Board of Assessment Appeals: You have the right to appeal the County Board of Equalization's (CBOE's) decision to the Board of Assessment Appeals (BAA). Such hearing is the final hearing at which testimony, exhibits, or any other evidence may be introduced. If the decision of the BAA is further appealed to the Court of Appeals only the record created at the BAA hearing shall be the basis for the Court's decision. No new evidence can be introduced at the Court of Appeals. (Section 39-8-108(10), C.R.S.) (Section 39-8-108.5, C.R.S.) Selecting the Arbitrator: In order to pursue arbitration, you must notify the CBOE of your intent. You and the OBOE select an arbitrator from the official list of qualified people. If you cannot agree on an arbitrator, the District Court of the county in which the property is located will make the selection. Arbitration Hearing Procedure: Arbitration hearings are held within sixty days from the date the arbitrator is selected. Both you and the OBOE are entitled to participate. The hearings are informal. The arbitrator has the authority to issue subpoenas for witnesses, books, records, documents and other evidence. O. Box 758 Greeley, Co. 80632 Subject: 2009 Property Taxes Received 2009 Property valuation . The value of our home increased from $475,000 to $645,932. An increase of $170,932 or 36%. Couldn't believe what Weld County was doing iti a recession and down economy. Requested a appeal with the Appraiser. This meeting was set up May 14, 2009. In this meeting we prepared a package for her to review (attached). Appraiser was not prepared to answer our question on why the valuation increased so drastically. When we gave her our appraisal value, she stated that there was no way that it would be reduced to that amount. We had a hard time understanding where she was coming from, since she couldn't tell us why they went up so much, but could tell us right away that they wouldn't go down. In our meeting we had to keep trying to bring her back to our taxes and why they should be going down, instead of social chit chat. After forty five minutes we were finally able to provide all of our documentation. This could had been done within fifteen minutes, especially since she wasn't prepared to tell us why and how the valuation went up. We had provided three comps for her to review and right away she said that they were not good and she would need to find upgraded comps. Reminded her that we live in Milliken, which is a depressed area and all taxes were going down per Chis Woodruff (County Assessor) in a statement to the Greeley Tribune. We advised her that we do not live on a Golf course at Pelican Lakes (Windsor) or Marianna Buttes (Loveland). She then advised us that we do live on a Jack Nicklaus Golf course. My wife and I could not believe this and told her how it was really developed. Told her there was an article about the Mad Russian in Golf Digest on how and when it was developed. When we left this meeting all we said was be fair to us and make sure the comps were in the Milliken area, where we could compare Apples to Apples. Received my new evaluation on June 30, 2009 (mailed June 28, 2009) and it still had been increased by $44,433 or 10%. Left Appraiser a phone message on July 1, 2009 requesting the new comps. Did not hear back from her and since I was going to be in Greeley that thy I dropped off a letter requesting the new comps. She called me back July 2, 2009 and left message that she could do them over the phone, but would be leaving her office by 10:00 that day. Called her back after I got the message and said it would be okay to get them from her over the phone, but also wanted them in writing. J Oa. We finally got together via phone on July 6, 2009 and she e -mailed me the comps street addresses, but not the city. Had to call her back to get the locations. Couldn't believe she used two in Mead, one in Berthoud, one in Johnstown, and two in Milliken, which one of the Milliken's comp was one I gave her that she said was not any good to compare. We will go into some particulars on our house and area. One bedroom and one and a half bathrooms on main level. Two bedrooms downstairs with a Jack and Jill bathroom and half bathroom. This all be on file with the county with our blueprints of the house. Live in sub -division on the Mad -Russian Golf Course, which within the development the third phase has homes on the Golf course. Everyone we have talked to that live in the third phase on the golf course, their property taxes have been lowered for 2009. We do have an upgraded house, but as everyone knows if lower priced housing is within the same development it tends to lower the upgraded homes. As any Realtor can tell you it's "location, location, location". We do now live in a depressed area. We have attached the new comps that the appraiser provided and we will write comments on each one. Also providing one more that is located 3500 Mill Iron Court in Mill Iron Estates (comp#7), since she is using two from that development. This one sold on June 30, 2008 for 395,000, and would be within our area. We are trying to be fair with Weld County and revised our value to $440,000 instead of the $418,000 based on Chris Woodruff comments that the average price in Weld County dropped eight percent, even though for zip code 80543 the valuation has gone down forty percent. This week, homeowners are receiving letters from the Weld County Assessor's Office, and most of them are earning that the assessed value of their property is down. The valuation of about 84 percent of the residential properties in Weld decreased in the latest reappraisal of roperties, accordi to We Some of the areas with notable decreases were in east and north Greeley, Evans and Milliken, Woodruff said. He also noted that neighborhoods with more foreclosures during the appraisal time period — all of 2007 and the first half of 2008 -- saw bigger declines. On the other hand, the valuations of about 15 percent of residential properties in Weld increased. Many of these homes were in Windsor, west Greeley and parts of southwest Weld. Countywide, overall residential property valuations dropped about 8 percent_ Woodruff, who has been in the industry for about 30 years, said he has never seen property valuations drop to this degree before. Then again, he said, the number of foreclosures in Weld during the reappraisal period was unprecedented, as well. The valuations were based on the prices of properties that were sold during that time period. The statements property owners are receiving this week are just the beginning of the process that determines how much they will pay in property taxes, Woodruff said. Those who want to protest their valuations can do so through June 1. Once the value of property has been established, local taxing districts apply the value to determine mill levies, which is the tax rate. The various levies are added to determine the total tax bill against any particular property, and the county treasurer collects that amount and distributes it to the taxing jurisdictions. Taxing districts within Weld include schools, fire protection districts, water and sewer districts, recreation districts, cities and towns, library districts, county government and special districts. A full picture of the county's valuations will be clearer by Aug. 25 when a preliminary certification of valuation is completed. Then, Woodruff said, officials will know how the lower property values will affect government revenues. The big question that remains, though, is whether revenues from oil and gas property taxes could make up enough of the shortfall of the residential valuations. Woodruff said oil and gas property taxes typically make up about 40 percent of the tax base in Weld. He anticipates that oil and gas values will fill the void this time, but the official valuation on that segment of the county's valuation portfolio won't be completed until June 15. "What we are concerned about is what's going to happen in 2011," he said, adding that oil and gas production stowed after the reappraisal time period. That stump will be accounted for in next year's valuation. HOW ARE RESIDENTIAL PROPERTY APPRAISALS FIGURED? The Weld County Assessor's Office used sales data and other market information that occurred between Jan. 2007 and June 30, 2008 to configure the latest round of valuations. The latest valuations will apply to taxes payable in 2010 and 2011. WHAT'S UP AND WHAT'S DOWN There are several categories of property that are assessed by the Weld County Assessor's Office. Here's a look at some of the categories that saw increased values and decreased values in the latest reappraisal: Down: Vacant land. The valuation of several properties were affected by halted development. Up: Industrial property. This is the first year the county has been able to assess a full valuation for Vestas in Windsor. Up: Agricultural property. Up a bit, but agricultural property values are not based on market values. Down: Residential property. Foreclosures during the assessment time period had an impact on the lower values. This hearing will be held at the Weld County Centennial Center, First Floor Hearing Room, 915 10th Street, Greeley, Colorado. You have a right to attend this hearing and present evidence in support of your petition. The Weld County Assessor or his designee will be present.
