The Weld County Council met in regular session in full conformity with the Weld,,Ootnty • v
Home Rule Charter, Monday, July 20, 2009, 6:30 p.m., at the Pierce Fire Department,
601 rd Street, Pierce, CO.
ROLL CALL: The meeting was called to order by President John Kivimaki. Vice
President Perry Buck, Councilwoman Ginny Buczek, Councilmen Don Mueller and
Charles Tucker were present, constituting a quorum of the members. Also present was
Brian Foss, Lowell Kilzer, Pat Persichino, Tina Booton, Larry Dill, Jim Rohn, Bob Dill, Don
Rohn, Janice Henry and Karla Ford, Council Secretary.
APRPOVAL OF AGENDA: Councilman Tucker made a motion to add a discussion to
make a resolution to support the Board of County Commissioners with their decision to
move the prairie dogs. Councilwoman Buczek seconded the motion and it passed.
Councilwoman Buczek made a motion to approve the agenda with the change. The
motion was seconded by Councilwoman Buck and carried.
APPROVAL OF MINUTES: Councilwoman Buczek made a motion to approve the
June 15, 2009 minutes. The motion was seconded by Councilwoman Buck and carried.
APPROVAL OF REPORT TO THE PEOPLE: Councilman Tucker made a motion to
approve the 2009 2nd Quarter Report to the People. The motion was seconded by
Councilwoman Buck and carried.
REVIEW PROGRAM:
Tina Booton, Weld County Public Works, gave a brief overview of the Noxious Weeds
Division, made brochures available and responded to Council and resident questions.
Councilman Kivimaki stated that Erie has a lot of thistles and inquired what the county
can do to help. Ms. Booton responded that there is a State law and the county does not
have any jurisdiction to require towns to spray. Ditch companies and railroads do not
always comply either. The county can talk to the companies, but can not force it to be
done.
In response to a resident, the hardest noxious weed to control is the Canada Thistle and
the least compliance is the Leafy Splurge.
In response to mowing the paved roads, the county is currently working in Ault and will
continue on to Pierce. Also, in comparison to last year for spraying, the county is where
they were last year. They are currently short a spray truck this year due to budget cuts.
They are currently looking into wet blade mowers.
In response to the Council, Ms. Booton stated that her department did invite the Public
Works and Code Enforcement officers for all towns within Weld County to come to a

meeting to learn about weed identification and compliance; only few towns sent
representatives.
Councilwoman Buczek suggested going to the Town Board meetings and making a
presentation regarding these issues.
Regarding weed management enforcement, the policy is to make general contact. If
there is not any action on the part of the resident, then a 10 day legal notice is sent, a
right of entry is approved from Board of County Commissioners and the county goes on
the property and sprays. This takes approximately 14-15 days. The landowner is
charged to do this. It does go on their taxes if not paid. Habitual offenders — there is
nothing that the county has in the code to correct this or at state level.
The county currently does not have a height requirement for noxious weeds.
Councilwoman Buczek will check with the Planning Department regarding this issue.
Pat Persichino, Department of Public Works Director, gave a brief update on current
issues, the gravel mining has been contracted out, the county will be paving WCR 74 to
Cornish, paving starts the week of July 27th. The county has completed 17 miles of
maintenance overlay, paved 1.2 miles of new construction, milled 24 miles of asphalt
and filled 363 pothole locations. Mr. Persichino also suggested that at the Annual
October Elected Officials meeting, that a brochure regarding Noxious Weeds is
distributed.
Councilwoman Buczek thanked Ms. Booton for coming and answering questions from
the Council and local residents and stated that Ms. Booton showed a great deal of
knowledge in this area. The entire Council concurred.
PUBLIC COMMENT: There was no public comment.
SHORT RECESS: The Council took a brief recess.
NEW BUSINESS:
Notebook Updates
The secretary distributed an update for the Council Notebooks.
Coordinator Reports
Councilman Kivimaki stated that he continues to have a periodic meeting with
Commissioner Bill Garcia. They recently discussed that the county budget is looking
positive this year, the savings this year will help with the 2011 budget.
Councilman Mueller attended the County Webpage Meeting/Presentation. He stated
the updates will make the website more user friendly. He also attended the TARP
meeting.
Councilman Tucker attended the meeting at Leprino and the company is watching the
economic outlook. The company plants to have Phase1 completed in 2011.

Councilman Tucker made a motion to pass a resolution to support the Weld County
Commissioner's decision to reject cross county transfer and relocation of prairie dogs.
Councilman Mueller made a point of order and stated that he does not feel this is part of
the Council's purview to make a resolution on this action. After discussion, Councilman
Tucker made a motion to withdraw the original motion.

Councilwoman Buck made a motion for the bills to be paid as listed below:

The motion was seconded by Councilman Mueller and passed.
