The attached Development Standards being recommended and approved for the Conditional Use Permit. 2. No building or electrical permits shall be issued on the Conditional Use Permit area until the Development Standards for the Conditional Use Permit have been placed on the Condi- tional Use Permit plat and said plat have been delivered to the office of the Department of Planning Services. 1153 Continental Pipeline Company CUP Development Standards 1. The permitted use of the hereon described parcel of land shall be a Crude Oil Truck Unloading Facility. Facilities shall be limited to those shown hereon. 2. Items to be stored in the Material Storage Area may include the following: (A) 2-inch, 3-inch, 4-inch, 6-inch, 8-inch and 10-inch line pipe in the following maximum -quantities: (a) 2-inch: 300 feet (b) 3-inch: 1500 feet (c) 4-inch: 1500 feet (d) 6--inch: 500 .feet (e) 8-inch: 300 feet (f) 10-inch: 300 feet • (B) 2-inch through 10-inch steel valves with a maximum number of-valves of all sizes to be 15. (C) 2-inch through 10-inch flanges, elbows., tees and other steel fittings, with the maximum number of fittings to be 20. • (D) Pumps, engines and electric motors with a maximum of" 15 items. 3. There shall be only two automatic custody transfer (A.C.T. ) units at the site. Each A.C.T. unit shall consist of a . strainer, a meter and an automatic sampler together with -. necessary-valves-;- piping- and related. appurtenances. - 4. A .paved apron complete with catch basins shall be placed in the area of the unloading activity so as to gather and contain any oil which is lost during unloading operations. 5. The Conditional Use Permit area shall be surrounded by a 3- strand barbed wire fence as shown on the plans. 6. The above ground piping, equipment, tanks and material storage area shall be enclosed by a six foot chain link fence topped with three strands of barbed wire. 7. The Conditional Use Permit area shall be maintained in such- a manner so as to prevent soil' erosion, ' fugitive dust and the growth of noxious weeds. 8. Parking for up to five oil transport trucks (in addition to three at the unloading point) will be provided on the property. 9. Access shall be limited to the two proposed points shown here- on. The traffic pattern at the facility shall be one way only. All accesses shall have the approval of the Weld County Engineering Department. All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department.' r • I 1 10. All. phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water' quality, noise emission, and sanitary disposal ' systems. 11. No fences shall be constructed across the Platteville Ditch. Any fence parallel to the ditch will be placed no closer than fifteen feet'from' the toe of the existing dike. 12. Continental Pipeline Company shall provide personnel and appropriate fire fighting equipment to stand by during the burn-off of weeds along the ditch adjacent to their facilities in order to confine the burned area. 13. He then went into a great amount of detail in explaining the pollution control measures that will be utilized on the site and read into the record a letter in response to the Weld County Health Department as regards wastewater retention, other permits required, noise levels and fly and mosquito control . John Hall of the Weld County Health Department expressed concern regarding the sealing of the lagoon and what measures will be taken regarding this . Mr. Norton stated that a proposal for sealing the lagoon has been proposed to the State Health Department, but they have not yet received anything back from them. Mr. Hall stated if -their proposal poses no problem to the State Health Department, then the County Health Department would have no problem either with it . The floor was then opened to anyone who wished to express their opinion regarding the request . At this time Cynthia Berthurum expressed concern regarding fugitive dust and odor. Gene Inloes of the Weld County Extension Service responded to her concern about fugitive dust in that there will be dome dust at certain times throughout the year depending on the management and housekeeping of . the operation and the amount of rainfall . Orville Green stated he was concerned about flooding of Owl Creek and Lone Tree Creek as did Eugene Clark. Jim Davis was concerned about flooding, pollution and decrease in his property value. Mrs. Berna Scott was concerned about dust and odor as she now has three feedlots surrounding her property. Alfred Miller, owner and operator of the feedlot to the west, stated he was in favor of the proposal and feels the applicant will manage the operation very well and follow all rules and { regulations as required. The range will have a 5 trap layout with a clubhouse and will eventually expand to a 9 trap layout on 36 acres of property. The property is not suitable to farming. Access will be from County Road 74 . The noise level will be low. Discussion followed regarding the regulation of shell loads . Tom Honn then read the staff ' s recommendation for approval and the Development Standards. He then stated that the staff had raised two subjects of concern in the Development Standards. These concerns were the landscaping around the area and the four consecutive days of operation . Mr. Hall stated they would prefer not having shrubbery on the north side of the range as it is distracting to shooters and does not really provide a good sound barrier. Also, most shoots only last 2-3 days at the most . The staff ' s Development Standards state no longer than four consecutive days. Discussion followed. John Hall of the Weld County Health Department stated that a noise study was conducted on the site with a reading of slightly over the required noise level . However, off the site the reading is acceptable . Jim Gilbert stated he had site reviewed the property and feels this would be a tremendous asset to the area and of great benefit to the County. Steve Theede then stated that effective immediately there will be no night loading. This has been done on a somewhat limited basis and will now be discontinued. He stated there is a concrete driveway which was installed in 1978. There is gravel on both sides of the road. They felt they have met the intent of the stipulation in the Special Use Permit as regards paving. Trees were planted around the perimeter of the site, but since there' is no water on the property most of them have not survived. They have installed some aluminum lattice work in the woven wire fence as an alternative to the visual screening. There are three meter manifolds on the site instead of one as stipulated. They feel this allows traffic to get unloaded faster and get off County Road 