Re: Joint Notice of Measures Taken to Mitigate Natural Gas Detected in Water Well (Permit
No. 160720) at 20991 County Road 20, Fort Lupton, Colorado
Dear Mr. Neslin:
Noble Energy, Inc. ("Noble") and Jesse and Amee Ellsworth (the "Ellsworths") are pleased to submit this
Joint Notice of measures they have recently agreed upon to address the presence of dissolved biogenic and/or
thermogenic natural gas ("Gas") in the Ellsworths' water well ("Water Well"). Even though the source of the
gas in the Ellsworth's well has not been determined and Noble has performed all tests requested by the
COGCC, all with negative results, Noble is prepared to move forward with actions to assist the Ellsworths in
resolving their problems. As you know, the Water Well is the subject of COGCC's Complete Report
No. 200196553, and was disconnected by Noble with the permission of the Ellsworths on March 21, 2009,
when Noble began providing the Ellsworths with temporary substitute water for domestic use at their home.
Noble and the Ellsworths have agreed to Noble's installation of a filtration system to essentially remove
the Gas that has been previously detected in the Water Well and make it safe for use by the Ellsworths.
The parties have further agreed to cooperate and work diligently to resolve any remaining issues
associated with prior detections of Gas in the Water Well, including cooperation with COGCC staff in
their remaining investigative work to determine the source of Gas in the Water Well.
Please also note that beyond this notice of installation of a filtration system to mitigate the presence of
Gas in the Water Well and make it safe for use by the Ellsworths, the parties will continue to cooperate
to resolve their differences according to mutual agreeable terms that are and will remain strictly
confidential. Please contact Mr. Daniel Kelly, Vice President Wattenberg Operations, Noble Energy,
Inc., or Jesse and Amee Ellsworth if you have further questions regarding the planned installation of a
filtration system to mitigate the presence of Gas in the Water Well.
