Everist Golden Pit,CrriyUSR-1255 _ Dear Julie: The Department of Planning Services is in receipt of your letter dated June 12, 2009 requesting clarification of the permitting process required for, in this instance, the city of Aurora to utilize the previously mined and reclaimed L.G. Everist Golden Pit, slurry lined reservoir, for augmentation and exchange purposes. The Departments of Public Works and Planning Services in consultation with the County Attorney's office have determined that a new Special Use Permit is warranted. This determination is based on findings of the substantial improvements that will be required of the existing permit, including yet not limited to piping, pump structures, pump stations, electrical transformers, headgates, inlet and outlet weir structures and all associated improvements to the existing lined reservoir. It is the opinion of Weld County that Section 23-2-400 Major Facility of a Public Utility or Public Agency applies to this proposal. The definition is as follows: MAJOR FACILITIES OF A PUBLIC UTILITY OR PUBLIC AGENCIES: Public Utilities or Public Agencies operating or constructing a mine, ELECTRIC TRANSMISSION LINES, commercial radio transmission towers, cellular and other wireless communication towers, domestic water storage facilities, POWER PLANTS, SUBSTATIONS of electrical utilities, wastewater treatment facilities, water treatment facilities, including extensions, expansions or enlargements thereof, STORAGE AREAS of utilities providing electricity, water. wastewater and natural gas or other petroleum derivatives, including extension, expansions or enlargements thereof PIPELINES of utilities providing natural gas or other petroleum derivatives, including extensions, expansions or enlargements thereof road, park or other a009-39/6 pi. 1370 public way, ground or space, public building or structure or public utility, whether publicly or privately owned. Everist, Inc. is writing to formally respond to your letter of June 9, 2009, sent to Eric Scott of the Colorado Division of Reclamation Mining and Safety (DRMS). In your letter, -you noted some floodplain requirements and concerns related to the DRMS's partial release of the Golden property of L.G. Everist's Fort Lupton Sand and Gravel Mine. With this letter, we shall reiterate what was discussed last Friday, including clarifying L.G. Everist, Inc.'s intentions at the Fort Lupton Sand,and Gravel Mine, and clear up any miscommunicationsthat may have unfortunately occurred. • - - The Fort Lupton:mine is under, the following permits, as applicable to items addressed inthis letter: Colorado DRMS 112 Reclamation Permit M-1999-120, Weld County Use By Special Review AmUSR-1255, and Weld County Flood Hazard Development Permit AmFHDP-355. On May 18, 2009, the Colorado Division of Reclamation, Mining, and Safety (DRMS) approved a partial release of the Fort Lupton Sand and,Gravel mine, DRMS Permit M-1999-120. The partial release was only for the Golden phase which (a) is approximately 36 acres, (b) is only one part of the Fort Lupton Sand and Gravel Mine site, and (c) is one of many separate legal parcels making up the permitted area. The majority of the Fort Lupton site is still being mined and reclaimed, and is covered by a bond of $997,872.00. The Golden phase has been fully reclaimed as a lined water storage reservoir in compliance with the Colorado DRMS permit, and the County USR and FHDP permits. We do not know where the misinformation about permanent berms came from, but we can assure you that there are no berms on the Golden property, and no plans for permanent berms in other parts of the Fort Lupton site. An attached copy of the most recent DRMS Reclamation Plan (Dec -2007) shows no berms at final reclamation of the site. Please note that L.G. Everist has made no changes to our approved reclamation plan or placed any permanent fill on the floodplain which are the factors you listed that would require a detailed floodplain study and/or a Letter of Map Revision to be submitted to.FEMA. - • •_ - - We also discussed the futurePartial Vacation (of,the Golden phase), of Ar1iUSR-1.255, which L.G. Everist is working on with Weld County Planning. L.G. Everist was going to do the Partial Vacation of the USR immediately after the DRMS release. , However, we Kaye since decided to maintain our USR over the Golden property,to make sure that the property -Is protected from outside interests until the City of Aurora is ready to take over the property with their own USR. Everist to use as water storage. Aurora is planning to purchase the other properties/phases from the Fort Lupton site as L.G. Everist reclaims and releases them. Any improvements or changes that Aurora is planning to make to the Golden property (and future properties) - and which may or may not affect floodplain regulations - will not occur until L.G. Everist has received a Partial Vacation of our USR for the Golden property and Aurora has taken over the property with their own USR (and all associated requirements, including a FHDP). Finally, L.G. Everist would like to address the recurring neighbor complaints about flooding that we discussed last Friday, and you mentioned in your letter. As you know, L.G. Everist addressed neighbor complaints, DRMS requirements, and Weld County FHDP conditions last year with (a) the complete removal of the temporary topsoil stockpiles in the Golden property (April 2008) and (b) a floodplain study done by Deere and Ault (dated 12/09/08). The floodplain study proved that our operations have no affects on flood flows. In your approval of the study (dated 12/31/08), it was noted that 'Weld County agrees that the Fort Lupton Sand and Gravel Mine does not appear to adversely impact adjacent properties. In fact, in most of the cross sections, the existing water surface elevations appear to decrease slightly when compared to the pre -mining condition water surface elevations." So, with all the work we did and having