RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 430 - JAKE HAFFNER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Com- missioners of Weld County, Colorado, at a public hearing held on the 26th day of November, 1979 in the Chambers of the Board of County Commissioners of Weld County, Colorado, that the division into two parcels of land, as shown on the plat known as Recorded Exemption No. 430, being the property of Jake Haffner, described as the Southwest Quarter of Section 25, Township 1 North, Range 65 West of the 6th P.M. , Weld County, Colorado, being more parti- cularly described as follows: The Southwest Quarter of Section 25, Town- ship 1 North, Range 65 West of the 6th P.M. , Weld County, Colorado. The parcel of land on which this request has been made is described as the SW-31 Section 25, T1N, R65W of the 6th P.M. , Weld County, Colorado. This property is located 1 mile east and 3-1/2 miles south of Hudson. The property con- tains approximately 160 acres of Class II , III and IV irrigated soils. The request is to split the property into parcels of 4. 95 acres and 155. 05 acres. Mr. Haffner desires to retain the 4. 95 acre parcel which has his resi- dence and other improvements located on it and sell the 155. 05 acre parcel as an agricultural unit . Mr. Haffner has submitted a letter of explanation with his application which sets forth his reasons for making this request. Based upon the information submitted and the adopted policies in the County, the Department of Planning Services Staff recommends the re- quest be approved for the following reasons: 1. The request is consistent with the intent clause of the recorded exemption procedure, the intent clause of the Agricultural Zone District, and the Weld County Comprehensive Plan in that the use would be compatible with the surrounding agricultural land uses. The request will not exceed the residential density which is currently available to the property because of the minimum lot size for irrigated property.
