Phone 303-866-3581), to discuss each individual situation. 3. Prior to recording the plat: A. The plat shall be titled: Recorded Exemption No. 1309-21-3 RE -4916 B. The following notes shall be placed on the plat: 1) All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. No building or structure as defined and limited to those occupancies listed as Groups A, B, E, F,H, I, M and R in Section 302.1 of the 2003 International Building Code, shall be constructed within a 200 -foot radius of any tank battery or within a 150 -foot radius of any wellhead. Any construction within a 200 -foot radius of any tank battery or 150 -foot radius of any wellhead shall require a variance from the terms of the Section 23-3-10 of the Weld County Code. • • 2) Any future structures or uses on site must obtain the appropriate zoning and building permits. 3) Lot A is not eligible for a future land exemption in accordance with Section 24-8- 20.C.1 of the Weld County Code. 4) Prior to the release of building permits, the applicant shall submit a recorded deed describing the Lot upon which the building permit is requested with the building permit applications. The legal description on such deed shall include the Lot designation and Recorded Exemption number. 5) Prior to the release of building permits, the applicant shall submit evidence to the Department of Planning Services that Lot B has an adequate water supply of sufficient quality, quantity and dependability. 6) Prior to the release of building permit, the applicant shall submit evidence of approval from the Fort Lupton Fire Protection District to the Weld County Building Department. 7) Potential purchasers should note that Lot B is claimed by well permit Nos. 211207 and 211208. Per the Colorado Division of Water Resources, well permit Nos. 211207 and 211208 must be re -permitted prior to Lot B obtaining an exempt well permit. 8) Potential purchasers should be aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment. The Weld County Department of Public Health and Environment strongly encourages well users to test their drinking water prior to consumption and periodically there after. 9) Potential purchasers should be aware that approval of this Recorded Exemption does not guarantee that well permits will be issued for the lots. Any lot may be deemed non -buildable if the lot owner is unable to obtain a well permit. The State Division of Water Resources issues all well permits. 10) Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Section 15-1-40 of the Weld County Code. 11) Recorded Exemptions on adjacent properties may raise the issue of compliance with the intent of the Recorded Exemption Process. Approval of this Recorded Exemption does not guarantee approval of future applications on adjacent properties. 12) Building permits shall be obtained prior to the construction of any building. Buildings that meet the definition of an Ag Exempt Building per the requirements of Section 29- 1-20 and Section 29-3-20.6.13 of the Weld County Code do not need building permits, however, a Certificate of Compliance must be filed with the Planning Department and an electrical and/or plumbing permit is required for any electrical service to the building or water for watering or washing of livestock or poultry. 13) Effective January 1, 2003, Building Permits issued on the proposed lots will be required to adhere to the fee structure of the County Road Impact Program. (Ordinance 2002-11) 14) Effective August 1, 2005, Building permits issued on the subject site will be required to adhere to the fee structure of the Capital Expansion Impact Fee and the Stormwater/Drainage Impact Fee. (Ordinance 2005-8 Section 5-8-40) 15) Prior to the release of building permits on Lot B, the Lot owner shall verify with the nearest Town/City or Sanitation District to determine the location of the nearest sanitary sewer line. In accordance with the Weld County Code, if a sewer line exists within four hundred (400) feet of the property line and the sewer provider is willing to serve the proposed structure, a septic permit cannot be granted by the Weld County Department of Public Health and Environment. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. 16) Recorded Exemptions on adjacent properties may raise the issue of compliance with the intent of the Recorded Exemption Process. Approval of this Recorded Exemption does not guarantee approval of future applications on adjacent properties. 17) The property owner acknowledges that mineral owners and lessees have real property interests that entitle them to surface use in accordance with Colorado State Statutes and applicable Colorado oil and Gas Conservation Commission regulations. (Department of Planning Services) 18) WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive agricultural counties in the United States, typically ranking in the top ten counties in the country in total market value of agricultural products sold. