HomeMy WebLinkAbout770463.tiff RESOLUTION RE : APPROVAL OF CONTRACT FOR SERVICES BETWEEN MARIANNE LeCLAIRE, CONSULTANT, AND THE COUNTY OF WELD FOR BERGER-FRY SUBDIVISION RELOCATION PROJECT, AND AUTHORIZATION FOR CHAIRMAN OF THE BOARD TO SIGN THE SAME. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Director of Department of Planning Services reviewed with the Board of County Commissioners, a Contract for Services between Marianne LeClaire, Consultant and the County of Weld for Berger-Fry Subdivision Relocation Project. If approved, said contract would provide for the completion of the four remaining properties in the Berger-Fry Subdivision. The Director of Planning pointed out that services must be completed by December 31, 1977, and WHEREAS, it has been agreed between the Board of County Commissioners that the aforementioned contract, a copy of which is attached hereto and incorporated herein, be approved. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the Contract for Services, referred to above, be, and hereby is, approved. BE IT FURTHER RESOLVED by said Board, that the Chairman of the Board of County Commissioners be, and hereby is , authorized to sign the same. The above and foregoing Resolution was , on motion duly made and seconded, adopted by the following vote on the 14th day of November, A.D. , 1977. �yy, n BOARD OF COUNTY COMMISSIONERS /1 iC . n^ JG:� (lml WELD COUNTY, COLORADO ATTEST: Weld County Clerk and Recorder a/lerk to the D r `l r 7791/EDDeputy ounty lerk ��� � ,- (' AS TO FOR • t.;c+f�wy County Attorney Date Presented: November 23, 1977 770463 CONTRACT FOR SERVICES THIS AGREEMENT, entered into as of this 14th day of November, 1977, nunc pro tune November 1 , 1977, by and between MARIANNE LeCLAIR, herein- after known as "Consultant", and the COUNTY OF WELD, a body corporate and politic of the State of Colorado, hereinafter known as "County", acting by and through its BOARD OF COUNTY COMMISSIONERS, WITNESSETH: WHEREAS, Weld County, in cooperation with the City of Greeley Urban Renewal Authority, has been conducting a project for the acquisition of properties in the Burger and Fry Subdivision, located in Part of Lnt 4, Southeast Quarter, Northeast Quarter, Section 5, Townshin 5; North, Range 65 West , Weld County, Colorado, and WHEREAS, the Consultant was the representative for the City of Greeley Urban Renewal Authority for the project, and is no longer employed by said authority, and WHEREAS, four properties remain to be acquired under the project, and WHEREAS, the County believes that the Consultant has the skills and familiarity with acquisition procedures essential to the successful completion of the project, NOW, THEREFORE, the parties hereto mutually agree as follows : 1 . Scope of Services. Consultant shall acquire, on behalf of the County, the following parcels in the Burger and Fry Subdivision, Weld County, Colorado: Lots 9 and 10, Block 1 ; Lots 11 and 12, Block 2 The Consultant shall be responsible to the Director of the Department of Planning Services. Consultant shall complete all acquisitions by the end of the contract period, as set forth in clause 4 below. Con- sultant shall conduct all negotiations with property owners , and shall keep written records of all contacts, communications and agreements made with property owners relating to the parcels to be acquired. Consultant agrees to perform these tasks in accordance with the stan- dards and procedures in the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, and all applicable rules and regulations thereunder. Consultant further agrees that, should condemnation proceedings be required in order to acquire any of the subject properties, she will serve as a witness , if necessary, and will continue to assist the County during the proceedings by providing relevant files and other information. Consultant will also participate in any monitoring sessions of the program conducted by the United States Department of Housing and Urban Development. The County agrees to cooperate in all ways necessary to allow the acquisition by the Consultant of the subject properties within the time allowed. Such cooperation will include, but not be limited to, super- vision by the Director of the Department of Planning Services , and the expeditious handling of disbursement of funds for acquisition. 2. Compensation. In consideration of the Consultant's performance of her obligations under this agreement, the County shall pay her five hundred dollars ($500) for each subject property acquired, at the time title to the property is received by the County. No additional compensation will be paid for services rendered during condemnation proceedings or HUD monitoring sessions. 3. Disbursement of Funds for Acquisition. Funds for the acquisition of the subject properties will be disbursed upon the signature of the Director of Planning Services by a county purchase order drawn on the appropriate account. Should the normal processing time for such a disbursement prove too long to allow satisfactory completion of the acquisition, the Board of County Commissioners shall authorize the issuance of a handwritten warrant. 4. Term of Contract. Time is of the essence in this agreement. All acquisitions of property covered by this contract, except those requiring condemnation proceedings , if any, shall be completed by the Consultant by midnight, December 31 , 1977. This agreement shall expire on its own terms on December 31 , 1977, or at such later time as the acquisition of all subject properties is completed by eminent domain. 5. Assignment and Delegation. Consultant may not assign any of her rights in this contract nor delegate any of her duties defined in this contract. -2- 6. Termination.
