RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST ROSWELL AND KERRY CHECKETTS FOR VIOLATION OF THE
WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Roswell and Kerry Checketts, ZCV #0900247, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 8th day of December, 2009, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Roswell and Kerry Checketts, property owners, were present at said hearing,
and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until February 8, 2010, in order to allow adequate time for the property owners to
submit an application for a Use by Special Review permit.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV #0900247 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Roswell and Kerry Checketts to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an interest
in the properties, and any persons acting in active concert with the identified parties, with an
instruction for delay of action upon such referral until February 8, 2010, in order to allow adequate
time for the property owners to submit an application for a Use by Special Review permit.

I just received a call from the Lynn Orr (owner) @ 21480-WCR 43.284-6214. It was the woman who lives at
that address who called.
She is saying that a CAFO (that she says is a dairy) just to her north that is owned by a Roswell Checketts
(21506 WCR 43) is expanding. This is parcel # 105515200067. She said that she thought that he had all the
animals that he was allowed to have, but he is building new equipment to handle even more "head". She is
reporting that already the problems exist with flies, truck dust and dirt, and damage to her property when
vehicles' drivers associated with the dairy are careless and not paying attention.
Per Lauren Light there is no USR for this operation.
Is there anything that a county code compliance officer can do to assist the complainant with these problems?
Does this fellow need a USR? Does this fellow need to pay attention to the # of animals that are placed on his
property? Does this fellow need closer attention from "us"?
She has indicated that she wishes to remain anonymous.
Let me know what you decide so I can know what we need to do with environmental complaints (some of his
stuff passing off site may be protected {exempt} from regulations).