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with long-standing agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural areas: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well -run agricultural activities will generate off -site impacts, including noise from tractors and equipment; slow -moving farm vehicles on rural roads; dust from animal pens, field work, harvest and gravel roads; odor from animal confinement, silage and manure; smoke from ditch burning; flies and mosquitoes; hunting and trapping activities; shooting sports, legal hazing of nuisance wildlife; and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. It is common practice for agricultural producers to utilize an accumulation of agricultural machinery and supplies to assist in their agricultural operations. A concentration of miscellaneous agricultural materials often produces a visual disparity between rural and urban areas of the County. Section 35-3.5-102, C.R.S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Water has been, and continues to be, the lifeline for the agricultural community. It is unrealistic to assume that ditches and reservoirs may simply be moved "out of the way" of residential development. When moving to the County, property owners and residents must realize they cannot take water from irrigation ditches, lakes, or other structures, unless they have an adjudicated right to the water. • • Weld County covers a land area of approximately four thousand (4,000) square miles in size (twice the size of the State of Delaware) with more than three thousand seven hundred (3,700) miles of state and County roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the County, and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers. People are exposed to different hazards in the County than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs and livestock, and open burning present real threats. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. 4. The applicant shall submit three (3) paper copies of the plat for preliminary approval to the Weld County Department of Planning Services. Upon approval of the paper copies the applicant shall submit a Mylar plat along with all other documentation required as conditions of approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services Staff. The plat shall be prepared in accordance with the requirements of Section 24-8-60 of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty (60) days from the date the Administrative Review was signed. The applicant shall be responsible for paying the recording fee. 5. In accordance with Weld County Code Ordinance 2005-7 approved June 1, 2005, should the plat not be recorded within the required sixty (60) days from the date the Administrative Review was signed a $50.00 recording continuance charge may be added for each additional 3 month period. 6. The Department of Planning Services respectfully requests the surveyor provide a digital copy of this Recorded Exemption. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files format type is .e00. The preferred format for Images is .tif (Group 4). (Group 6 is not acceptable). This digital file may be sent to maps@co.weld.co.us. 7. The Weld County Department of Planning Staffs approval of this Recorded Exemption Application is based on satisfying the Conditions of Approval. Should an applicant be unwilling or unable to meet any one of these conditions within 60 days of approval, then this case will be forwarded to the Weld County Board of County Commissioners with a staff recommendation for denial. We traced the 50' ROW back to its beginning, being a deed from Lansdown to Hladky in 1971. The deed conveyed N1/2 of the SW1/4, EXCEPT the north 50' thereof for County road. Subsequent investigation indicates that Hladky later states that he had given the County an easement for the north 50' of his property back in 1961 or so (he was not the owner of record at that time). Our research indicates that in 1986 the County did the same records search as we did and could find no documentation of this easement. Later, the 50' shows up again on a plat of RE 1386 in 1992. It appears on that plat as 50' road ROW. The way the North 50' was excepted from the conveyance I believe that it could still be owned by Lansdown and not Hladky. There is no document of public record that reflects the 50' ever being dedicated to the County for a road, just the exception from the conveyance. There is a road petition, as Joel mentions, for 40' of ROW, but nothing in the petition mentions 50'. So, my question would be why not just keep it at 40'? Do we need the extra ROW for something? If we do, then I think we will need a quit claim deed from Lansdown and a similar quit claim deed from Kladky, for the same 50'. One interesting thing though, back in 1986, the landowner to the north moved his fence south, forcing the road to move south (through normal maintenance practices). The landowner to the south asked the Board of County Commissioners to intervene. They did and a letter