RE: APPROVAL OF RENEWAL APPLICATION FOR 3.2% BEER LICENSE ISSUED TO
RUTH L. HARDING ENTERPRISES, INC., DBA CROW VALLEY CAFE AND
AUTHORIZE CHAIR TO SIGN - EXPIRES OCTOBER 6, 2010
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Ruth Harding Enterprises, Inc.,dba Crow Valley Cafe, presented to the Board
of County Commissioners of Weld County, Colorado, an application for the renewal of a County
Retail License (On/Off Premises) for the sale of fermented malt beverages, containing not more
than 3.2% of alcohol by weight, and
WHEREAS, pursuant to Exhibit 5-H of the Weld County Code, said applicant has paid the
sum of $57.50 to the County of Weld for the renewal of the existing license, and
WHEREAS, said applicant has exhibited a State License for the sale of 3.2% fermented
malt beverages for consumption by the drink on the premises, and/or in sealed containers not for
consumption at the place where sold, outside the corporate limits of any town or city in the County
of Weld at the location described as follows:
P.O. Box 26, Briggsdale, Colorado 80611-0026;
being further described as part of Section 20,
Township 8 North, Range 62 West of the 6th P.M.,
Weld County, Colorado
NOW,THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Weld
County, Colorado, having examined said application and the other qualifications of the applicant,
does hereby grant License Number 2009-03 to said applicant to sell 3.2% fermented malt
beverages for consumption by the drink on the premises, and/or in sealed containers not for
consumption at the place where sold, only at retail at said location; and the Board does hereby
authorize and direct the issuance of said license by the Chair of the Board of County
Commissioners, attested to by the Clerk to the Board of Weld County, Colorado, which license
shall be in effect until October 6, 2010, providing that said place where the licensee is authorized
to sell 3.2%fermented malt beverages for consumption by the drink on the premises only, and/or
in sealed containers not for consumption at the place where sold, shall be conducted in strict
conformity to all of the laws of the State of Colorado and the rules and regulations relating thereto,
heretofore passed by the Board of County Commissioners of Weld County, Colorado, and any
violations thereof shall be cause for revocation of the license.

INQUIRY

In response to your request, Environmental Health Services has reviewed the Retail Food
Service Establishment file for Crow Valley Cafe, located at 37937 Highway 14, in
Briggsdale, Colorado.
The facility was opened August 28, 2008. A condition of opening was that a chlorination
system would be required if the facility had a positive bacteriological water sample. The
facility was allowed to open without a chlorination system due to having a well that was
not affected by surface water and having a negative bacteriological water sample. As per
the Colorado Retail Food Establishment Rules and Regulations the facility was to submit
samples once per quarter.
However, recently the facility had a positive bacteriological water sample and as such,
the facility is required to install a chlorination system. The owner has agreed to install the
chlorination system as required. Further testing of the water system has been done and
current samples have come back negative. Currently a time line for installation has not
been determined, but the Department feels that the facility is taking action to remedy the
issue.
The Department recommends approval of their liquor license at this time.

Dear Commissioners,
I have researched and found no reported calls for service to the Crow Valley Cafe,
located at 37937 Highway 14, Briggsdale,CO 80611 for the calendar year of 2008.
There have been no reported calls for service to date in 2009.
The establishment has a liquor license,however does not sell alcoholic beverages
to the public. The establishment does not have any alcoholic beverages on the property.
I find no grounds for disapproval for the renewal of the liquor license.
