To Whom It May Concern,
Per CRS 31-12-108 (2), your agency is required to obtain a copy of the published notice,
resolution, and petition (not applicable for the annexation of county roadways) for the annexation
of portions of Weld County Roads 4, 6 and 27.
It should be noted that the public hearing was originally scheduled for Tuesday, February 3,
2009; however, the city clerk's office missed the publication deadline. Therefore, city staff will
be requesting the meeting be moved to Tuesday, February 17, 2009 in order to meet the
publication requirements as set forth in CRS 31-12-108 (2).

COLORADO STATING THE INTENT OF THE CITY OF BRIGHTON TO
ANNEX CERTAIN PROPERTY AND INITIATING ANNEXATION
PROCEEDINGS FOR SUCH PROPERTY; AND SETTING A PUBLIC HEARING
FOR FEBRUARY 3RD, 2008 TO DETERMINE IF THE PROPOSED
ANNEXATION•OF PORTIONS OF ROADWAYS KNOWN AS WELD.COUNTY
• ROAD 27, WELD COUNTY ROAD.4, AND WELD COUNTY ROAD 6,
.COMPLIES WITH STATUTORY REQUIREMENTS FOR SUCH
ANNEXATION.
RESOLUTION NO. 08-164
WHEREAS, pursuant to the laws of the State of Colorado, the City of Brighton and the
County Commissioners,of the County of Weld have agreed that it would be in the public interest
for the City to initiate annexation proceedings of certain roadways located in territory situated,
lying, and being in the County of Weld, State of Colorado, more particularly described in Exhibit
"A" attached hereto; and
WHEREAS, the City and the County have agreed that annexation proceedings should be
initiated based on the following:
A) The County is the 100% owner of the territory proposed to be annexed;
B) If the territory described in Exhibit A is eligible for annexation and is not
otherwise limited by statute as determined following a public hearing to consider the same, the
annexation of the entire territory shall be accomplished by sequential annexation ordinances of
portions of the territory, each being not less than one -sixth (1/6th) contiguous with the boundary
of the City;
C) It is desirable and necessary that the territory described in Exhibit A be annexed
to the City;
D) A community of interest exists between. the territory proposed to be annexed and
the City;
E) The roadways proposed to be annexed will be urbanized in the near future, and at
such time will be integrated into the City; and
F) The County has acknowledged and agreed that should the annexation of the
roadway described in Exhibit A be approved, the annexed territory will be divided from the
county roadways located beyond the annexed territory.
WHEREAS, the City Council has determined that it is in the best interests of the citizens
of the City to initiate the annexation of said territory to the City; and
WHEREAS, the City Council desires to initiate the annexation of the territory by the
adoption of this resolution setting forth its findings and setting a public hearing at least thirty
(30) days and no more than sixty (60) days after the effective date of the Resolution, to

determine if the annexation meets the requirements of CRS §31-12-104, Eligibility for
Annexation, and §31-12-105, Limitations.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Brighton,
Colorado, as follows:
1. The City Council hereby finds that the agreement with Weld County for the
initiation of the annexation of the territory described in Exhibit A, attached hereto, as
outlined herein, is in substantial compliance with the requirements outlined in CRS §31-
12-107(1), and based thereon initiates the annexation of the territory as provided by
statute.
2. The City Council of the City of Brighton, Colorado will hold a public hearing for
the purpose of determining if the proposed annexation complies with Colorado Revised
Statutes Sections 31-12-104, Eligibility for Annexation and 31-12-105, Limitations, 1973,
as amended, at the following time, date, and place:
