RE: APPROVE MEMORANDUM OF UNDERSTANDING CONCERNING THE JUVENILE
ASSESSMENT CENTER AND AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Memorandum of Understanding
Concerning the Juvenile Assessment Center among the County of Weld, State of Colorado, by and
through the Board of County Commissioners of Weld County, on behalf of the Department of
Human Services, the Centennial Board of Cooperative Education Services (BOCES), and the
Juvenile Assessment Center (JAC), commencing July 1, 2009, and ending June 30, 2010, with
further terms and conditions being as stated in said memorandum, and
WHEREAS, after review, the Board deems it advisable to approve said memorandum, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Memorandum of Understanding Concerning the Juvenile Assessment
Center among the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Department of Human Services, the Centennial
Board of Cooperative Education Services (BOCES), and the Juvenile Assessment Center (JAC)
be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said memorandum.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 28th day of September, A.D., 2009, nunc pro tunc July 1, 2009.

Memorandum of Understanding among the Weld County
Department of Human Services, Centennial Board of
Cooperative Education Services and the Weld County
Juvenile Assessment Center
Enclosed for Board Approval is the Memorandum of Understanding among Weld County
Department of Human Services, Centennial Board of Cooperative Education Services and the
Weld County Juvenile Assessment Center, concerning the Weld County Juvenile Assessment
Center. This Memorandum of Understanding was presented at the Board's August 17, 2009,
Work Session.
This is a continuation of services. The JAC will continue to provide a work site. Centennial
BOCES will provide the JAC with one full-time employee. The Department of Human
Services will provide $39,278 to Centennial BOCES.
The term of this Memorandum of Understanding is July 1, 2009 through June 30, 2010.

MEMORANDUM OF UNDERSTANDING AMONG WELD COUNTY DEPARTMENT OF HUMAN
SERVICES, CENTENNIAL BOARD OF COOPERATIVE EDUCATION SERVICES, AND THE
WELD COUNTY JUVENILE ASSESSMENT CENTER, CONCERNING THE WELD COUNTY
JUVENILE ASSESSMENT CENTER
The Weld County Department of Human Services, (hereinafter "DHS), the
Centennial Board of Cooperative Education Services, (hereinafter
"Centennial BOCES"), and the Weld County Juvenile Assessment Center
(hereinafter "JAC"), hereby enter into the following Memorandum of
Understanding, and agree as follows:
WHEREAS, JAC is a collaborative, multi -agency, single-entry site which
contributes to the safety of youth, families and the community through
prevention, intervention, comprehensive assessments and improved access
to services; and
WHEREAS, JAC requires the services of one full-time employee, but lacks
the funding necessary to fill this need. DHS is a partner agency with
JAC in this community endeavor, and has agreed to cooperate with
Centennial BOCES to provide JAC with one full-time employee.
NOW THEREFORE, IT IS HEREBY STIPULATED AND AGREED AS FOLLOWS:
1. Responsibilities of JAC. JAC will provide the following for the
full-time employee:
a. A safe work site;
b. A suitable work station;
c. General office supplies;
d. Access to general office equipment, including a computer
with internet access, telephone, fax machine, and photo copier;
e. Training and use of JAC protocols for the assessment,
referral and case management of persons receiving services
through JAC;
f. Daily work assignments and functional supervision.
2. Responsibilities of DHS. DHS will provide $39,278 to Centennial
BOCES and Centennial BOCES will utilize the funds as follows:
a. Provide in kind personnel as one full-time employee (40
hours per week, 10:00 a.m. - 6:00 p.m., Monday through Friday)
b. Pay all salary, benefits, and other compensation
customarily paid to other employees of Centennial BOCES.
c. Provide any specialized equipment or resources needed to
access Centennial BOCES' data base case management systems, as
necessary.
d. Provide a Supervisor from Centennial BOCES to provide
direct supervision of the Centennial BOCES personnel assigned to
JAC for the purpose of communication, problem -solving and
coordination.
e. DHS' obligation to provide the required funding will be
adjusted according to community usage, which is defined by the
caseload average served by the full-time employee.
3. Establishment of Work Schedule. JAC and Centennial BOCES will
jointly agree upon the work schedule for the personnel assigned to JAC,
and JAC shall provide copies of the schedules to Centennial BOCES and

