I am inclosing a copy with the agreement made between Careers World Wide Inc. and COUNTY OF WELD. STATE OF COT ORADO ROM) MAINTENANCE AND IMPROVEMENTS AGREEMENT . Which states that Careers World Wide Inc. shall apply dust suppression rhrmirals approximately 300 ft. in front of the existing homes along WCR. 18 and WCR53. Mr Rica's home address is listed on WCR 18. As you know his home site on the comer of WCR 18 and WCR 53. I'm aware the Mr. Ries feels that I should apply dust suppression chemicals on both roads. I did try to appease Mr. Ries by applying 150 ft. of dust suppression chemicals on both roads, Mr. Ries apparently is very unhappy. Since there is no way to make Mr. Ries bappy,next year I will apply the full 300 ft. on WCR 18 which is his mailing address and we will address this issue next year, I'm quite sure. If W. Ries wants 300 ft. 1 suggest you give him ENVIROTCH SERVICE INC. phone number which is 303-477- 1919 and infant him, he can pay for it himself. I have addressed a letter to the Department of Planning Services for your review. Upon your review you'll see that it is well documented that it is not my school trucks creating all the dust. The reason I am writing you this letter is because oft a conversation I had with my neighbors. They said, they called you with concerns of the dust from all the vehicles traveling up and down WCR 18. And you replied to them, that it was due to the Truck Driving School I want you to know that I don't appreciate this comment. My trucks that use the haul route, WCR 18 and WCR 53 are not allowed to exceed 25 MPH. With the cameras Pm Installing it will show that my trucks produce minimal to no dust on the haul route. This letter basically states that I am in violation of case number USR.- 1438 for compliance with the Development Standards and Conditions of approval, as approved by the board of County Commissioners. Development Standard #7- 7he training trucks are limited to four in and out trips per day. The County Roads that serve this facility art County Road 18 and 53. One hundred percent of the truck traffic shall use this haul route. The trucks leaving this facility shall turn left of County Road 18, travel approximately V, mile. tam left of County Road 53, proceed south under 1-76 to State Highway 6 (Frontage Road) to the Kersey Road (County Road 49) to I-76 access, and return to the training facility using the same route. Students and employees should also use this route to minimize additional traffic is the area. The complaint has been that the Department of Public Works has received information that the number of truck trips (four in and out tips per day ) has been exceeded. The property is not in compliance with the following Development Standards. We all know that this complaint stems from one person, Mr. Ries, who lives on the corner of Courtly Road 18 and County Road 53. For the record, my training program has been the same since April 21,2004 to date. My road training trucks leave my yard at approximately 7:30 A.M. and return approximately 12:00 PM (noon time) Once again, they leave the training yard approximately 12:30 P.M. Ramming to the yard approximately 5:00P.M. Monday thronah Friday. We do follow the proper route to 1-76 to continue the training. We are not coming and going all day long like Mr. Ries says. I have included pictures of road 18 in which all types of vehicles have been photographed. Cars, Trucks, Tractor -trailers, Farm Implement Equipment, and Sheriff Cam, there are many truck -driving schools that bring their trucks up and down road 18, that are not required to follow procedures under Development Standard 7. Mr. Ries must be mistaking all of these other vehicles that use this road. Mr. Ries might want to invest in a pair of glasses. These cameras will give me a video record of all vehicles using WCR 18 every time a vehicle goes by, will be photographed with the date and time. This will give us all a valid record that Mr. Rtes is lying. I am also including previous letters that I have received tom the DEPARTMENT OF PLANNING SERVICES. Which shows Mr. Ries files this complaint every year. The true reason for the complaint is, Mr. Ries thinks I should apply dust suppression chemicals on all WCR 18 and WCR53 which my trucks travel on. I am also including a copy of the agreement entered between. CAREERS WORT!) Mr Ries's home address is WCR. 18 and does not require me to put any dust suppression chemicals on WCR. 53. Mr Ries does not have a home address on WCR. 53. This can be verified through your records. The list being generated upon his interpretation of pertinent documents listed below. 1. Mr. Tweedy should have no more than 4 trucks on site. A. He cites Doc.# 2004-1070 Dev. Standard #7 My response: The standard says "four in/out trips per day." , not trucks. 2. Dust control should be applied 300 feet in front of his house in each direction from the intersection of WCR 18 & 53. A. He cites Doc. # 2004-2342 pg.1 Sec.3.b. My response: The document says "300 feet in front of the existing homes". 3. Existing and Future homes should be treated for dust control. A. He cites Doc. #2004-1070 pg.2 Sec.2.d. My response: See my response to # 2 above, citing Doc.