NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the hereinabove described parcel of land owned by Mile Hi Sheep Company, be exempt from the definition of the terms, "subdivision" and "subdivided land" pur- suant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and Section 2-1A(3) of the Weld County Subdivision Regulations. The parcel of land in question is described as part of the Ni of Section 30, T7N, R65W of the 6th P.M. , Weld County, Colorado. Said property is located 1 mile north of Eaton. The subject property con- tains 149. 971 acres of predominantly Class II irrigated soils. The request is to split the property into parcels of 2.471 acres and 147. 5 acres. As indicated in a letter dated April 25, 1977 submitted by Melvin Dinner, Legal Council for the Mile Hi Sheep Company, it is the desire and wish of the Mile Hi Sheep Company to split off the 2.471 acre parcel with the improvements thereon and trans- fer them to Mr. and Mrs. Don Godby, who is the president and one of the principal shareholders of the Mile Hi Sheep Company. The Eaton Planning Commission has indicated the requested split complies with their Comprehensive Plan and recommends the Recorded Exemption be approved. 2. The proposed split conforms with the intent clause of the Recorded Exemption procedure (Section 9-2 of the Weld County Subdivison Regulations) , the intent clause of the Agricul- tural District (Section 3. 3 A of the Weld County Zoning Resolution) , and the Weld County Comprehensive Plan in that each resulting parcel would have an existing set of improve- ments, and the use would be compatible with the surrounding agricultural uses. 3. Mr. Godby is also one of the principal shareholders, a director and officer of Mile-Hi Sheep Co. Mr. Godby has sold his home in Arvada and has moved into the 3 bedroom house located on Tract A. It is both Mr. Godby's desire and the wishes of Mile-Hi Sheep Co. to allow him to purchase what is described as Tract A for his own residence. Mr. Godby is now devoting his full time to the activities and operations of Mile-Hi Sheep Co. Mr. Godby and his family desire to purchase what is described as Tract A as their permanent residence. Tract B will continue to be owned by Mile-Hi Sheep Co. and to be utilized for irrigated farming purposes. With reference to your inquiry concerning adequate supplies of domestic water for both tracts, this letter shall serve to indicate to you that the improvements located on Tract A are serviced by a domestic well and Tract B is also serviced by a separate domestic well, each of which are located on the premises. The domestic well which services and supplies the improvements on Tract A has been in existence for a period in excess of 50 years according to the information provided to Mr. Godby and Mile-Hi Sheep Co. The former owner ,June Groves, who lived on the property and used this domestic well for approximately 30 years, has indicated to Mr. Godby and Mile-Hi Sheep Co. that there has been at ample, available supply of water, quantatively and qualitatively for the entire period she owned the property. Water from North Weld County Water District is also available for both Tract A and Tract B. The present water line is approximately 1 1 miles from the improvements located on Tract A. The domestic well which services and supplies Tract B was drilled and installed in January of 1964 and carries Permit No. 18433 with issue date of January 15, 1964 from the Ground Water Administration of the Office of the State Engineer, Division of Water Resources. This particular domestic well has a rated capacity of 15 gpm.
