony, exhibits, or any other evidence may be introduced. If the decision of the BAA is further appealed to the Court of Appeals, only the record created at the BAA hearing shall be the basis for the Court's decision. No new evidence can be introduced at the Court of Appeals. (Section 39-8-108(10), C.R.S.) Binding Arbitration: You have the right to submit your case to arbitration. If you choose this option the arbitrator's decision is final and your right to appeal your current valuation ends. (Section 39-8-108.5, C.R.S.) Selecting the Arbitrator: In order to pursue arbitration, you must notify the CBOE of your intent. You and the CBOE select an arbitrator from the official list of qualified people. If you cannot agree on an arbitrator, the District Court of the county in which the property is located will make the selection. Arbitration Hearing Procedure: Arbitration hearings are held within sixty days from the date the arbitrator is selected. Both you and the CBOE are entitled to participate. The hearings are informal. The arbitrator has the authority to issue subpoenas for witnesses, books, records, documents and other evidence. Your office assigned a 9.4% increase to the value of our home. I was so surprised that I researched the sales of homes within the Mead School District and discovered that on average, the selling prices of homes similar to ours actually dropped by 6.38% from 2007 to 2008. The summary spreadsheet of this data, as well as the actual MLS output used for the research is included herein. I studied home sales from January through June of 2007, and then again from January through June in 2008. I searched on previously owned homes that were greater than 2400 square feet, with 1-5 acres of land, had least a 2 car garage, built since 1985 (and then excluded three homes that were new construction, 2 in 2008 and 2 in 2009). Not only did I notice the average price per square foot drop, but the difference in number of home sales in my area with these qualifications was almost 50% in 2008 compared to what it was in 2007 (12 homes sold in 2007, 7 homes sold in 2008). I also noticed an additional 7 homes with listings which expired or were withdrawn in 2008. Adding these 7 to the 7 that did sell in 2008, we can see there were a similar number of home sale attempts in 2008 (14), but that the owners withdrew or let their listings expire. My hunch is that the owners could not realize the value of their homes, so they decided not to sell. I am asking you to reconsider the valuation of our home, by adjusting it downward by 6.38% from the previous valuation of $427,959, thereby making the NOV value of $400,655.