#2004-2342. Another document that he referenced was the Hearing Certificate - Doc. #2004-1084. Needless to say, he did not share my interpretation of the documents and will continue to press his case forward. There are about 8 semi -trucks on the property, some of which, were engaged in various modes of parking and backing up. Drivers in training, I assume. This time period does not coincide with the times (7:30 a.m. & 11:30 a.m.) Mr. Tweedy indicated as times when trucks would be entering or leaving the site. Perhaps this helps to validate the times he indicated as times of travel. We'll compare notes after you complete your observations today. Page 1 0 The Denver Post Trucker: School a safety risk Ex -teacher says others violated requirements for license testing By David Olinger and Michael Riley Denver Post Staff Writers Monday, February 14, 2005 - A former instructor at a Colorado truck -driving school said he watched his employer repeatedly violate requiremen for commercial licenses and believes the company also falsified tax reports. The instructor, Brian Wheeler, said he decided to speak out about the school, Careers World Wide, because he thinks its practices threaten highway safety. "I think it's creating a lot of risk to public safety. These vehicles are deadly - 80,000 pounds. You can kill somebod in a heartbeat," he said. Careers World Wide is facing federal and state scrutiny as part of a multiagency investigation of alleged driver's license sales in Colorado. Although the company has not been charged with a crime, federal agents are investigating whether its employees passed drivers who did not complete required tests, people familiar with the investigation said. The company's testing privileges have been suspended. Under Colorado law, individuals and private companies can be certified to give road tests to drivers seeking passenger -car and commercial -truck driver's licenses. Careers World Wide is such a "third -party" tester. According to an investigator's affidavit filed in federal court, 27 ineligible drivers approved at Careers World Wide were later responsible "for approximately 199 serious traffic and regulatory violations," including 26 accidents. Wheeler said he taught trucking students at Careers World Wide from 2003 until he quit last year after seeing things "that I did not want to be part of any more." During that time, Wheeler said he often saw Careers World Wide testers - including the school's owner, Charles Tweedy, and its education director, Tony Garcia - award passing grades without requiring drivers to perform some portions of the test. Some of these people, Wheeler said, were incapable of driving large trucks. Wheeler also said he was concerned about the amount of business at Careers World Wide that was done in cash. F said he also was given a W-2 income tax statement for 2003 that reported a third of his real income and therefore believes the company forwarded less money than required for tax and Social Security payments. Located at his home, Tweedy declined to comment. Reached by phone, Garcia also declined comment. Other company employees have denied wrongdoing, saying the school does not pass unqualified drivers. Before driving a tractor -trailer, an applicant for a commercial driver's license must adequately inspect the truck, perform a series of backing maneuvers and demonstrate driving skill in a road test. If Garcia was busy, he would pass students "according to what they had done the previous day or two during training and never officially tested them," Wheeler said. "I saw that 20, 30, 40 times." As an instructor at the school, Wheeler said he did not witness what happened during the highway portions of the test. But he remembers a cold, icy day when one of his students got a driving certificate from Tweedy without taking a truck on the road. "I asked him, 'How'd you do?' He said, 'I didn't go out,"' Wheeler recalled. Meanwhile, "Charlie (Tweedy) was fillinc out the state paperwork. But there were others, he said, who "had no more right getting a CDL than anybody walking off the street." Garcia passed one man "who could not back a truck up for anything. Period," Wheeler said. And Tweedy passed a woman from Texas who was about 60 years old, even though "she couldn't shift a gear after three weeks." Wheeler said he didn't know what became of those drivers. But "this is a very deadly job," he said. "You don't just give a license to someone who can't drive a truck." Two other former Careers World Wide instructors have raised concerns about the school's operation. One of them, Forrest Tyler, said he saw company testers pass several drivers without completing the detailed skills tests require for a license. Charles Stanford, another former instructor, said he never saw a company tester cheat on a road test but was surprised that some of his poorer students received licenses. As an instructor, Wheeler said he also grew concerned about the volume of business he saw conducted in cash at Careers World Wide and what he believed was its improper reporting of his own income. For 