from our Assistant County Attorney at that time, Mr. Barker, sent a letter to the landowner stating that the County had 50' of ROW south of the quarter section line. So, in 1986, the County felt it had 50', but no document. I'm not sure how that assumption could be made, because it would need to be accepted by the County in a formal Resolution, and it wasn't. I don't believe the exception on the deed was a grant of right of way to the County. So, needless to say, we'll keep looking. I'm out of the office until next Monday, but I will get with Bruce the first thing on Monday. If I sound confused, I am... Based upon expected student generation rates from what appears to be the possibility of two new single- family units on approximately 10 to 12 acres for lot A and approximately 57 acres for lot B, the new homes would generate approximately 2 new students to be accommodated within district. Bus transportation would likely be provided. It is understood that approval of the proposed new lots does not yet add residential units to enrollment potential. However, certain school issues should be considered at this important juncture, including school site planning, transportation access and facility capacity. The current facilities that would serve this lot are Twombly Elementary or Butler Elementary, Fort Lupton Middle School and Fort Lupton High School. This development could impact all levels of schools. In addition, even without this project, completion of other previously approved developments would generate more students than can be accommodated by the existing schools. As the volume of developments increases with no alleviation of the existing capacity conditions, the ability to provide the same quality education for these new students becomes increasingly difficult. Weld County School District RE -8 requests the cooperation and participation of the developer to provide cash in -lieu of land dedication fee, a one-time fee in the exact amount of $939.00 per lot or current required rate per lot, to address the need for future school sites. Further, the District requests that the County assist with monitoring residential growth working and consider facility capacity impacts upon the schools in determining whether a new project should be approved. We appreciate your cooperation and the opportunity to comment upon the issues of interest to both the County and the School District. We ask that the recorded exemption not be approved until the applicant demonstrates that the cash in -lieu of land dedication fee has been paid, or that arrangements have been made with the School District. Since well permit no. 211207 was issued for a 35.01 -acre parcel and now will located on a 12 -acre parcel we recommend that permit no. 211207 is re -permitted to only claim the 12 acres for the proposed Lot A. The ability of the existing well on proposed Lot A to be re -permitted will be evaluated at the time that the well permit application is submitted. Since the new Lot B is to be created through an exemption from the subdivision regulations it may qualify for a new residential well permit. The ability of Lot B to obtain a well permit will be evaluated at the time that the well permit application is submitted. However, note that according to our records, well permit no. 211208 was issued for a portion of the land that is subject to this Office of the State Engineer 1313 Sherman Street, Suite 818 • Denver, CO 80203 • Phone: 303-866-3581 • Fax: 303-866-3589 www.water.state.co.us Exemption from Platting for Ain Hladke April 28, 2009 • Page 2 exemption. The remainder of proposed Lot B is claimed by well permit no. 211207. Well permit no. 211208 is currently permitted pursuant to C.R.S. 37-92-602(3)(b)(II)(A) as the only well on a tract of land of 37.14 acres described as Lot B in the N1/2 of the SW1/4, Section 21, Township 2 North, Range 66 West. The land area claimed by well permit no. 211208 includes a portion of proposed Lot B. Therefore, a permit to construct an exempt well pursuant to C.R.S. 37-92-602 cannot be approved for proposed lot B until such time as well permit nos. 211207 and 211208 are re -permitted to claim only the lot on which the well is located, Our office recommends that, at a minimum, the information that well permit nos. 211207 and 211208 must be re -permitted prior to Lot B obtaining an exempt well permit, be recorded on the plat and made available to anyone purchasing/owning the lot. Should you have any questions in this matter, please contact loana Comaniciu of this office. Surface runoff is medium, and the erosion hazard is low. In irrigated areas this soil is suited to the crops com- monly grown in the area. Perennial grasses and alfalfa or close grown crops should be grown at least 50 percent of the time. Contour ditches and corrugations can be used in irrigating close grown crops and pasture. Furrows, con- tour furrows, and cross slope furrows are suitable for row crops. Sprinkler irrigation is also desirable. Keeping til- lage