the matter seemingly cleared up last year, it came as quite a shock to read the allegation in your June 9 letter that' 'Weld County is aware that the berms around the Fort Lupton Sand & Gravel site have likely pushed floodwaters off onto adjacent properties." We will repeat again - there are no berms on the Golden phase, and there are no plans for permanent berms after reclamation anywhere on the site, and the flood plain study (which was approved) proved that our mining operations are not affecting flood flows. Furthermore, on June 4, 2009, a DRMS representative met with one of the neighbors on his property and came over to inspect the Fort Lupton site immediately afterward. He found that there was nothing on the Fort Lupton site that could be contributing to flooding of the neighbor's property across the river. Please see the attached inspection report. We hope this letter clears up the concerns and objections you have to the DRMS partial release and to the future USR Partial Vacation, and we apologize for any miscommunications. Mr. Russ Bachofer sent a letter to DRMS alleging that activity associated with the Ft. Lupton Sand and Gravel site (M1999-120) or other mining activity in the vicinity had impacted the flood plain morphology sufficiently to cause flooding on his property that would not be otherwise occurring. Mr. Bachofer also made the same compliant previously, in the spring of 2008. At that time DRMS representatives Peter Hays and Erica Crosby inspected the site, the surrounding area, and reviewed the site files for M1999-120. It was determined that the mine needed to move some soil stockpiles that were located in the flood plain, and conduct a flood plain analysis to comply with Weld County's Flood Hazard Development Plan requirements. The mine complied and the soil stockpiles were removed entirely from the flood plain, and a floodplain analysis was conducted and submitted to Weld County for review and approval. On December 31, 2008, Weld County approved the flood hazard analysis and stated that Ft Lupton Sand and Gravel had adequately demonstrated that the operation does not negatively impact the flood plain, and was in compliance with their approved flood hazard development plan. At that time DRMS considered the matter to be resolved and Ft Lupton Sand and Gravel to be in compliance. No increases were shown by the flood plain analysis modeling that were even near the one -foot allowable increase, and for currently existing conditions over most of the site, the 100 year water surface profile is equal to or even less than the pre -mining condition. On June 4, 2009, DRMS representatives Eric Scott, Peter Hays, and David Bird met with Mr. Bachofer at 9:00 on his property to respond to this latest complaint and examine the situation. It was apparent that water had indeed risen to the level of the walk -out basement of the home. Upon inspection of the property, and contour mapping taken from 2008 aerial photography, it was apparent that the home and associated garage were constructed on top of an approximately three to four foot high bench along the east bank of the river in that location. It appears that in this area this bench is functionally the eastern limit of the floodplain. It also corresponds with the delineation of the eastern 100 yr floodplain boundary in the area as depicted on the FEMA floodplain map. There is minimal elevation change in the area between the base of the bench and the top of the riverbank. This bench was removed along the west side of the home to create the entrance to the walk -out basement. The basement exit as constructed is at the base of this three to four foot bench, and therefore "walks - out" onto the level of the local floodplain. Because of this configuration, any time the river tops its banks, very little additional increase in water level is necessary to impact the basement of the home. Also note that the 100 year flood plain, by definition, contains many areas that are flooded much more frequently. The area behind the house may, in fact, also be within the annual or 5 year floodplain. DRMS then inspected the west side of the river in that area to determine if any recent changes have occurred associated with mining that may contribute to the reported flooding. None were observed. During the inspection of the western riverbank it was noted that the river had also left its banks on the west side in several areas and has encroached onto the mine property and other properties on the west side of the river. This would seem to indicate that the river is not being significantly constrained by activities associated with the mine, and is in fact leaving its banks on both sides during flood events. Until such time that it can be demonstrated that there is a direct correlation between the mining activities and adverse off site flooding impacts, or that flood plain development compliance requirements are no longer being met, DRMS has no authority and therefore considers this matter closed. The Division has also received and reviewed the letter dated June 9, 2009 sent by Weld County objecting to the proposed release, and there are a couple of points that we would like to clarify. This is only a partial acreage release for the 36 acres of the Golden phase of the Ft Lupton site. 256 acres will remain in the active mining permit. DRMS will also continue to hold $997,872 in bond for the remainder of the site. The site was inspected prior to the release decision, and no permanent berms were left in place anywhere as part of the final reclamation configuration of the Golden Phase. The presence of permanent berms would have halted the final release of the area as there were no berms included in the approved reclamation plan for the area. The final reclamation configuration of the Golden phase meets the Division's standards and requirements and the current approved reclamation permit for the site. The remaining issues raised by Weld County in this letter