HomeMy WebLinkAbout20090477.tiffRESOLUTION RE: REGULATING, WARNING AND GUIDING TRAFFIC DURING THE TEMPORARY CLOSURE OF COUNTY ROAD 28 BETWEEN COUNTY ROAD 23 AND U.S. HIGHWAY 85, AND COUNTY ROAD 25.5 BETWEEN COUNTY ROADS 26 AND 28, FOR ONE NIGHT, FOR FILMING WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, pursuant to Section 42-4-410(6)(a), C.R.S.: "...local authorities, with their respective jurisdiction may, for the purpose of road construction and maintenance, temporarily close to through traffic or to all vehicular traffic any highway or portion thereof for a period not to exceed a specified number of work days for project completion and shall, in conjunction with any such road closure establish appropriate detours or provide for an alternative routing of the traffic affected...", and WHEREAS, the Board, pursuant to said statute and upon the basis of traffic and personal investigations, has determined that conditions exist which make it necessary to temporarily close to through traffic and to regulate, warn and guide vehicular traffic on said County roads by posting signs thereon. NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Weld County, Colorado, deems it necessary to regulate, warn and guide vehicular traffic on County roads and any intersections thereof, and it hereby authorizes and orders the posting of such traffic control devices as shall be reasonably necessary to regulate, warn and/or guide traffic thereon for the safety of the general public and that said traffic control devices shall conform to the Federal Manual on Uniform Traffic Control Devices. BE IT FURTHER RESOLVED that the Board of County Commissioners of Weld County, Colorado, does declare and establish that County Road 28, between County Road 23 and U.S. Highway 85, and County Road 25.5. between County Roads 26 and 28, be temporarily closed, with said closure being effective March 3, 2009, for approximately one night, for filming, and further, that standard official traffic control devices shall be erected at said closure giving notice of the restrictions. 2009-0477 EG0024 r� , cm, so, Os P ROAD CLOSURE - CRS 28 AND 25.5 PAGE 2 The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 23rd day of February, A.D., 2009. WINDEMERE, LITTLETON, CO 80120, hereinafter referred to as "Contractor." WITNESSETH: WHEREAS, Contractor is desirous of entering into an Agreement with the Sheriff for the performance of special duty law enforcement services (hereinafter referred to as "special duty services") which are in addition to the regular law enforcement services provided by the Sheriff on an "as needed" basis for special events held, sponsored, or coordinated by Contractor, and WHEREAS, Sheriff is willing to render such special duty services in accordance with the terms and conditions set forth in this Agreement, and WHEREAS, this Agreement is authorized by Section 30-11-101(1)(d), C.R.S., and the Weld County Home Rule Charter, Section 3-8(4)(m). NOW, THEREFORE, for and in consideration of the mutual covenants. conditions and promises contained herein, the parties hereto agree as follows: I. SERVICES PROVIDED BY SHERIFF A. Terms and Conditions of Special Duty Services. The Sheriff shall provide special duty services to Contractor on an "as needed" basis, as determined by Contractor, according to the following terms and conditions: Notice to Sheriff Contract Person. Upon notice by Contractor to the "Sheriff Contact Person" (as defined in Section I, C.. below), in accordance with the conditions set forth in Section II., A., of this Agreement. of Contractor's need for special duty services, the Sheriff Contact Person shall determine the number of special duty deputies to assign to the event. The Sheriff Contact Person shall also determine, in his sole discretion, which Sheriffs Office personnel to assign to the event and what their respective duties shall include. 2. "Special Duty Services" Defined.