to the assigned personnel. The current schedule is set forth in
paragraph 2.a. above.
4. Translation Services. JAC will provide and be responsible for the
cost of translation services needed by non-English speaking clients of
JAC.
5. Reimbursement Procedure. A monthly reimbursement claim will be
submitted to DHS which includes a time sheet setting forth the client
hours worked by Centennial BOCES personnel for JAC and the number of
families served by said personnel. The time sheet will be verified by
Centennial BOCES and the JAC Director. Upon receipt of the claim, DHS
will pay $3570 to Centennial BOCES.
6. Assessment of Centennial BOCES. Centennial BOCES and the JAC
Director will assess the performance of Centennial BOCES personnel
assigned to the JAC position every six months. The assessment will
include DHS comments regarding job performance as it relates to
coordination of referrals from DHS.
7. Program Evaluation. On or before May 30, 2010, DHS, Centennial
BOCES and JAC will determine whether DHS' funding of the Centennial
BOCES position has met the JAC standards. In this contract year we will
see an increase in referrals to the Department of Human Services
programs. The Juvenile Assessment Center will include in their
quarterly reporting an accounting of specifically where these referrals
are going at the Department, i.e., Youth in Conflict, MYAT.
8. Conflict Resolution. In the event the Centennial BOCES personnel
assigned to JAC encounter a policy or protocol that conflicts with
Centennial BOCES policy or protocol, the personnel assigned to the
position shall report the conflict to the Centennial BOCES department
supervisor, who shall then meet with the JAC Director. The department
supervisor and the JAC Director shall resolve the conflict in a
mutually agreeable manner, if possible, and if that is not possible,
Centennial BOCES shall resolve the conflict.
9. Objectives. Information sharing is a key component to
successfully evaluating the needs of JAC clients, to delivering
integrated services to said clients, and to eliminating the duplication
of services by partnering agencies. To achieve these objectives, DHS,
Centennial BOCES and JAC shall share the information contained in their
respective data bases on all JAC clients, if permitted by law and if
the agencies have been given a written Release of Information form
authorized by the Interagency Oversight Group (hereinafter IOG), under
HB04-1451, which has been properly executed by the parent/legal
guardian of the juvenile client. All information shared in this manner
is confidential and, unless specifically authorized by State or Federal
statute, may not be disseminated to the public or released to any other
agency or individual by any of the parties to this MOU without an
additional written release properly executed by the juvenile client's
parent/legal guardian.
10. Applicable Law. Centennial BOCES and JAC acknowledge that
applicable Colorado State laws govern and limit liability for negligent
or wrongful acts or omissions committed by their employees while
participating in the activities contemplated under this MOU. However,
liability for negligent or willful acts committed by employees of
Centennial BOCES or JAC committed outside the terms of the agreement
will be the responsibility of the employee who commits said acts. DHS
is not the employer of any personnel assigned by Centennial BOCES to
JAC.
11. Term of Agreement. The term of this memorandum of understanding
begins on the 1s° day of July, 2009, and terminates on the 30°h day of
June, 2010. This MOU may be renewed for one year upon DHS' notification
to Centennial BOCES and JAC, on or before May 31, 2010. This MOU may be
terminated by any party hereto, upon delivery of a thirty (30) day
written notice to all other parties. OHS agrees to reimburse Centennial
BOCES for all expenses it incurs and for all services performed by its
personnel pursuant to the terms of this agreement through the date of
termination.
12. Modification of Agreement. This MOU may be modified at any time
by mutual consent of all participating agencies. No modification to
this MOU shall be effective until it is reduced to writing and signed
by each participating agency.
13. Consent to Terms. By signing this Memorandum of Understanding,
each agency consents to be bound by the terms and conditions set forth
herein.
14. No Waiver of Immunity. No portion of this Agreement shall be
deemed to constitute a waiver of any immunities the parties or their
officers or employees may possess, nor shall any portion of this
Agreement be deemed to have created a duty of care which did not
previously exist with respect to any person not a party to this
Agreement.
15. No third Party Beneficiary. It is expressly understood and agreed
that the enforcement of the terms and conditions of this Agreement, and
all rights of action relating to such enforcement, shall be strictly
reserved to the undersigned parties and nothing in this Agreement shall
give or allow any claim or right of action whatsoever by any other
person not included in this Agreement. It is the express intention of
the undersigned parties that any individual or entity other than the
undersigned parties receiving services or benefits under this Agreement
shall be an incidental beneficiary only.
16. Early Termination. This Agreement may be terminated by any of the
signers upon thirty (30) days written notice.
17. Entire Agreement. This Memorandum of Understanding contains the
entire agreement and understanding between the parties to this
Memorandum of Understanding and supersedes any other agreements
concerning the subject matter of this transaction, whether oral or
written.
18. Severability. If any provision of this Memorandum of
Understanding should be held to be invalid, illegal, or unenforceable
for any reason, the validity, legality, and enforceability of the
remaining provisions shall not in any way be affected or impaired
thereby.