2003, he said, Tweedy gave him three identical sets of W-2 forms, each showing he earned only $7,200. He said Tweedy then took him, Garcia and another employee into his office, closed the door and said "File one." Wheeler filed all three, paying taxes on $21,600, which is what he said he really earned in 2003. Wheeler and his wife, Lisa, said they were later notified by the Social Security Administration that benefits were accrued on only $7,200 in income. Christie Prewitt, the Wheelers' tax preparer, confirmed that Wheeler paid taxes on the combined income from thre identical W -2s. Prewitt said she had never seen another employer produce three sets of W -2s for the same employee. "And I've been doing this for 17 years now," she said. Wheeler said that after he confronted Tweedy about the matter, Tweedy gave him a letter stating that Wheeler ha been paid the extra $14,206 for repair work. Wheeler said he only taught for Careers and never did repair work. Tweedy once offered to pay him under the table to work Saturdays, he said, and many of the drivers paying $100 for a truck license test brought cash. Wheeler has returned to truck driving and delivers King Soopers produce. He said he has not been contacted by state or federal investigators looking at Careers World Wide. The state Division of Motor Vehicles suspended testing privileges at Careers World Wide last month after finding test certificates for seven drivers bearing the same, supposedly unique, control number. The affidavit filed in court as part of the ongoing federal investigation said 134 people who passed tests at Careers World Wide got their learner's permits from Janet Gonzalez, a former DMV employee accused of selling commercia driver's licenses. The investigator said 27 people used false names, birth dates or Social Security numbers or othe misinformation to get those licenses. Careers World Wide tested not only its own students but many others who paid the $100 fee for the skill test required for a commercial license. The business generated "a tremendous amount of cash. It's all $20, $50, $100 bills," Wheeler said. According to state records, Careers World Wide, now based in rural Weld County, was testing more commercial - license applicants than any other site in Colorado before its suspension. By David Olinger Denver Post Staff Writer The state has dropped a charge that a Colorado truck- ing company authorized sev- en fraudulent commercial li- censes but contends the com- pany's negligence allowed someone to misuse driving test completion forms. At a hearing Friday, Careers World Wide tester Tony Gar- cia testified that someone forged his signature on seven forms used to procure truck driver's licenses. He presented forms with his handwriting to a state hearing officer for comparison. "This is not my handwrit- ing." he said. "Not even close." How those forms — certify- ing passage of a truck driving skills test — were obtained and fraudulently altered re- mained a mystery. The forms in question are used by driving schools to cer- tify that students have passed tests showing they under- stand how to operate big trucks safely. The state sus- pended Careers World Wide's testing privileges last month, citing misuse of the forms. The suspension followed news reports of a federal crimi- nal investigation into illegal sales of truck driver's licenses by state Division of Motor Ve- hicles employees, including some to truckers tested at Ca- reers World Wide. Simpson, P.E. State Engineer I have received your phone message stating your concerns regarding the second sentence of condition of approval no. 5 on permit no. 252773. That sentence states, "(w)ater from this well shall not be used for lawn or landscape irrigation or for any other purpose outside the business building structure." You have requested clarification of that sentence. The intent of that sentence is to state that one condition of approval for this permit is that the water from the well may not be used for outside purposes. It is not the intent of that condition of approval on this permit to limit the use to just one building. I understand that the well will be used for commercial purposes in the business structure and for residential uses in a separate domestic dwelling, all on one property. The use of the well in these two structures is consistent with the intent of all conditions of approval on the permit no. 252773, including condition of approval no. 5. Please note that, as stated on the permit, the well may be used for drinking and sanitary purposes only with absolutely no water used outside the residence or the building structure and the well is limited to 15 GPM pumping and an annual withdrawal of 1/3 acre-foot. Just write something along the lines of that you have already contacted the Corps of Engineers and they have determined that if any work associated with this project requires the placement of dredged or fill material, and any excavation associated with a dredged or fill project, either temporary or permanent, in waters of the United States at this site, the Corps of Engineers will be notified by a for the appropriate permits.
