RE: APPROVAL OF RECORDED EXEMPTION NO. 309 - LIND FARMS, INC.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering
the affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing
held on the 20th day of March, 1978 , in the Chambers of the
Board of County Commissioners of Weld County, Colorado, that
the division into two parcels of a certain parcel of land, as
shown on the plat known as Recorded Exemption No. 309, being the
property of Lind Farms, Inc. , described as the E1/2 of the NE4
of Section 23, Township 7 North, Range 67 West of the 6th P.M. ,
Weld County, Colorado, being more particularly described as
follows :
The E' of the NF'r, of Section 23, Township 7 North,
Range 67 West of the 6th P.M. , except reservation
as contained in patent recorded Book 154, page 40, and
in Deed recorded in Book 112, Page 245, Weld County,
Records, Weld County, Colorado.
Said described parcel of land is subject to any rights-
of-way or other easements as recorded by instruments of
record or as nag existing on said described parcel of
land.
does not come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS
1973 , as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of land

missioners of Weld County, Colorado, that the hereinabove
described parcel of land owned by Lind Farms , Inc. , be, and
hereby is, exempt from the definition of the terms, "sub-
division" and "subdivided land" pursuant to its authority under
Section 30-28-101 (10) (d) , CRS 1973, as amended.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 20th day of
March, A.D. , 1978 .

Dear Commissioners:
The attached application , plat and related items are in reference to a
request by Lind Farms , Inc . for a recorded exemption. The parcel of
land in question is described as EINE* Section 23 , T7N, R67WN f the 6th
P.M. , Weld County, Colorado. The subject property contains Z8'.6 acres
of Class II and IV irrigated soils. The request is to split the property
into parcels of 76. 930 acres and 1. 254 acres. This property is located
21 miles north of Severance.
As indicated by H. F. Lind in a letter dated February 20, 1978 , the in-
tent is to convey the title of the 1 . 254 acare parcel to Mr. & Mrs .
Kenneth F. Lind, H. F. Lind' s son and daughter-in-law, for financing,
tax and estate planning purposes. Kenneth F. Lind assists with farming,
cattle feeding operations , and other farm related work on weekends and
many evenings during the irrigation season . Additionally, he is the
attorney for Lind Farms, Inc. and handles all legal work concerning the
corporation. A home is presently under construction on the 1 . 254 acre
parcel , and there is an existing home located on the 76 . 930 acre parcel .
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends the request
be approved for the following reasons:
1 . The proposed split conforms with the intent clause of the Recorded
Exemption Procedure (Section 9-2 of the Weld County Subdivision Reg-
ulations) , the intent clause of the Agricultural Zone District (Sec-
tion 3. 3 A. of the Weld County Zoning Resolution) , and the Weld
County Comprehensive Plan in that each parcel does have an existing
set of improvements. The use will be compatible with surrounding
agricultural uses. The request will allow agricultural and related
uses to be the predominant land use.

Dear Commissioners :
This letter is to respectfully request the approval of an exemption
for Lind Farms , Inc . , recently submitted to the Weld County Planning
Commission. The requested exemption is to allow construction
of a residential home for my son and daughter-in-law, Kenneth F.
Lind and Joyce A. Lind . It is necessary that an exemption be
granted for financing purposes .
A home is presently under construction on the property for Mr.
and Mrs . Kenneth F. Lind and said building permit was taken out
by Lind Farms , Inc . However, upon the advice of our accountant
and attorney, it was their recommendation that title be held
in the name of Mr. and Mrs. Kenneth F. Lind rather than Lind
Farms , Inc . , for tax and estate planning purposes . Additionally,
if title is not held by Mr. and Mrs . Kenneth F. Lind , the financing
institution will require security upon the total 80 acre parcel
of land rather than just the 1 . 25 acres of the land parcel .
At the time the building permit was taken out under the name
of Lind Farms , Inc . a letter was submitted to the building in-
spection department stating that Lind Farms , Inc . , considered
the home as necssary for operations of the business . That was
an accurate statement then, and continues to be an accurate statement .
This statement is true as even though Kenenth F. Lind is employed
as an attorney in Greeley, he and his wife are responsible for
certain farm activities . For example , Kenneth F. Lind assists
with farming, cattle feeding operations , and other farm related
work on weekends and on many evenings during irrigation season.
Additionally, he is the attorney for Lind Farms , Inc . , and handles
all legal work concerning the corporation, employees , and officers .
During 1977 Kenneth F. Lind represented the corporation or its
officers or employees at six legal or administrative hearings
and did handle other legal matters requiring approximately 300
hours of legal time.
Additionally , there is an employment contract between Kenneth F.
Lind and Lind Farms , Inc . , which requires him to live on the
farm property and assist with farm operations . While his work

may not always be direct physical involvement on the land , his
presence on the farm and work for the farm are considered vital
requirements to the successful operation of the farm. Additionally ,
his presence on the farm property on weekends allows other full
time employees to have free weekends and he supervises the farm
operation on many weekends when the foreman is not available .
Lind Farms , Inc . , not only owns the 80 acre parcel of land in
the East half of the Northeast Quarter ( EZNE4) of Section Twenty-
three ( 23 ) , Township Seven ( 7 ) North, but also the West Half
of the Northeast Quarter (WZNE4) ; most of the Northwest Quarter
(NW4) ; the Southeast Quarter ( SE4) ( excluding Loop Lake ) all
in Section Twenty-three ( 23 ) ; and most of the East Half of the
Northeast Quarter (EZNE4) of the adjoining Section Twenty-six
( 26 ) ; and the North Half of the Northwest Quarter (NZNW4) of
the adjoining Section Twenty-four ( 24) . The family has owned
most of this property for over twenty years and in none of those
years has any parcel of land been exempted or subdivided from
the total described property.
In these times of the many problems related to the agricultural
industry, it is my hope that this exemption can be granted so
that only that small parcel will be secured by a lending institution.
In the event the exemption is not granted, the whole 80 acre
parcel must be secured and that would create an additional encum-
brance upon the land which I have worked so hard to eliminate
over the last twenty years .

approximately 9 : 30 a.m. This meeting will take place in the
County Commissioners' Hearing Room, First Floor , Weld County
