RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST RICK AND TERESA DUDDEN FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Rick and Teresa Dudden, VI #0500006, are allegedly in violation of the Weld
County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 8th day of September, 2009, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Rick Dudden, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until March 8, 2010, to allow adequate time for the property owners to obtain a new
permit, complete all the inspections, and have a Certificate of Occupancy issued to bring the
subject property into compliance.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that VI #0500006 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Rick and Teresa Dudden to remedy the violation of the Weld County
Code, and any other persons occupying the properties, any persons claiming an interest in the
properties, and any persons acting in active concert with the identified parties, with an instruction
for delay of action upon such referral until March 8, 2010, to allow adequate time for the property
owners to obtain a new permit, complete all the inspections and have a Certificate of Occupancy
issued to bring the subject property into compliance.

This letter is to remind you that a permit for a manufactured home with two wing additions at 8614 County
Road 29.5 was issued on June 30, 2008. According to our records, this permit will expire on December 30,
2008, and all of the required inspections have not been completed.
Article VIII, Section 29-8-40 of the Weld County Code states that:
Every permit issued by the Building Official under the provisions of the Building Code shall expire by limitation
and become void after the given utilization period has elapsed. The utilization period begins on the date of
permit issuance.
If the building or work authorized by a Building Permit has not received final inspection by the permit expiration
date, all work shall stop until a new permit is issued.
Article VIII, Section 29-8-45 states:
A. The Building permit holder may submit a request for an extension of time before the expiration of the
utilization period. The Building Official may extend the Building Permit one time, for a period not to
exceed 180 calendar days. Such request shall include name, address, telephone number, the building
permit number, site address and a description of specific circumstances which prevented completion of
the work prior to the expiration date. A $42.00 fee shall be charged if a building permit extension is
granted.
B. If the Building Permit expires before a request is submitted for an extension, an extension shall not be
granted. To proceed with the same project the following process shall be required:
1. A new permit must be obtained.
2. The full permit fee must be paid along with any other applicable fees.
3. The applicant must comply with all applicable codes and regulations in effect at the time the new
permit application is submitted.

On October 25, 2007, the above noted permit for a manufactured home with wing additions at 8614 County
Road 29.5 was approved for issue. That plan review will expire on April 25, 2008.
Section 29-3-230 of the Weld County Code states that:
Applications for which no permit is issued within one hundred eighty (180) days following the date of
application shall expire by limitation, and plans and other data submitted for review may thereafter be returned
to the applicant or destroyed by the Building Official. The Building Official may extend the time for action by
the applicant for a period not to exceed one hundred eighty (180) days upon request by the applicant showing
that circumstances beyond the control of the applicant have prevented action from being taken. No
application shall be extended more than once. In order to renew action on an application after expiration, the
applicant shall resubmit plans and pay a new plan review fee.
Failure to pick up the permit and pay the permit fee of $211.75 by the expiration date will result in a violation
notice and is subject to go before the Board of County Commissioners with written notice.

with wing additions at 8614 County Road 29.5 was submitted on May 1, 2006. This is the third permit that has
been issued for this property. The first two permits (PRS-043031 and PRS-053022) were expired due to lack
of inspections.
This home has now been on the site for some time and there are numerous inspections to be completed. At
this time, the property is in violation for a building with no permit. Failure to pay the balance due of $211.75
and pick up the permit within 10 days from the date of this letter will result in a notice to appear before the
Board of County Commissioners.

I am writing this letter to request an extension on my building permit at: 8614 WCR 29 '/
in Fort Lupton. We have been working on building our house a little at a time and it has
not gone very quickly. It has been our hope that we could put this place together in our
free time, paying for it as we went. Both money and free time have been limited, and this
project has taken longer than expected.
Should my request to extend the building permit be granted, 1 understand that it would be
my duty to do everything in my power to complete this project by April 21', 2006

violations. The property is in violation of the following Sections of the Weld County Code:

Section 29-7-120 "Required inspections."
Section 29-7-130 "Certificate of occupancy"

This meeting will take place at the Weld County Planning Department Office, 918 10th Street, Greeley,
Colorado. It is recommended that you or a representative be in attendance at this meeting to answer any
questions the Board of County Commissioners might have regarding the violation.
The Department of Building Inspection will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate that
you were made aware of the nature of the violation, the action necessary to correct the violation, and that you

completed. Section 29-7-130 of the Weld County Code states that a certificate of occupancy shall be obtained
on all mobile, manufactured, or factory -built homes no later than one hundred eighty (180) days after the
permit is issued. In the event the certificate of occupancy is not issued by the expiration date, a meeting may
be scheduled with the Board of County Commissioners to review the violation. The Board will determine if an
extension is warranted or if the case should be referred to the County Attorney for legal action.

before the Board of County Commissioners to consider whether to refer the violation to the County Attorney's
Office for legal action.
