BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
APRIL 8, 2009
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial
Center, Greeley, Colorado, April 8, 2009, at the hour of 9:00 a.m.
ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were
present, constituting a quorum of the members thereof:
Commissioner William H. Garcia, Chair

MINUTES: Commissioner Conway moved to approve the minutes of the Board of County Commissioners
meeting of April 6, 2009, as printed. Commissioner Long seconded the motion, and it carried unanimously.
AMENDMENTS TO AGENDA: There were no amendments to the agenda.
PUBLIC INPUT: No public input was given.
CONSENT AGENDA: Commissioner Rademacher moved to approve the Consent Agenda as printed.
Commissioner Conway seconded the motion, and it carried unanimously.
PROCLAMATIONS:
NATIONAL PUBLIC HEALTH WEEK - APRIL 6-11, 2009: Chair Garcia read the proclamation into the
record, recognizing the week of April 6-11, 2009, as National Public Health Week. Dr. Mark Wallace,
Director, Department of Public Health and Environment, expressed his appreciation to the Board for their
interest in understanding public health, and confirmed their interest and support makes a difference in the
lives of Weld County residents. He stated many staff members within the Department do not get the
chance to interact with the Board, as staff tends to work in the background through partnerships within the
community. He confirmed the residents of Weld County, from all walks of life, make Weld County a great
place to live, and he invited the Board to attend the luncheon being held to celebrate Public Health Week,
and which time community partnerships will be celebrated. Commissioner Conway stated it was a pleasure
to meet with various staff members of the Department during a recent meeting, and he requested that
Dr. Wallace extend the Board's appreciation to his staff for all of the comments and suggestions provided
during the meeting.

COMMISSIONER COORDINATOR REPORTS: Commissioner Conway stated the Senate passed the Bill
concerning emissions testing by a vote of 18-17, and the Bill has been forwarded to the House of
Representatives fora future vote. He indicated the Board has been working to address the issue regarding
emissions testing with area legislators, and the Bill will probably be presented to a Committee next week.
He clarified a very important Metropolitan Planning Organization (MPO) meeting is taking place in the
Town of Windsor tomorrow night, and the issue of emissions will be addressed through the presentation
of concerns and questions.
Commissioner Conway further stated he has met representatives from the Weld County Farm Bureau,
which has agreed to send a letter of support to the necessary Congressional delegation, concerning the
situation at the Pawnee National Grasslands with the U.S. Forest Service. Commissioner Long indicated
he was recently interviewed by Channel Four News, and Forest Ranger Lori Bell, of the U.S. Forest
Service, was also interviewed. He confirmed the fee figures she quoted within the interview were double
the costs of the figures provided within a previous briefing, and he is now questioning what the real costs
are, and how the public gains benefit. He further confirmed Ms. Bell indicated the U.S. Forest Service
must spend specific funds on the Pawnee National Grasslands, which confirms the Board's argument that
local entities are not allowed to provide input regarding decisions for prescribed burns. He clarified the
statements provided are counter -productive to the statements which have been provided by
representatives in previous years, and the people of Weld County should be alarmed that the control of
the grasslands does not receive local input; rather, decisions are handed down from Washington, D.C.
Commissioner Long clarified, two years ago, approximately 6,300 acres of the grasslands were burned
during a drought situation, and over 400 acres of grassland were mowed, which could have been utilized
for cattle grazing. He indicated he believes taxpayers money is being wasted, and ranchers within the area
are not able to benefit from the poor decisions being made. He further indicated he hopes the Weld
County Farm Bureau is able to grow its alliance, in order to bring more attention to the situation.
BIDS:
PRESENT BID #B0900055, WINDOW CLEANING - DEPARTMENT OF BUILDINGS AND GROUNDS:
Monica Mika, Director of Administrative Services, read the names of the six vendors who submitted a bid
into the record. Said bid will be considered for approval on April 22, 2009.
PRESENT BID #6003-09, FUEL (UNLEADED, DIESEL, E-85, AND PROPANE): Ms. Mika read the names
of the four vendors who submitted a bid into the record. Said bid will be considered for approval on
April 22, 2009. In response to Chair Garcia, Ms. Mika stated the vendors are usually able to provide all
four types of fuel; however, there is flexibility available to separate the bid in order to select the lowest
bidder for each fuel type. Barb Connolly, Controller, confirmed it has been several years since the bid has
been required to be separated; however, it can be done if necessary.
PRESENT BID #60900087, EMERGENCY SIRENS - DEPARTMENT OF FINANCE AND
ADMINISTRATION: Ms. Mika read the names of the five vendors who submitted a bid into the record.
Said bid was originally to be considered for approval on April 22, 2009; however, she requested that the
date be modified to April 27, 2009, due to a community meeting scheduled for April 22, 2009.
NEW BUSINESS:
CONSIDER WATERLINE RELOCATION AGREEMENT AND AUTHORIZE CHAIR TO SIGN - LITTLE
THOMPSON WATER DISTRICT: Bruce Barker, County Attorney, indicated Stephanie Arries, Assistant
County Attorney, has worked with Bob Patrick, Department of Public Works, to draft the agreement.
Mr. Patrick stated the Department is constructing County Road 7, south of State Highway 60, and a
waterline owned by the Little Thompson Water District is located within the easement, south of State
Highway 60. He clarified the waterline needs to be lowered so that the roadway may be properly
constructed, and he confirmed the ditches will be deepened in order to provide adequate cover for the

pipe. Commissioner Conway moved to approve said agreement and authorize the Chair to sign. The
motion was seconded by Commissioner Rademacher. In response to Commissioner Kirkmeyer,
Mr. Patrick clarified the water district has an easement, located outside of the right-of-way on State
Highway 60, and the Department is relocating County Road 7 by a total of 600 feet to the west. He
indicated the waterline will have to be crossed, and he confirmed the waterline is within the easement
controlled by the water district. There being no further discussion, the motion carried unanimously.
CONSIDER APPOINTMENT TO JUVENILE COMMUNITY REVIEW BOARD: Commissioner Rademacher
moved to appoint Kelly Slade to the Juvenile Community Review Board, with a term to expire November 1,
2011. Commissioner Kirkmeyer seconded the motion, and it carried unanimously.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
Consent Agenda. No Ordinances were approved.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Acting Clerk to the Board.
There being no further business, this meeting was adjourned at 9:20 a.m.
