HomeMy WebLinkAbout20100205.tiffMinutes WELD COUNTY COUNCIL December 21, 2009 CD 12A2009 The Weld County Council met in regular session in full conformity with the Weld *County Home Rule Charter, Monday, December 21, 2009, 6:30 p.m., at the Weld County Centennial Center, 915 10th Street, Greeley, CO. ROLL CALL: The meeting was called to order by President John Kivimaki. Vice President Perry Buck, Councilmen Don Mueller and Charles Tucker were present, constituting a quorum of the members. Councilwoman Ginny Buczek was excused. Also present was Weld County Sheriff John Cooke, Bruce Barker, Monika Mika and Karla Ford, Council Secretary. PUBLIC COMMENT: There was no public comment. APPPOVAL OF AGENDA: Councilman Kivimaki requested to add Bruce Barker to speak after the approval of minutes. Councilwoman Buck made a motion to approve the agenda with addition. The motion was seconded by Councilman Tucker and carried. APPROVAL OF MINUTES: Councilwoman Buck made a motion to approve the November 16, 2009 minutes. The motion was seconded by Councilman Tucker and carried. COUNCIL INFORMATION: Bruce Barker, Weld County Attorney, distributed information and discussed issues regarding Home Rule Charter rules in conjunction to setting commissioner salaries and information related to executive sessions. Mr. Barker stated the Weld County Council Resolution 178 adopted at the November meeting was actually a void resolution. Mr. Barker suggested that the Council rescind Resolution 178. Councilman Kivimaki's asked Mr. Barker if some language could be submitted to voters regarding a provision in the Home Rule Charter regarding the Weld County Council's ability to alter/reduce commissioner salaries in regard to economic issues. Mr. Barker stated that is an issue that can be put to voters. Councilwoman Buck asked Mr. Barker if the Commissioners have the opportunity to not accept an increase as an individual and Mr. Barker said they do have that option. Mr. Barker discussed the executive sessions in conjunction with state statutes. He stated the justified times the Council should go into these sessions is due to a performance review of the secretary or receiving legal advice regarding the position of the county. Mr. Barker stated he is available to come discuss County Council procedures at the January 2010 meeting. Councilman Mueller made a motion to rescind Weld County Council Resolution 178. The motion was seconded by Councilwoman Buck and passed. Councilman Tucker made a motion to create a resolution stating The Weld County Council asks the Weld County Commissioners to consider foregoing their 2010 pay raise ptit rcJic7-1J 2010-0205 Weld County Council Minutes December 21, 2009 Page 2 of 3 and donate it to the county or charity as appropriate. Councilman Kivimaki stepped aside and seconded the motion and it passed. REVIEW PROGRAM: Weld County Sheriff John Cooke distributed several handouts and outlined what his responsibilities are to the county residents. As a sheriff, by statute, he is chief law enforcement official in the county. He is also required to have a jail, serve civil papers, provides search and rescue, chief fire marshal of the county and approves concealed weapons permits for the county. The patrol and jail side of the Sheriffs Office have been nationally recognized. The jail side created a video on infectious diseases in a jail setting. Other Sheriffs offices use this video for training. The patrol side was asked to send an officer to Maryland to participate with other officers to give input on traffic safety. This group came up with new policies to use nationwide. In response to Councilman Kivimaki, Sheriff Cooke stated that the Crime Lab has been receiving earmarked money. He believes the lab analysis is the future of law enforcement. Weld County, Larimer County, Greeley, Ft. Collins, Loveland have joined forces to handle all the lab work for Northern Colorado. Each agency sends their respective officer to one particular lab — Ft. Collins handles the fingerprint analysis; Greeley has a digital forensics lab and also a chemistry lab. Once a new facility is completed, all lab analysts will work under one roof. One goal is to work with UNC to attract new students majoring in forensic science to our county. Sheriff Cooke discussed statistics regarding priority one, two and three calls, the number of calls for service, by time of day and day of week. Calls for service have gone up but the crime rate has gone down. An overview of the jail and history of inmates was given and an analysis of all adult bookings was distributed. When the jail had 400 beds, a record of 697 inmates were in jail. The new part of the jail was opened with a total of 800 beds and the number of inmates has decreased. CrimeTRAC - each month the commanders in each district sit down and discuss crime reports. The commanders come up with a SARA report (Scan, Analyze, Respond, Assess) for their district. Discussion on what worked the previous month and/or what else needs to be done happen at the CrimeTRAC meetings as well. The officers patrol the areas where more crimes are being committed and also work with the community in those areas. In response to Councilman Mueller, Sheriff Cooke stated that the Highway State Patrol and the Sheriffs Department both concentrate on their own roads but if one is closer to a call/accident than that particular department responds. It is about working together and not worrying about the territory issue. Traffic Unit — This group came up with a set of goals to reduce fatal accidents. As of December 2151 that goal has been met. In previous years, all tickets given out were state tickets, which mean the money went to the state. A few years ago, a model traffic code (MTC) was adopted so that any fines are given back to the county general fund. Weld County Council Minutes December 21, 2009 Page 3 of 3 Several tickets are still part of the state tickets such as driver's license tickets and DUI's. Recently, the MTC fines have been increased. Concealed Weapons Permit — The state law allows the Sheriff to enter people with a concealed weapons permit into a statewide database. Weld County, along with a few other counties, does not participate in that program. Weld County has 3,763 active Concealed Handgun Permits issued. Once someone has applied for this permit, the Sheriff has 90 days to turn that permit around. The average in Weld County is 39.6 days for application approval. NEW BUSINESS: 2010 Meeting Dates Councilman Mueller made a motion to approve the 2010 Weld County Council Dates. The motion was seconded by Councilwoman Buck and passed. Notebook Update The secretary distributed an update for the Council Notebooks. Coordinator Reports Councilman Kivimaki attended the commissioner hours in the south part of the county. Councilwoman Buck attended a Progressive 15 retreat where the legislation will be affecting Weld County. She will continue to update the council on Progressive 15. Payment of Bills Councilwoman Buck made a motion for the bills to be paid as listed below: Mileage for Councilman John Kivimaki $ 51.94 Mileage for Councilwoman Perry Buck $ 81.62 Mileage for Councilman Don Mueller $ 15.64 Mileage for Councilman Charles Tucker $ 43.46 The motion was seconded by Councilman Tucker and passed.
