RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST ENRIQUE AND ELISA GUERRERO FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Enrique and Elisa Guerrero, BCV #0800149, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 20th day of October, 2009, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Enrique Guerrero, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until November 20, 2009, to allow adequate time for the property owners to have a
survey of the property conducted in order to establish the property lines and the appropriate
setback and offset distances, to bring the subject property into compliance, and for an inspection
of the property by the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that BCV #0800149 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Enrique and Elisa Guerrero to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an interest
in the properties, and any persons acting in active concert with the identified parties, with an
instruction for delay of action upon such referral until November 20, 2009, to allow adequate time
for the property owners to have a survey of the property conducted, in order to establish the
property lines and the appropriate setback and offset distances, in order to bring the subject
property into compliance.

enlarged, altered, repaired, moved, improved, removed, converted or demolished unless a
separate building permit for each building or structure has been first obtained from the
Building Inspection Department. (Before any demolition permits are issued, approval must
be given by the Department of Public Health and Environment.)
23-3-50.6 Minimum SETBACK: twenty (20) feet. Fences are not required to comply with
the minimum SETBACK and may be located on the property line. Fences located on
corner lots abutting public rights -of -way shall not obstruct the view of vehicular traffic at an
intersection.
23-3-50.C Minimum OFFSET: three (3) feet, or one (1) foot for each three (3) feet of
BUILDING HEIGHT, whichever is greater. Fences are not required to comply with the
minimum OFFSET and may be located on the property line.
REMEDY
A current survey shall be submitted to determine property lines and setbacks regarding the buildings
on each side.
RECOMMENDATION
Staff recommends this case be referred to the County Attorney but delay action for 30 days to allow
the property owners to obtain a current survey to determine the property line.

12/02/2008 Phone Call Phone call from Enrique Guerrero. He was wondering
when he can pick up his building permit. I explained that
we cannot release the permit until both sides of the
building are moved at least three feet from the property
line. He said he will do that this weekend.
02/26/2009 Phone Call Phone call from Enrique. He almost has his portion of
the building moved and will call for inspections when he
is ready. He will then get a permit for the horse stalls.
03/04/2009 Phone Call Phone call from Enrique. He says he is getting his
property into compliance. He asked if he could build a
"cabin" on his property so he and his kids could stay
there (they live in Thornton and he rents the house to
someone) and have a bathroom where they could
shower after working with the horses. I told him he can
put a bathroom in an outbuilding but it cannot be used for
a dwelling unit or even to stay in ocassionally.

This meeting will take place at the County Commissioners Hearing Room, First Floor, Weld County Centennial Center,
915 10th Street, Greeley. Colorado. It is recommended that you or a representative be in attendance at this meeting
to answer any questions the Board of County Commissioners might have regarding the violation.
The Department of Building Inspection will be recommending that the Board of County Commissioners authorize the
County Attorney to proceed with legal action to remedy the violation. Our records indicate that you were made aware
of that the nature of the violation, the action necessary to correct the violation. and that you were given sufficient time to
remedy the violation. If you wish to see me personally, please call to schedule an appointment so that I may reserve a
sufficient amount of time with you.

Due to the unresolved setback issue regarding the "shared barn" between the two properties, it has been determined
that the property pins must be identified by submitting a current survey of the properties. Without this information,
setbacks on each side of the property line cannot be identified.
Failure to obtain a survey and submit the information to this department by August 31, 2009, will result in this office
scheduling the violations before the Board of County Commissioners to consider whether to refer the case to the
County Attorney's Office for legal action.

three (3) feet setback from the property line by June 1, 2009. It has been determined that, if the fence is the
property line, the building does not meet the requirements. If the fence is not on the property line, the property
pins must be identified and the property line marked to verify setbacks.
Failure to correct the violation and schedule an inspection within 10 days from the date of this letter will result
in this violation being scheduled before the Board of County Commissioners to consider whether to refer the
case to the County Attorney's Office for legal action.
