RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION
ZCV #0900025 AGAINST COREY AND LISA RUPPLE FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Corey and Lisa Rupple, ZCV #0900025, are allegedly in violation of the Weld
County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 16th day of June, 2009, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Corey and Lisa Rupple, property owners, were present at said hearing, and
WHEREAS, the Board of County Commissioners determined the property owners have
brought the subject property into compliance and deemed it advisable to dismiss said matter.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV#0900025 against Corey and Lisa Rupple be, and hereby is, dismissed

REMEDY
During my last inspection conducted earlier today, I noted the following: A roll -off was present on the
property. While some progress is apparent, there were still buckets, barrels, plastic bottles, wood,
trash and miscellaneous debris.
As I have previously indicated, while the presence of a NONCOMMERCIAL JUNKYARD consisting of
tires, wood, plastic, iron/metal, buckets, barrels, demolition debris, trash and miscellaneous debris is
an allowed use within the Agricultural Zone District, it must be completely SCREENED from all
adjacent properties and public rights -of -ways. Furthermore, any household trash shall be completely
removed from the property as screening is not an option for household trash.

This hearing will take place in the County Commissioners Hearing Room, first floor, Weld County
Centennial Center, 915 -10th Street, Greeley, Colorado. It is recommended that you or a
representative be in attendance to answer any questions the Board of County Commissioners
might have about the violations.
Please also be advised that I will be taking video and/or pictures from the road or adjacent
properties the business day before or as soon as possible to the above mentioned Violation
Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the
violation. Our records indicate that you were made aware of the nature of the violation including
the action necessary to correct the violation, and that you were given sufficient time to remedy

First of all, I apologize for not getting back to you sooner, but I wanted to conduct another site inspection before
replying to your e-mail.
I conducted an additional site inspection from the road right of way on March 18, 2009. During my inspection, I
noted the presence of tires, plastic, household trash, wood, demolition debris, iron/metal and general .
miscellaneous debris. The definitions listed in all CAPS in my letters are just definitions taken from the Weld
County Code. My next action is a Violation Notice (see attached) which grants 30 days for the property to come
into compliance. If these items have been removed within this 30 day time frame, the violation will then be
closed.
I did receive a complaint from a property owner in the general area. The complaint was that the items were really
starting to accumulate on the site and the demolition rubble had been there for quite some time.

We received your letter about potential noncompliance on our property. Your letter mentions "junkyard" and "derelict
vehicles". We acknowledge that we do have a substantial amount of equipment on our property, but the majority of it is used
throughout the year in our farm ranch operation. This equipment has been on our property for more than six years. and we
haven't been told about any problems with it. There were also items around the old sheds when we moved here. We don't
think we have any derelict vehicles. The amount of scrap metal has increased somewhat in the past month because our
daughter is collecting it to turn into the salvage yard as a way of raising money for a 4-H trip she will be attending. We had
planned to haul it away during spring break, which is the first week of April. Please let us know what, specifically, is posing
the noncompliance issue. Also. was this matter brought to your attention by a staff member or by someone in the
community?
