HomeMy WebLinkAbout20090196RESOLUTION RE: APPROVE E911 EMERGENCY TELEPHONE SERVICE SURCHARGE IN AN AMOUNT OF SEVENTY CENTS ($.70) WHEREAS, pursuant to an Intergovernmental Agreement among various Weld County jurisdictions, dated November 4, 1987, the Weld County 911 Emergency Telephone Service Authority Board was established and vested with the authority of administering the affairs to the E911 system, and WHEREAS, on May 26, 1981, House Bill 1240 was passed and accepted into law. This bill allowed for the cost of implementing an E911 system, and WHEREAS, in 1987, the Weld County 911 Emergency Telephone Service Authority Board imposed a surcharge in an amount of fifty ($.50) cents, and WHEREAS, it is the intent of the Weld County 911 Emergency Telephone Service Authority Board to enhance the capabilities and expansions of service to the existing services, and WHEREAS, the Weld County 911 Emergency Telephone Service Authority Board has the authority to increase the tariff rate to seventy ($.70) cents without Public Utility Commission approval, and WHEREAS, the Weld County 911 Emergency Telephone Service Authority Board deems it advisable that an increase in surcharge from fifty ($.50) to seventy ($.70) cents is in the best interest of the citizens of the County of Weld. NOW, THEREFORE BE IT ORDAINED by the Weld County 911 Emergency Telephone Service Authority Board that: Section 1. Section 2. There is hereby imposed, pursuant to Section 29-11-101, C.R.S., et seq., upon all telephone exchange access facilities, including wireless providers, within Weld County, an increase of the tariff rate from fifty ($.50) cents to seventy ($.70) cents, effective January 1, 2009. Telephone service suppliers, including wireless providers, providing telephone service in the County of Weld are hereby authorized to modify the surcharge from fifty ($.50) cents to seventy ($.70) cents imposed by this Resolution, in accordance with Section 29-11-101, C.R.S., et. seq., effective January 1, 2009, and to provide those funds to the Weld County 911 Emergency Telephone Service Authority Board. Section 3. ROLL CALL: The meeting was called to order by Chairperson Juan Cruz. Present were Board Members David Montgomery, Gary Sandau, Juan Cruz, Margie Martinez, , Ron Grannis, Bill Jerke; and staff members Mike Savage, Dave Mathis, Julie Walde, Mark Patterson and Peggy Turner. Minutes: Rod Deroo moved to approve the minutes of the May 20, 2008; seconded by Gary Sandau. Minutes were unanimously approved. OLD BUSINESS: 1. Staff Report: Dave Mathis handed out the Dispatch stats for May [refer to Sgt. Mathis' "May, 2008 WCRCC Monthly Report"]. 2. Staff Report: Don Warden, Weld County Finance Director/Administrator reported on the reasons supporting the Proposed E-911 Rate Increase. • Growth is the main reason for the twenty cent increase • Increase will provide projected funds of $591,956 • Funds will provide 3 dispatchers and one computer technician • Increase will start on January 1, 2009 • Notice for Public hearing published in the Greeley Tribune • All land line and wireless service companies must be notified by September 1, 2008 NEW BUSINESS: C 1. Juan Cruz opened the hearing to the public for comments. • Jerry Garner, Greeley Chief of Police, spoke in favor of the increase. • Warren Jones, Fire Chief of Evans, spoke in favor of the increase. He stated the current number of dispatchers cannot provide the level of service needed. • Doug Forsman, Fire Chief of Greeley, spoke in favor of the increase. • Since there were no further comments for or against the increase Juan Cruz closed the public hearing session and turned to the Board for their comments. 2. Board Discussion and Disposition of Rate Increase • Bill Jerke spoke in favor of the increase stating it was highly needed for adding staff and it is only a nominal charge per line. • David Montgomery moved, seconded by Ron Deroo, to approve the E-911 rate increase of .20 cents per land and wireless line. • Juan Cruz called for a vote. Motion was unanimously approved. 3. Treasurer Report: Margie Martinez presented the May, 2008 Treasurer Report [refer to Margie Martinez's "June 17, 2008 Treasurer Report"]. Bill Jerke moved, seconded by , to approve the report. Report was unanimously approved. 4. Margie Martinez advised the current balance in the E-911 account is $4,080,887.33. 5. David Mathis requested the Board to approve two additional call positions at the cost of $125,000. David advised his department is understaffed by 2 call positions and it would be more economical to add the 2 lines now to the new system than to wait. The money to fund this is expected to be available in the budget due to a surplus amount on the Quest account. The funds will be transferred from phone operations to capital expense. moved, seconded by Ron Grannis, to approve the request to add two additional call positions. Motion was unanimously approved. As there was no further business, the meeting was adjourned. The next meeting will be Tuesday, July 15, 2008. The notification included the letter drafted by your office and signed by the E911 Board Chairman, Juan Cruz; a copy of the June 17, 2008 E91 I Board meeting minutes at which the rate increased passed; a copy of the public notice; and a copy of the increase resolution. This bill allowed for the cost of implementing an E911 system, and on November 4, 1987, Weld County and its jurisdictions entered into an Intergovernmental Agreement to establish the Weld County 911 Emergency Telephone Service Authority Board. The November 4, 1987 Resolution and accompanying Intergovernmental Agreement also authorized the Weld County 911 Emergency Telephone Service Authority Board to impose a surcharge in an amount of fifty cents ($.50) per month on each telephone service subscriber's bill. This surcharge has been in effect since that time. On June 17, 2008, the Weld County 911 Emergency Telephone Service Authority Board met to discuss an increase in the surcharge. After consideration, the Board voted to pass the attached resolution increasing the surcharge from fifty cents ($.50) to seventy cents ($.70). In addition, the resolution authorizes service suppliers, such as your firm, to collect the emergency telephone charges. The Board found it is in the best interest of the citizens of Weld County to enhance the capabilities of the existing E911 services. The Weld County 911 Emergency Telephone Service Authority Board has the authority to increase the tariff rate to seventy cents ($.70) without Public Utility Commission approval. Pursuant to Section 29-11-101, C.R.S., et seq., all telephone exchange access facilities, including wireless providers, within Weld County will collect a seventy cent ($.70) monthly charge effective January 1, 2009 on all phone users, including user of cellular phones. It is our understanding that these documents must be on file with you prior to September 1, 2008 in order for you to collect the emergency telephone charges effective January 1, 2009. This correspondence should serve as the letter of authorization, together with the attached resolution authorizing the levying of a seventy cent ($.70) per month fee on all telephones, including cellular phones, within Weld County for the purposes of creating and maintaining an emergency telephone service system.
