WHEREAS, it has been determined by the Board of County Commis-
sioners, Weld County, Colorado, that a certain tract of land being the
property of Fred B. Schaller and Nicholas J. Schaller, father and son, and
more particularly described as follows:
The East one-half of the East one-half of the Southwest Quarter
of Section 17, Township 1 North, Range 67 West of the Sixth
Principal Meridian, Weld County, Colorado, more particularly
described as: Beginning at the South Quarter corner said
Section 17; thence South 89°37'05" West on an assumed bearing
along the South line said Section 17 a distance of 668. 13 feet
to the Southwest corner said East one-half East one-half
Southwest Quarter; thence North 00°15'41" West along the West
line said East one-half East one-half Southwest Quarter a
distance of 2650. 08 feet to the Northwest corner said East
one-half East one-half Southwest Quarter; thence North 89°49'53"
East along the East-West centerline said Section 17 a distance of
664. 09 feet to the center said Section 17; thence South 00°20'55"
East along the North-South centerline said Section 17 a distance
of 2658. 18 feet to the point of beginning; containing 40. 510 acres,
more or less,
does not come within the purview of the definition of the terms "subdivision"
and "subdivided lands" as set forth in 1973 C. R. S. 30-28-101 (10), as
amended, and
WHEREAS, the Board of County Commissioners of the County of
Weld, State of Colorado, has studied the request of the petitioner and studied
the recommendations of the Weld County Planning Commission, and having
been fully informed, now desires to exempt this particular division of land
pursuant to its authority under 1973 C. R. S. 30-28-101 (10) (d), as amended.
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove
described tract of land owned by Fred B. Schaller and Nicholas J. Schaller,
father and son, be exempted from the definition of the terms "subdivision"
and "subdivided lands" as provided for in the new Weld County Subdivision
Regulations at Section 2-1, A. , (3) adopted August 30, 1972.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 26th day of May, A. D, , 1976.

Dear Commissioners:
The attached application, plat and related items are in reference to a
request, by Fred B. and Nicholas J. Schaller, for a Recorded Exemption
and Lot Size Variance on a parcel of land described as the Ez Ez SWa of
Section 17, Township 1 North, Range 67 West of the 6th P.M. , Weld
County, Coloardo. Said parcel is located 11/2 miles east and 3 miles
south of Dacono on the north side of County Road 7. Said parcel con-
tains 40. 510 acres of dry agricultural land. The request is to split
the property into parcels of 22 and 18.510 acres.
Based upon the information submitted, the Planning Commission staff
recommends denial for the following reasons:
1 . The proposed split does not comply with the Intent
Clause, Section 9-2 of the Weld County Subdivision
Regulations, which states:
"The intent in establishing the Recorded Exemption pro-
cedure is to provide, in accordance with the Weld County
Comprehensive Plan, a means whereby non-productive agri-
cultural lands may be developed for higher or more pro-
ductive uses, in-so-far as such uses are compatible with
surrounding agricultural uses in areas where such land
divisions are proposed. (Rev. 4/17/74)"
2. The proposed development is located in close proximity to
Dacono. Section 9-4 A. (6) states:

"That the original tract or parcel of land to be divided
under this Section meets the minimum lot size require-
ments established by the Weld County Zoning Resolution;
variance from this requirement being allowed only upon
good cause being shown to the Board of County Commis-
sioners or where said tract or parcel of land lies with-
in the comprehensive plan area of an existing incor-
porated town of Weld County. (Rev. 4/17/74)"
The Comprehensive Plan states:
"New residential developments which are not closely
connected to and served by municipal utilities and
services shall be discouraged."; and
"Proposals for new residential development adjoining
existing municipalities shall be encouraged so long as
they conform to the desires of the towns as expressed
in their comprehensive plans. "
The proposed split would not be in compliance with the
Comprehensive Plan. The parcel is located in the plan-
ning area of Dacono. An attached letter from the Dacono
Planning Commission indicates an objection as the development
would not be in the best interest of Dacono.
3. The proposed request violates the intent of the Agricultural
Zone in that it would further divide an area which has been
previously divided.

Gentlemen
The Dacono Planning Commission has decided to place an objection to
this application. It is the opinion of the Commission that future
interests of the Town of Dacono would be in jeopardy if the sub division
of this section of land is allowed.
The Commision feels that adequate water, sanitation, police and fire
protection services could not be provided by either Weld County or the
Town of Dacono and the sub division of this section would encourage
future development creating these problems.
Therefore, the Dacono Planning Commission requests that the application
by Fred B. Schaller for a recorded exemption be denied by Weld County
Planning Commission and the Zoning Administrator Tom E. Honn.

AFFADAVIT
TO WHOM IT MAY CONCERN:
This 40 acre tract was purchased by Fred B. Schaller
and son Nicholas J. Schaller in 1971, to be developed as
a home-site for each family.
Due to a later law, it became impossible to do this
legally. Fred B. Schaller, father, has developed a
home-site on Lot #2 (as per new survey). Nicholas J.
Schaller, son, could legally build his home or a home on
Lot #1 with this division.
This is not a request for development, but a permit to
divide and be legal according to the new State regulations.
Have adequate water storage and filtration system
set-up. R.E.A. power and Mountain Bell Telephone under-
ground. have approved Septic System on Lot #2. Lot #1
poses no problems for adequate Septic System.
