HomeMy WebLinkAbout20092735.tiffRESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST LATIMER AND NANCY BOHLING FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Latimer and Nancy Bohling, ZCV #0900013, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 20th day of October, 2009, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Dawn Thurston, representative for the property owners, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until November 20, 2009, to allow adequate time for the property owners to apply for a Use by Special Review permit in order to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. See pictures dated 01/23/09. Upon a visual inspection of the property, the following items were noted: several semi trailers, commercial vehicles, derelict vehicles, truck beds, wood, tires and miscellaneous debris. Still appears that several vehicles are lined up in front of what appears to be an office. Stick built house and a mobile home. See pictures dated 09/09/09. Wendi Inloes, Kim Ogle, Nancy Bohling, her daughter (Dawn 303-818-8541) and I met at the Greeley Planning Office where we discussed how to bring the property into compliance. (1.) Since they indicated no one is living in the stick built house and Nancy has since moved into the modular, Wendi gave them an option of coverting the modular home into the Principle Dwelling Unit, until they are ready to move back into the stick built house. (.2) We then discussed the commercial business - construction. She said the office is on the property and the equipment (when not in use) is stored on the property or if the equipment needs repaired it comes to the property to be repaired. They were again advised that a USR would be required for this activity. They indicated that they do intend to proceed with a USR, just that currently it is financially difficult. We discussed the October Violation hearings where they could request some additional time from the BOCC. (.3) We discussed the NCJY both by the barn structure and further West - I noted pick-up truck beds and a large pile of tires. They were going to check this out and get back in touch with me. Again I advised them that this would be expected to be completed within whatever time the BOCC approved. I handed Nancy the Violation Hearing Notice for the October Violation Hearings. She was only missing the signatures, a written description of what they were wanting to do and the surrounding property owner list. Wendi printed out the surrounding property owner list. We purchased this property in November of 1990. To start with we moved my mother out here and replaced the modular on the property so that we could take care of her. She passed away in June of 2008 at the age of 89. We have made quite a few improvements to the property in the last 19 years. From Hwy 85 you can not see that this is anything more that a residence, there are so many trees. There is approximately 3 500 lineal feet of white picket fencing around the two front yards. The 1905 4000 sq ft Victorian has 14000 sq ft of yard with a sprinkler system. There is a well for this house and sprinkler system. There is a five stall equipment shed that we enclosed for a garage beside this home. The modular has 46000 sq ft of grass with a sprinkler system. The well for this home services the sprinkler system and the cattle waterer in the pens also. We have a small herd of cattle, about 50 head. We also have chickens for their eggs. There was a three stall garage built adjacent to this home. One stall was an office for our business. The garage is attached to the modular by a deck. The entrances and center area to the farm have been asphalted because of the mud problem. It was too dangerous for my mother to walk between the buildings prior to having this done. In the years since 1990 my husband's business has grown. He is a frame & trim contractor for residential home building. There is now a pole barn that is used for storage of the classic cars and the garage next to the modular has been converted into an office with heat, air and electricity. The pole barn has five bays three have electricity only; two bays are insulated, with heat and air conditioning in addition to the electricity. These two bays are for maintenance of the cars and trucks that my husband and oldest son restore as a hobby. They restore and rebuild antique cars and trucks. The old office portion is now storage for my library of paperback books. I have been collection these for over 50 years. We laid a floor over where they used to milk so it is flat and put my mother's wood working machines. So that is a woodshop, for doing hobby work. At the very back we have a small paint booth that is used about 15 days a year, when we paint one of the cars that they have been restoring. The employees that work at the office on the farm arc me, my husband, one daughter, one grand -daughter, one son and our boom truck driver. The sub contractors work on the job sites and are contacted by phone. My husband and son visit the job sites daily. From Hwy 85 you can not see that this is anything more that a residence, there are so many tees. There is approximately 3500 lineal feet of white picket fencing around the two front yards. The 1905 4000 sq ft Victorian has 14000 sq ft of yard with a sprinkler system. There is a well for this house and sprinkler system. There is a five stall equipment shed that we enclosed for a garage beside this home. The modular has 46000 sq ft of grass with a sprinkler system. The well for this home services the sprinkler system and the cattle waterer in the pens also. We have a small herd of cattle, about 50 head. We also have chickens for their eggs. There was a three stall garage built adjacent to this home. One stall was an office for our business. The garage is attached to the modular by a deck. The entrances and center area to the farm have been asphalted because of the mud problem. It was too dangerous for my mother to walk between the buildings prior to having this done. In the years since 1990 my husband's business has grown. He is a frame & trim contractor for residential home building. There is now a pole barn that is used for storage of the classic cars and the garage next to the modular has been converted into an office with heat, air and electricity.
