BE IT RESOLVED, by the Board of County Commissioners of Weld County,
Colorado, that they hereby approve the dedication of the perpetual rights-of-way
over the public roads, streets, highways, easements in behalf of the public, as
submitted by the Trinity Episcopal Church, said tract of land located in the
Northeast Quarter of Section 14, Township 5 North, Range 66 West of the 6th P. M. ,
Weld County, Colorado, more particularly described as follows:
Commencing at the NE corner of said Section 14 and considering the
North line of the NEt of said Sec 14 to bear N 90°00'00" West and
with all other bearings contained herein relative thereto:
Thence North 90°00'00" West along the North line of the NE's of said
Sec 14, a distance of 1,466.40' ; thence South 03°25'00" East, 50.09' to
the South right-of-way line of 20th Street; the true point of beginning:
Thence continuing South 03°25'00" Eat, 503.00' to the North
easment line of the City of Greeley Water transmission pipelines;
thence North 61°40'30" West along the North easement line of the City

Gentlemen :
The following are excerpts from the minutes of
the City Planning Commission meeting of June 4, 1969 :
The motion was made by Kadlecek, seconded by Bartels,
to recommend to the Weld County Planning Commission to
approve the dedication of 38th Avenue and 20th Street by
St. John' s Evangelical Lutheran Church . The vote was
unanimously in favor of the motion.
Kadlecek moved to recommend to the Weld County
Planning Commission that the existing platted 38th Avenue
north of this property be changed to 37th Avenue so the
street patterns coincide in Highland Acres Subdivision.
Motion seconded by Williams . Motion carried.
The motion was made by Kadlecek, seconded by McAfee,
to recommend to the Weld County Planning Commission to
deny the request of change of zone from estate to high
density at the corner of_ 35th Avenue and West 20th Street,
because of the vagueness of the plans ; because specific
plans should be presented for the proposed development;
and because the City Planning Commission feels the compre-
hensive plan should be completed before any change of zone
is made in this area . Chairman called for a vote with four
voting in favor of the motion. Bartels abstained. Motion
carried.

Gentlemen:
In March of 1966 , I sold the St. John' s German Evangelical
Lutheran Church ten acres of land in the East Half (Eh) , South-
west Quarter (SWl6) of the Southeast Quarter (SEA) of Section
Eleven (11) , Township Five (5) North, Range Sixty-six (66) West,
in Weld County, Colorado .
Subsequent to that time , I gave a strip of land along my
remaining land 20 feet in width for roadway purposes, which was
all that was requested. After giving the 20-foot strip, I built
a fence along my present east property line.
The Church has since requested that I grant an additional
ten feet off my east side for roadway purposes. I am presently
using this property for agricultural purposes for pasture and
have no intention of moving my fence.
In order to satisfy requirements of the Weld County Planning
Commission, I do hereby agree to dedicate an additional 10-foot
strip of land extending along the east side of my land for street
purposes at such time as:
1. Sixteenth Street is opened up to the west of 35th Avenue
and this street to the east of my property can be opened through
to 16th Street as extended;
2. I sell or subdivide my remaining property.

The said conveyance shall be with all the title and legal
effect as if said strip of ground had been taken for public high-
way under award in eminent domain proceedings under the statutes
of Colorado. The said right of way shall be for relocation of,
and in substitution for, all that easterly portion of the public
road now existing along the east and west center line of said
section, connecting said county road known as 23rd Avenue with
the point of intersection of said new right of way, including the
following strip:
Starting at the intersection of centerline of existing
county road and centerline of 23rd Avenue at East 4 corner
of Section 12, and traversing S 00 111 West a distance of
30.00 feet to a point on centerline of 23rd Avenue; thence
South 89°551 30" West a distance of 50.00 feet to a point
of beginning; thence South 89° 551 30" West along existing
south right-of-way line a distance of_794.37 feet to a
point of curvature on existing right-of-way line; thence
along the arc of a left curve whose radius is 701.89 feet
a distance of 291.14 feet to a point of tangency on exist-

2. The First Parties agree to promptly reimburse the Second
Party for all the costs of construction over said strip of ground
of a public highway to be substituted of the same quality as that
now extending from the east line of said section twelve (12) to
the above described strip.
3. The Second Party accepts said right of way for said pro-
posed new road and agrees to diligently complete construction of
the same and concurrently with the completion of such construction,
to adopt a resolution vacating that portion of the existing public
highway extending westerly along the east and west center line of
said section twelve (12) from the west line of 23rd Avenue to the

4. It is understood that the title to said vacated roadway
between said two points along the said line between the Northeast
and the Southeast Quarters of Section Twelve (12) shall, by opera-
tion of law thereupon, vest in the First Parties and the Third
Parties as owners of the abutting land, each abutting owner taking
to the center of the vacated roadway.
5. The Third Parties covenant that they are owners of that
abutting portion of the Southeast Quarter of the Northeast Quarter
(SEf,NEj) of said Section Twelve (12) and consent and agree to the
vacating of said portion of the now existing roadway along the East

WHEREAS, the dead end and sharp angle connections on the
existing County Road, #133, located in Section 12, Township 5 North,
Range 66 West, of the 6th P. M., Weld County, Colorado, are inconven-
ient anddan dangerous to the traveling public and the relocation of an

o easterly portion of said road along the east and west middle line of
o Section Twelve would reduce present hazards to life and property of
o users of the road, and
WHEREAS, by connecting said road with the much traveled "Six-
`P teenth Street", which crosses the City of Greeley, said Sixteenth
,A Street having a .300 foot offset at the range line, would eliminate
cm dangerous angle turns, and
WHEREAS, THE RELOCATION OF SAID County Road, from a point in
the middle of Section 12 to a point about 100 feet West thereof,
would improve safety for users of said roads, and
WHEREAS, the owners of the land required for said relocated
portion of said road have tendered their deed to Weld County, Colorado,
for the right-of-way and have agreed to reimburse the construction
cost of the County for said relocated portion of said road, and
WHEREAS, the Board believes it is in the interest of the
safety, health and welfare of the public that the easterly portion
of said road be relocated for about its East 1,000 feet to a line
which would connect the west end of Sixteenth Street at its inter-
section with Twenty-third Avenue; and that the County should, for
such relocation, accept the deed for right-of-way from the owners of
said relocated portion of the road; cease to maintain; and.vacate the
easterly portion of the present existing road along the middle line
of said Section 12 in substitution therefor of said new road right-
of-way.
NOW, THEREFORE, BE IT RESOLVED AND IS SO ORDERED, by the Board
of County Commissioners, Weld County Colorado, that the easterly
1,000 feet of County Road #133, be vacated, closed and discontinued;
said vacated portion of road is more particularly described as follows;
to-wit:
Starting at the intersection of centerline of existing
county road and centerline of 23rd Avenue at East 4
•corner of Section 12, and traversing SO° 11' West a
distance of 30.00 feet to a point on centerline of 23rd
Avenue; thence South 89° 55' 30" West a distance of
50.00 feet to a point of beginning; thence South 89° 55'

tance of 784.37 feet to a point of curvature on existing
right-of-way line; thence along the arc of a left curve
