HomeMy WebLinkAbout20090352.tiffRESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST JOSE AND HILDA HERNANDEZ FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Jose and Hilda Hernandez, ZCV #0800266, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 10th day of February, 2009, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Hilda Hernandez, property owner, and her son Adrian Hernandez, were present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until April 20, 2009, to allow adequate time for the property owners to restore, remove or screen the noncommercial junkyard from all adjacent properties and public rights -of -way to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. REMEDY 2009-0352 Violation Summary Report As I indicated in my previous letters the utilization of a camper/trailer as a dwelling unit is not an allowed use in the Agricultural Zone District. The only unit that can be occupied as a dwelling is the house, no other structures are approved as dwelling units on this property. The Camper/trailer shall be removed from the property or disconnected from ALL utilities. Also as I previously noted there are several DERELICT VEHICLES and a small amount of miscellaneoud debris was present. While the presence of a NONCOMMERCIAL JUNKYARD consisting of DERELICT VEHICLES and miscellaneous debris is an allowed use within an Agriculturally zoned subdivision, such as Aristocrat Ranchettes, it must be completely SCREENED from all adjacent properties and public rights -of -ways; otherwise, any Derelict Vehicles shall be operational at all times and evidence of current registrations shall be submitted to this office. RECOMMENDATION The Department of Planning Services recommends this case be forwarded to the County Attorney's Office for immediate legal action. She said she was calling on behalf of her father (Jose Hernandez). She said he received a letter about someone staying in the camper/trailer. She said her father told her that he has a son (about 20 years old) who occasionally stays in it. She said the grandkids also play in it, so it is connected to eletricity. She said he wanted to know if he had to remove it or what. I explained that 2 (two) things would need to happen. 1.) It would need to be disconnected from all utilities. 2.) I would need to receive a letter from Mr. Hernandez indicating that no one will stay in it at any time. I explained that even if it is occassional, it is illegal for any one to occupy it while it is at this property. She said she would tell her father. Upon a visual inspection of the property, the following items were noted: camper/trailer is still present and appears to be connected to utilities. I also noted several Derelict Vehicles and a small amount of miscellaneous debris. No pictures were taken during this inspection.