to a minimum and utilizing crop residue help to con- trol erosion. Maintaining fertility is important. Crops respond to applications of phosphorus and nitrogen. In nonirrigated areas this soil is suited to winter wheat, barley, and sorghum. Most of the acreage is planted to winter wheat. The predicted average yield is 25 bushels per acre. The soil is summer fallowed in alternate years to allow moisture accumulation. Generally precipitation is too low for beneficial use of fertilizer. Stubble mulch farming, striperopping, and minimum til- lage are needed to control soil blowing and water erosion. Terracing also may be needed to control water erosion. The potential native vegetation on this range site is dominated by sand bluestem, sand reedgrass, and blue grama. Needleandthread, switchgrass, sideoats grama, and western wheatgrass are also prominent. Potential production ranges from 2,200 pounds per acre in favora- ble years to 1,800 pounds in unfavorable years. As condi- tion deteriorates, sand bluestem, sand reedgrass, and switchgrass decrease and blue grama, sand dropseed, and sand sage increase. Annual weeds and grasses invade the site as range condition becomes poorer. Management of vegetation on this soil should be based on taking half and leaving half of the total annual produc- tion. Seeding is desirable if the range is in poor condition. Sand bluestem, sand reedgrass, switchgrass, sideoats grama, blue grama, pubescent wheatgrass, and crested wheatgrass are suitable for seeding. The grass selected should meet the seasonal requirements of livestock. It can be seeded into a clean, firm sorghum stubble, or it can be drilled into a firm prepared seedbed. Seeding early in spring has proven most successful. Windbreaks and environmental plantings are generally suited to this soil. Soil blowing, the principal hazard in establishing trees and shrubs, can be controlled by cul- tivating only in the tree row and by leaving a strip of vegetation between the rows. Supplemental irrigation may he needed at the time of planting and during dry periods. Trees that are best suited and have good survival are Rocky Mountain juniper, eastern redcedar, ponderosa pine, Siberian elm, Russian -olive, and hackberry. The shrubs best suited are skunkbush sumac, lilac, and Siberi- an peashrub. Wildlife is an important secondary use of this soil. The cropland areas provide favorable habitat for ring-necked pheasant and mourning dove. Many nongame species can be attracted by establishing areas for nesting and escape cover. For pheasants, undisturbed nesting cover is essen- tial and should be included in plans for habitat develop- ment, especially in areas of intensive agriculture. Range- land wildlife, for example, the pronghorn antelope, can be attracted by developing livestock watering facili' ' mss, managing livestock grazing, and reseeding where nee( Rapid expansion of Greeley and the surrounding has resulted in urbanization of much of this Olney The soil has good potential for urban and recrea development. The only limiting feature is the mode rapid permeability in the substratum, which cat hazard of ground water contamination from sewage lagoons. Lawns, shrubs, and trees grow well. Capability subclass IIIe irrigated, IVe nonirrigated; Sandy Plains range site. V Osgood sand, 0 to 3 percent slopes. This is a deep, well drained soil on smooth plains at elevations of 4,680 to 4,900 feet. It formed in eolian sands. Included in mapping are small areas of soils that have a subsoil within 20 inches of the surface. Also included are small areas of soils that have a loam and sandy clay loam subsoil. Typically the surface layer of this Osgood soil is gray- ish brown sand about 22 inches thick. The subsoil is brown sandy loam about 12 inches thick. The substratum to a depth of 60 inches is pale brown loamy sand and sand. Permeability is moderately rapid. Available water capacity is moderate. The effective rooting depth is 60 inches or more. Surface runoff is very slow, and the ero- sion hazard is low. This soil is suited to limited cropping. Intensive cropping is hazardous because of erosion. The cropping system should be limited to such close grown crops as al- falfa, wheat, and barley. This soil also is suited to ir- rigated pasture. A suitable cropping system is 3 to 4 years of alfalfa followed by 2 years Of corn and small grain and alfalfa seeded with a nurse crop. Closely spaced contour ditches or sprinklers can be used in irrigating close grown crops. Contour furrows or sprinklers should be used for new crops. Applications of nitrogen and phosphorus help in maintaining good produc- tion. The potential vegetation on this soil is dominated by sand bluestem, sand reedgrass, switchgrass, sideoats grama, needleandthread, little bluestem, and blue grama. Potential production ranges from 2,500 pounds per acre in favorable years to 1,800 pounds in unfavorable years. As range condition deteriorates, the sand bluestem, switchgrass, sand reedgrass, sideoats grama, and