are not within the jurisdiction of the Division, therefore we would encourage you to seek resolution of these matters with the operator where appropriate. The Division cannot enforce another regulating entity's requirements, and any objections made regarding the Division's decision to approve the partial release must be based on the failure of the operator to comply with DRMS requirements. Regulations and requirements imposed on the operator by other entities such as CDPHE, ACOE, FEMA or Weld County must be enforced by those entities. Everist Golden Pit, permitted in Weld County under AmUSR-1255 approved for mining, with the final reclamation being a slurry wall lined reservoir used for water storage. As background, the City of Aurora owns certain water rights and will soon own the reservoir. The City intends to store some of those water rights in the reservoir at the Golden Pit for augmentation and exchange purposes. The City anticipates constructing inlet and outlet structures, including pump stations and headgate diversions from a ditch into the reservoir and deliver water back to the river through a diversion structure. While'waking in the Weld County Planning Department and in the private sector for many clients with mining permits, it has been my experience that there are many entities, including municipal entities, water conservation districts and other water districts which utilize reservoirs on previous gravel mining sites for the storage of their water rights with no further permitting through Weld County. I have spoken to several Planners on several occasions as far back as July of 2007 regarding this and have been told that if the water is stored within approved water storage facilities that no further land use permits are required with the exception of potential Building Permits and/or potential Flood Hazard Development Permits. The City of Aurora will be completing its purchase of the property from L.G. Everist in the next couple of weeks and would like written confirmation that no further amendment of the existing USR, or new USR permit, is required for - the construction of the pump station or inlet/outlet structures, and the use of the reservoirs as - water storage. The seeding was completed in April and a copy of the invoice and ticket are attached. Please see the two Reference paragraphs below for more details. Reference - Golden Phase bonding: In January 2009, the bond monies associated with the sluny wall around the Golden phase were released. The slurry wall had been previously certified by the State Engineer. The slurry wall bond release came in conjunction with a bond increase for other parts of the site as part of Technical Revision TR-3. We are including copies of two relevant documents for easy reference: (a) the Division's TR-3 approval letter releasing the bond monies for the Golden slurry wall,. and (b) the State Engineer's certification letter approving the slurry wall lining. Everist asked that the bond be released on the Golden Phase of the Fort Lupton Sand & Gravel Pit. The pit's reclamation plan calls for the site to be reclaimed to water storage reservoirs. Weld County Public Works understands that L.G. Everist is in the process of selling the water storage reservoirs to the City of Aurora. It should be noted that the mined area is located within the floodplain and floodway of the South Platte River. As such, L.G. Everist and the City of Aurora must ensure that the reclaimed status of the gravel pits are in compliance with FEMA's NFIP, the State -of Colorado, and Weld County floodplain regulations. FEMA's Flood Insurance Rate Map (FIRM) Panel number 080266-0855C, dated September 28, 1982 shows the mined area as Zone A meaning that the floodplain boundaries are approximate and no base flood elevations (BFE) have been determined; and further, the floodway has been mapped. As described in FEMA document number 480, Floodplain Management Requirements, if no BFEs have been established or no floodway has been mapped the entire floodplain must be considered to be floodway until a detailed study delineates where the floodway is located and a BFE is determined. Weld County Flood Hazard Development Permit number 355 was issued for the gravel pit. The FHDP allows L.G. Everist to place fill in the floodplain as part of the mining activity because the fill material is considered temporary. However, it does not allow for the placement of permanent fill in the floodplain. Weld County understands that several berms placed around the perimeter of the mine site during mining will be left after the site is reclaimed. Floodplain regulations for FEMA and Weld County prohibit the placement of permanent fill in the floodplain and floodway unless it has been demonstrated that the fill does not cause an impact on surrounding properties and will be erosional stable during a flood. The regulations require that prior to the placement of fill in the floodway, a detailed study must be performed to show what impact the fill will have on the floodplain and floodway. The gravel pit is also covered under Amended Use by Special Review Permit number AmUSR-1255. L.G. Everist and the City of Aurora have not yet amended the permit to include the water storage reservoirs that will exist after mining is finished. Weld County is aware that the berms around the Fort Lupton Sand & Gravel site have likely pushed floodwaters off onto adjacent properties. As DRMS is aware, there are Weld County residents who have been complaining that those berms have been causing their properties located east of the site to be flooded more frequently. Weld County objects to the release of the reclamation bond for this area because L.G. Everist has not provided an approved LOMR as required by the federal, state, and local floodplain regulations. They have not amended their FHDP for the reclaimed uses. They have not adequately demonstrated that they are not pushing floodwaters off onto surrounding landowners.
