RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST JAVIER BARRON-SIXTOS FOR VIOLATION OF THE WELD COUNTY
CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Javier Barron-Sixtos, ZCV #0900038, is allegedly in violation of the Weld
County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 16th day of June, 2009, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Rosaleta Barron, property owner's representative, was present at said hearing,
and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until July 16, 2009, to allow adequate time for the property owner to complete the well
permit and survey, and submit a Use by Special Review Permit application to bring the subject
property into compliance and for an inspection of the property by the Department of Planning
Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV #0900038 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Javier Barron-Sixtos to remedy the violation of the Weld County
Code, and any other persons occupying the properties, any persons claiming an interest in the
properties, and any persons acting in active concert with the identified parties, with an instruction
for delay of action upon such referral until July 16, 2009, to allow adequate time for the property
owner to submit a Use by Special Review Permit application to bring the subject property into
compliance.

June 15, 2009. In order to meet this deadline, the 4 packets for the 7 Day Completeness Review shall
be submitted before June 1, 2009. Any necessary corrections shall be completed and the remaining
paperwork shall be submitted prior to June 15, 2009. If this is completed, the above Violation Hearing
will be cancelled.
RECOMMENDATION
The Department of Planning Services recommends this case be forwarded to the County Attorney's
Office for immediate legal action.

On Thursday, March 19, 2009 an informal discussion took place at the Greeley Administrative
Offices Conference Room regarding a proposed business/storage of equipment. (The legal
description is Lot A RE -2266 Section 16, Township 2 North, Range 66 West of the 6th P.M.;
Situs Address is 14494 CR 22)
Background Information:
The applicant purchased the subject property approximately 3 months ago. The site is used for
storage of equipment as well as an office for the business. There is a vacant house which
contains the office.
The hours of operation are from 6 am to 6 pm with 23 employees. The majority of the
employees (approximately 15 at time of application) park their personal vehicles and leave in
company vehicles. Three to four employees remain on site through out the day.
Health Department
Water is provided through a well. The applicants are unsure of the classification of the well and
will contact the Division of Water Resources for further information.
There is a septic system located on site. Upon research staff found a Statement of Existing
Permit No. SE9700118. With the number of employees who come to the site, the applicants will
need to have an engineer evaluate the septic system for adequacy. Staff encouraged the
applicants to visit the Health Department website at
http://www.co.weld.co.us/departments/health/environmental for a listing of engineers.
Based on the approximate location of the well and septic system, staff advised the applicants to
measure the distance as they may need to relocate the septic system if it is less than 100 feet
apart.
The applicants indicated that they wash their vehicles on site. Staff encouraged them to not
wash their vehicles on site as they would then need to apply for an additional permit through the
State and would need to follow another set of regulations.
Heavy equipment is taken in for maintenance and fluid changes. The applicants indicated that
they change the oil in their company vehicles on site and deliver the oil to Auto Zone.
The applicants commented that they brush paint on the stairs in the shop building. Staff stated
that they will need to provide MSDS sheets on the paint which is stored on site.
Public Works
CR 22 is a paved road with a 60 foot of right-of-way. Staff advised the applicants that the future
right-of-way will be 80 feet.
The access and driveway is road based material.
No Traffic Study is required.
The applicants will need to identify on the Site Plan the parking locations for the employees as
well as for the equipment.
No Drainage Report is required; however a water quality feature will need to be located on site.
This may be accomplished by placement of a berm in the southwest quarter of the site.
Planning Department
The applicants indicated that the house located on site may potentially be lived in the future.
They also commented that they may have up to 30 employees.
There are currently two motion lights located on the shop building. No other lighting is on site.
There is a chain link fence running parallel to the front of the property. Staff informed the
applicants that they would be required to screen the equipment using an opaque fencing. A
gate controls the access to the business.
Staff explained that the existing buildings (shop & storage) may need building permits as they
were most likely Ag Exempt buildings. In addition to applying for the change of use for the
buildings there will be additional fees such as Road Impact Fees, Capital Expansion and
Stormwater Drainage fees.
The site is currently in violation (ZCV09-00038). The applicant will need to submit a completed
application prior to June 16, 2009 for the hearing to be canceled.
Staff explained the USR process - that the applicant shall submit 4 packets for a 7 day
completeness review. Once the 7 day completeness review is complete the applicant will be
informed of what items are still required to make the application complete. After the completed
application is submitted it will be sent out for referral for 28 days. The applicant will then meet
with their Planner to discuss the referrals and address as many of the referrals as possible. At
the meeting the Planning Commission hearing will be scheduled. The Board of County
Commissioners hearing typically follows approximately 3 weeks after the Planning Commission
hearing.

PRE -APPLICATION REVIEW REQUEST
The pre -application request is the preliminary review of a land use proposal. Pre -application reviews are required
prior to beginning the application process; however, this review is not an application.
Pre -application reviews are held with the Weld County Departments of Public Works and the Public Health and
and Environment. Pre -Application reviews are held Thursday and Friday of any given week in the Greeley office.
To be on the pre -submittal agenda, the request and required checklist items must be received one week prior to
the review date, and shall include at a minimum, a description of the property including surrounding lands and land
uses, property owners name and contact information, a brief narrative and a map delineating the property location,
in addition to the other items listed.