little bluestem decrease; forage production drops; and sand sage increases. Undesirable weeds and annuals invade and "blowout" conditions can occur as range condition becomes poorer. Management of vegetation on this soil should be based on taking half and leaving half of the total annual produc- tion. Seeding is desirable if the range is in poor condition. Sand bluestem, sand reedgrass, indiangrass, switchgrass, sideoats gram a, little bluestem, and blue grama are suita- ble for seeding. Because this soil is susceptible to soil blowing, the grasses should be seeded with an interseeder 34 41 Cory-%nd4illi SOIL SURVEY • or drilled into a firm, clean sorghum stubble. Seeding early in spring has proven most successful. Brush management can also help to improve deteriorated range. Windbreaks and environmental plantings are fairly well suited to this soil. Blowing sand and low available water capacity are the principal hazards in establishing trees and shrubs. This soil is so loose that trees should be planted in shallow furrows, and vegetation is needed between the rows. Supplemental irrigation may be needed to insure survival. Trees that are best suited and have good survival are Rocky Mountain juniper, eastern redcedar, ponderosa pine, and Siberian elm. The shrubs best suited are skunkbush sumac, lilac, and Siberian peashrub. Range- land wildlife, for example, the pronghorn antelope, can be attracted by developing livestock watering facilities, managing livestock grazing, and reseeding where needed. Few areas of this soil are in major growth and ur- banized centers. The chief limiting feature is the rapid permeability in the substratum, which causes a hazard of ground water contamination from seepage. Potential for recreation is poor because of the sandy surface layer. Capability subclass IVe irrigated, VIe nonirrigated; Deep Sand range site. b"D 50 —Otero sandy loam, 0 to 1 percent slopes. This is a deep, well drained soil on smooth plains at elevations of 4,700 to 5,250 feet. It formed in mixed outwash and eolian deposits. Included in mapping are small areas of soils that have loam and clay loam underlying material. Typically the surface layer is brown sandy loam about 12 inches thick. The underlying material to a depth of 60 inches is pale brown calcareous fine sandy loam. Permeability is rapid. Available water capacity is moderate. The effective rooting depth is 60 inches or more. Surface runoff is slow, and the erosion hazard is low. This soil is used almost entirely for irrigated crops. It is suited to all crops commonly grown in the area, includ- ing corn, sugar beets, beans, alfalfa, small grain, potatoes, and onions. An example of a suitable cropping system is 3 to 4 years of alfalfa followed by corn, corn for silage, sugar beets, small grain, or beans. Generally, such charac- teristics as a high clay content or a rapidly permeable substratum slightly restrict some crops. All methods of irrigation are suitable, but furrow ir- rigation is the most common. Proper irrigation water management is essential. Barnyard manure and commer- cial fertilizer are needed for top yields. Windbreaks and environmental plantings are generally suited to this soil. "Blowouts" occur as range condition becomes poorer. The native vegetation on the Loup soil is dominated by switchgrass, little bluestem, sand reedgrass, and western wheatgrass. Indiangrass, sand bluestem, prairie cordgrass, slender wheatgrass, alkali sacaton, saltgrass, sedge, and rush are also present. Potential production ranges from 4,000 pounds per acre in favorable years to 3,000 pounds in unfavorable years. As range condition deteriorates, the switchgrass, sand bluestem, indiangrass, little bluestem, and prairie cordgrass decrease, and saltgrass, blue grama, sand dropseed, sedge, and rush increase. Undesirable weeds and annuals invade the site as range condition becomes poorer. Seeding with an interseeder is advisable if the range is in poor condition. Sand reedgrass, sand bluestem, sideoats grama, switchgrass, little bluestem, indiangrass, and blue grama are suitable for seeding. Seeding early in spring has proven most successful. Grazing should be light to prevent range deterioration. Wildlife is an important secondary use of this unit. On the Valent soil, rangeland wildlife, for example, the pronghorn antelope, can be attracted by developing livestock watering facilities, managing livestock grazing, and reseeding where needed. The Loup soil, which is typically wet and produces an abundance of wetland vegetation, attracts wetland wil- dlife species, such as mallard, teal, geese, and miscellane- ous shorebirds. Primary management of this soil for wet- land wildlife includes managing livestock grazing, fencing to control livestock, protecting from fire, and preventing drainage. Natural wetland vegetation should be allowed to develop. Capability subclass VIe irrigated, VIe nonir- rigated; Valent soil in Choppy Sand Meadow range site, Loup soil in Sandy Meadow range site.
