RESOLUTION RE: GRANT PERMIT FOR TEMPORARY ASSEMBLY TO FRANK'S RIDE FOR CHILDREN, CIO GREG RISEDORF - MAY 17, 2009 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Frank's Ride for Children, c/o Greg Risedorf, P.O. Box 327, Mead, Colorado 80542, has presented the Board of County Commissioners with an application for a Permit for Temporary Assembly on land within the unincorporated portion of the County of Weld, State of Colorado, to be held from 6:00 a.m., until 10:00 p.m., on May 17, 2009, on property described as follows: Anderson Farms, 6728 County Road 3.25, Erie, Colorado 80516; being further described as part of Section 32, Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, said applicant has paid to the Weld County the sum of ONE -HUNDRED DOLLARS ($100.00) for said Weld County Permit for Temporary Assembly, and WHEREAS, a hearing was held on April 20, 2009, at which time the Board deemed it appropriate to continue the matter to May 4, 2009, in order to allow the property owner time to obtain the necessary permits for the buildings to be utilized for the event, and WHEREAS, on May 4, 2009, after having examined said application and hearing testimony provided by staff, the Board deems it appropriate to grant a Weld County Permit for Temporary Assembly to Frank's Ride for Children, c/o Greg Risedorf, and WHEREAS, said permit shall be issued subject to compliance with the terms and conditions as set forth in the application materials and upon the express condition and agreement that the temporary assemblage will be conducted in strict conformity to all laws of the State of Colorado, and WHEREAS, any violation to said terms and conditions shall be cause for revocation of said permit and forfeiture of bond. A full service kitchen is located on the facility, including a industrial dishwasher, sinks with hot/cold water, commercial refrigerators, etc. NO outside concessions will be provided. Permanent (Panel Breaker System) electrical systems are provided throughout the permanent building on the site. Anderson Farms is an event site. No natural environment will be disturbed. No existing violations were noted. Staff Concerns: Several structures have been identified which have not obtained the necessary building permits. 4 (four) metal covered structures and a "classroom facility" consisting of 5 cargo containers with a large A -Frame roof have been added to this site without first obtaining the required building and electrical permits through the Weld County Building Code, Chapter 29. All of these structures are situated within the delineated area of use called out in this application. Staff has discussed the required building & electrical permits with Mr. Anderson on numerous occasions. However, in a meeting with Mr. Anderson, he indicated his intent to utilize at least the 4 (four) metal covered structures for this event. Staff is unsure of his intentions regarding the "classroom facility" during this event. Staff recommends the following: 1.) Either the applicant shall submit a building permit application along with an engineered letter and obtain a Certificate of Occupancy through the Weld County Building Inspections Department prior to this event or 2.) A temporary barrier wall, such as the orange mesh plastic, shall be installed around these structures to ensure the public can not gain access. We had the permit ready to be issued by Tuesday morning (04/28/09). Mr. Anderson picked up the building permit on Tuesday (04/28/09). Greg Reisdorf (with Frank's ride) called me Tuesday late afternoon to see what was going on regarding the building permits. I explained that Jim had picked it up earlier that day. I advised him that if Jim called in for an inspection before 3 pm — the inspection would be scheduled for the next available working day. He said he would call Jim's daughter and have them call in right away. Greg Reisdorf called me today (04/30/09) to see what was going on regarding the building permits. I explained we still have not received a phone call requesting an inspection. I again explained that in order to have an inspection for the next day we needed to receive a phone call before 3 pm. He said he was going to call Jim's daughter again. I explained to Greg that most likely at Monday's hearing I would be asking the Board to either require Mr. Anderson to have the inspections completed before the event on the 17th or that orange style mesh barricade material installed around the shade shelters so they are not utilized. If they use the structures without a completed building permit — Maybe the Sheriff's Office can shut them down as a Condition of Approval. I have his phone number if there is a better suggestion.
