RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION
ZCV #0800231 AGAINST ENRIQUE GONZALEZ FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Enrique Gonzalez, ZCV #0800231, is allegedly in violation of the Weld County
Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 13th day of January, 2009, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Enrique Gonzalez was not present or represented at said hearing, although
all parties were notified of said hearing by Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
named above to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with
legal action against Enrique Gonzalez to remedy the violation of the Weld County Code, and any
other persons occupying the properties, any persons claiming an interest in the properties, and any
persons acting in active concert with the identified parties.

adoption of any regulations controlling subdivision. PUD development proposals shall not
be permitted to use the special review permit process to develop.
REMEDY
As we have previously discussed, the presence of more than 1 COMMERCIAL VEHICLE for ANY
period of time (a delivery style box truck and a semi truck and trailer) is a direct violation of Weld
County Code and your existing ZPCV-0006. Continual violations of this nature can vacate your
existing permit, thus not allowing you to park even 1 (one) Commercial Vehicle on the property. On 3
(three) separate occassions I have witnessed 2 (two) Commercial Vehicles situated on this property at
the same time (08/20/08, 09/26/08 & 11/12/08). In order to maintain more than 1 (one) Commercial
Vehicle a Use by Special Review Permit is required. I don't believe this is a process that would be
benaficial as it it much more costly than the Zoning Permit for a Commercial Vehicle, but if this is an
avenue that you are interested in, the first step is to complete and submit the Pre -Application Request
form which I included in my previous letter.

This hearing will take place in the County Commissioners Hearing Room, first floor, Weld County
Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a
representative be in attendance to answer any questions the Board of County Commissioners
might have about the violations.
Please also be advised that I will be taking video and/or pictures from the road or adjacent
properties the business day before or as soon as possible to the above mentioned Violation
Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the
violation. Our records indicate that you were made aware of the nature of the violation including
the action necessary to correct the violation, and that you were given sufficient time to remedy

PRE -APPLICATION REVIEW REQUEST
The pre -application request is the preliminary review of a land use proposal. Pre -application reviews are required
prior to beginning the application process; however, this review is not an application.
Pre -application reviews are held with the Weld County Departments of Public Works and the Public Health and
and Environment. The second and fourth Friday of any given month pre -applicant reviews are held in the
Southwest Service Center office at 10:30 a.m., 11:30 a.m., 1:00 p.m., 2:00 p.m. and 3:00 p.m. Pre -Application
reviews are held Thursday of any given week in the Greeley office. To be on the pre -submittal agenda, the request
and required checklist items must be received one week prior to the review date, and shall include at a minimum, a
description of the property including surrounding lands and land uses, property owners name and contact
information, a brief narrative and a map delineating the property location, in addition to the other items listed.