21 . Bob Johnson, safety coordinator and registered engineer for Continental Pipeline Company, briefly reviewed the safety precautions at the facility. He also explained the alarm system that is utilized and how the system failed when the spillage occurred. Jack Berger, Jr. and Jack Berger, Sr. both again expressed their feelings in that they cannot believe anything Continental Pipeline Company says they will do. They also expressed concern regarding safety of the condesate and because Weld County has no fire code and therefore no authority. The applicant then decided it would be best if the application were withdrawn at this time. Sections 25, 26 , 35 abd 36, T3N, R64W LOCATION: Approximately 5 miles north of Keenesburg APPEARANCE: Lyle Busch, Manager of Land Resources DISCUSSION: This application is for surface coal mining which is located in a reasonably shallow deposit and one that lends itself to mine more readily by surface methods because it is more economical and the reclamation is more satisfactory than underground mining. The coal is situated on overburder 40-50 feet on the north side and 150-160 feet on the south side of the site. The coal is in a seam 5-8 feet thick. It is anticipated 11-121 million tons of coal is in the area and the project is anticipated to last 20-25 years. to mine it . Mr. Busch then explained the many steps that were necessary regarding testing, drillings , • etc. in preparation for the project . The plan for developing the mining operation could begin as early as July . They would like to obtain permission from the State to begin construction of an access road and have stated to the County that if they would be willing to upgrade the road, Adolph Coors Company would apply an asphalt surface to it . Trucks would being hauling approximately one year from now 24 hours a day at intervals of every 20 minutes . He then showed the Planning Commission the mining and reclamation plans by use of a map presentation. They feel the impacts on the operation will be fairly minimal . There are very few houses in the area. The site would not be readily visible . There being no comments at the time, Tom Honn read the staff ' s recommendation for approval and the Development Standards. Mr. Busch then commented on the Development Standards regarding operating only during daylight hours. He feels there would be too much concentration of traffic in a shorter period of time if they operate only during daylight hours and it would be too costly . Discussion followed regarding the use of irrigation water for ground cover from the Foxhills aquifer and how suitable it would be for grass . There was also discussion regarding the severance tax. Russ Anson suggested that several modifications be made regarding the conditions of the road maintenance program, this being that instead of offering and agreeing •to acceptable program of road maintenance with the County Commissioners it should be proposed. Also that if additional roadways are requested to be dedicated for public use, they should be made a part of the condition . Keavan Starks expressed concern in regard to the traffic generated along County Road 59 . He feels that property owners along County Road 59 should be notified of the traffic volume . (i CONTINENTAL PIPE LINE COMPANY CONDITIONAL USE PERMIT Description of Proposed Operation The modifications proposed for the existing truck unloading facility at Spindle B Station are required by Continental Pipe Line Company in order that receipt volumes from truck transports can be more accurately measured. The facility will continue to be automated. Staff employees, based at CPL' s Ft Lupton Pump Station, will maintain and supervise the operations at the un- loading facility. There will be no personnel physically assigned to the Spindle B Station, thereby, eliminating the need for a water supply or a sewage disposal system. Under current operations , transport operators unload their contents directly into an Automatic Custody Transfer (A.C.T. ) unit for measurement. Each A.C.T. unit consists of a strainer, a -meter, -and an automatic-sampler, --together with necessary valves, piping, and related appurtenances . From the A.C.T. unit, the crude oil is pumped via underground pipeline to an existing pipe- line in the vicinity for further delivery to Continental Pipe Line Company' s Ft Lupton Pump Station, one (1) mile to the north. The proposed modifications will be designed- and constructed such that three crude oil transports can unload their contents simul- taneously, while providing parking for up to five additional transports on the property. Individual transport operators will make the necessary connections to the facility to unload and pump their contents directly into designated, breakout tankage. This tankage will allowthe crude to settle and weather before it is to be measured automatically. At a predetermined level, a pump will automatically begin transferring volumes from that tank, through the A.C.T. unit for measurement, and subsequent delivery, via underground pipeline, to Continental Pipe Line Company' s mainline injection station at Ft Lupton. The facility will continue to be automated. Staff employees, based at CPL'S Ft Lupton Pump Station, will maintain and supervise the operations at the un- loading facility. There will be no personnel physically assigned to the Spindle B Station, thereby, eliminating the need for a water supply or a sewage disposal system. Under current operations , transport operators unload their contents directly into an Automatic Custody Transfer (A.C.T. ) unit for measurement. Each A.C.T. unit consists of a strainer, a meter, and an automatic sampler, together with necessary valves, piping, and related appurtenances. From the A.C.T. unit, the crude oil is pumped via underground pipeline to an existing pipe- line in the vicinity for further delivery to Continental Pipe Line Company' s Ft Lupton Pump Station, one (1) mile to the north. The proposed modifications will be designed and constructed such that three crude oil transports can unload their contents simul- taneously, while providing parking for up to five additional transports on the property. Individual transport operators will make the necessary connections to the facility to unload and pump their contents directly into designated, breakout tankage. This tankage will allow the crude to settle and weather before it is to be measured automatically. At a predetermined level, a pump will automatically begin transferring volumes from that tank, through the A.C.T. unit for measurement, and subsequent delivery, via underground pipeline, to Continental Pipe Line Company' s mainline injection station at Ft Lupton.
