RE: APPROVE AGREEMENT FOR TRANSFER OF ENTITLEMENTS TO CITY OF
STERLING, COLORADO, AND AUTHORIZE CHAIR TO SIGN - FEDERAL AVIATION
ADMINISTRATION
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Agreement for Transfer of Entitlements
to the City of Sterling, Colorado, among the County of Weld, State of Colorado, by and through the
Board of County Commissioners of Weld County, the City of Greeley, the Greeley -Weld County
Airport Authority, and the Federal Aviation Administration, commencing upon full execution, with
further terms and conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Agreement for Transfer of Entitlements to the City of Sterling, Colorado,
among the County of Weld, State of Colorado, by and through the Board of County Commissioners
of Weld County, the City of Greeley, the Greeley -Weld County Airport Authority, and the Federal
Aviation Administration be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 25th day of February, A.D., 2009.

Please find attached five (5) original copies of the above referenced document. Your
assistance in having each document executed after approval by the Board is
appreciated.
Please note, as with other FAA documents executed in the past, that the Certificate of
Sponsors Attorney block must be dated on or after the date of execution by the Board.
Once execution is complete on the part of Weld County, please return all five original
copies to me for further execution by the City of Greeley and the Airport Authority.
Upon execution by all parties, one original copy will be returned to you for the County's
permanent records. Thank you in advance for you assistance.

Enclosed are five copies of the Airport Improvement Program (AIP) "Agreement for Transfer of
Entitlements". This agreement will transfer $150,000 of fiscal year (FY) 2009 federal funds from the
City of Greeley and the County of Weld, Colorado, and the Greeley -Weld County Airport Authority
to the City of Sterling, Colorado. Please complete this agreement by having the authorized officials
execute the appropriate sections. Certification by the attorney should be completed following
the acceptance and dated on or after the acceptance date.
Your normal procedures for accepting documents such as this in accordance with local and state law
should be followed, but evidence of such procedure is not required by the Federal Aviation
Administration.
After execution and certification of the "Agreement For Transfer of Entitlements", please return
two copies to this office. The other copies are for your records.

Pursuant to our phone discussion earlier, please find the above document attached. As
noted for explanation purposes, the FAA grant received by the City, County and Airport
Authority in 2008, included $150,000 of funding which was advanced to us by the FAA.
Those funds were originally programmed for Sterling, CO, but since they did not have a
project underway last year, they were re -programmed for Greeley, with the
understanding that we would waive receipt of our entitlement funds in 2009 in order to
re -pay Sterling. The Greeley -Weld County Airport did in fact receive these funds, and
used them to further progress the airport perimeter fencing project in 2008.
The FAA has recently begun requiring the execution of these documents, which was not
done in prior years when similar actions took place. Given there are no fiscal impacts,
our question was whether or not this agreement needed to be formally approved by the
BOCC or not.

AGREEMENT FOR TRANSFER OF ENTITLEMENTS
In accordance with section 47117(c)(2) of Title 49 U.S.C. (hereinafter called the "Act"):
The CITY OF GREELEY and the COUNTY OF WELD, COLORADO, and the GREELEY-WELD COUNTY
AIRPORT AUTHORITY
Hereby waives receipt of the following amount of funds apportioned to it for each fiscal year specified under section
47114(c)(1) of the Act.

On the condition that the Federal Aviation Administration makes the waived amount available to:
