Site Specific Development Plan and Use By Special Review (USR) Questionnaire Answers
1) The proposed use of the property would be to extend the allowance of one semi -truck
with trailer to two semi -trucks with trailer. This exception would allow the owner of the
property, Joel Mendez, to station two of his semi -trucks on the property for better
vigilance and protection. As a result, this would lower the cost of security, diesel, and
time needed for the two semi -trucks, thus increasing overall productivity for Mendez
Trucking Inc.
2) To the best of our knowledge, this proposal is consistent with the intent of the Weld
County Code, Chapter 22 of the Comprehensive Plan in that Mendez Trucking Inc., is
providing a service for the community by playing a vital role of Fort Lupton's
landscaping and trucking industry. The company hauls many different landscaping
materials such as: gravel and an assortment of rocks that are different in type, color, and
sizes to name a couple. As the city of Fort Lupton seeks to expand its housing and
commercial development, Mendez Trucking Inc., is there to do its hauling.
3) Our current understanding of Weld County Code, Chapter 23 (Zoning) is that the current
property standard is one semi -truck per property. By special request we are asking for an
increase to the standard by one semi -truck.
4) The area in which the property is located in is very rural allowing for several types of
uses. For instance, there is a race dog trainer down the road with his own facility as well
as a power station a few miles down. Conveniently, there are also a couple of material
pits within a five mile radius such as Renewable Fiber's Fort Lupton Pit and NCC.
Besides this the only other major use around the property is an oil pump which is located
on the border of the property.
5) a) The total number of people that will be using the site is three. This includes Joel
Mendez, Leonel Mendez, and Eva Mendez, whom are the parents of Joel Mendez. The
only two employees that will be living onsite are Joel Mendez and Leonel Mendez, while
Eva Mendez is not an employee and is only a resident living at this location.
b) Besides Joel Mendez, who is the owner of the company, there will be no other
employees onsite.
c) From Monday to Friday the hours of operation will be approximately between
7:00 AM and 6:00 PM. The semi -trucks may leave around 7:00 AM and will most likely
be back around 6:00 PM or anytime in between. Saturdays and Sundays are "closed."
d) There will be no structures built on the site.
e) There will be a total of three horses on the other side of the property along with a
dozen chickens and two dogs.

f) Besides the two semi -trucks there will be a separate vehicle for each resident; a
2003 Dodge Ram 2500, a 2004 Chevrolet Canyon, and a 2005 Chevrolet Malibu. In
addition to this there will be the occasional visitor in their own vehicle which can be as
often as every day to once a week.
g) Fire Protection will be provided the Fort Lupton Fire Department Station #1.
h) The property has its own water well as its water source.
i) The property will continue to use the existing sewage disposal system which was
created sometime before our occupancy.
There is no storage or warehousing being proposed.
6) The property will continue to use all existing utilities as well as all historic water flows.
There will be a fence built to screen where the semi -trucks will be parked.
7) Not Applicable — We were told this question did not apply to our situation.
8) The storm water drainage will use historical water flows, which seem to go downhill in
the south direction.
9) The construction of the fence should take approximately a month. Construction will
begin as soon as approval has been granted.
10) The materials being hauled by the company will not be brought back to the property, thus
no stockpiling.
11) Currently there are no signs on the property and there are no plans for any signs in the
future.
12) In most circumstances, a semi will leave in the morning and return once the workday has
ended, thus counting as two traffic trips daily. Other than this, residents of the home will
come and go on a personal basis.
13) After speaking to Joanna Williams with the Division of Water Resources, she has
concluded that the well and well permit for this property does not need to be upgraded
and is suitable for our use as is.
