RESOLUTION RE: APPROVAL OF LOT SIZE VARIANCE NO. 69 - SVEN JOHANSEN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners has determined at a public hearing on the 9th day of August, 1978 , in the Chambers of the Board of County Commissioners of Weld County, Colorado, that a certain tract of land is owned by Sven Johansen, which land is more particularly described as follows : The West Half of the Northwest Quarter (W1/2NW1/4) of Section Seventeen (17) , Township Five (5) North, Range Sixty-four (64) West of the Sixth (6th) Principal Meridian, Weld County, Colorado. WHEREAS, the owner of said tract of land desires to obtain a variance from the minimum lot size requirement so that said applicant may make application to the Board of County Commissioners for a recorded exemption, as set forth in Section 9-4 .A. (6) of the Subdivision Regulations, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, feels that the applicant has shown good cause for granting a lot size variance under Section 9-4 .A. (6) of the Weld County Subdivision Regulations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that a variance from lot size requirements, be and hereby is , granted to Sven Johansen for the above described parcel of land. The property on which this request has been made is described as the W2 of the NW4 of Section 17, T5N, R64W of the 6th p.m. , Weld County, Colorado. This property is located one mile northwest of the Town of Kersey. The property contains approximately 64 acres of Class II and III irrigated soils. The request is to obtain a variance from the minimum lot size requirement , Section 9-4 A. (6) , so that he can make application to apply for a recorded exemption. If this lot size variance is granted, Mr. Johansen will proceed with his application for a recorded exemption to divide the property into two parcels. Mr. Johansen wishes to sell three acres more or less which will include the existing improvements and a hog farrowing operation. The balance of the property will continue to be used for irrigated farming. Based upon the information submitted and the adopted policies in the county, the Department of Planning Services staff recommends this request be approved for the following reasons : 1. The request is in compliance with the intent clause of the Recorded Exemption Procedure (Section 9-2 of the Weld County Subdivision Reg- ulations) in that the propsed use of the property will be compatible with the surrounding agricultural uses. 2. The request is in compliance with the intent clause of the Agricultural Zone District (Section 3. 3 A. of the Weld County Zoning Resolution) and the Weld County Comprehensive Plan in that the request will be encouraging a related use to agriculture which is the predominant land use. As per his request, we are enclosing the following documents: 1. Copy of deed; 2. Rough draft of improvements to be exempted; 3. Letter from Central Weld Water District. It is my understanding that you are requesting, in this letter, a preliminary statement as to the reasons that I am requesting this recorded exemption. I have owned the subject farm for a good many years. Since my coming to the United States from Denmark, I was employed by the Great Western Sugar Company for twenty-two years as an agriculturalist. I have now retired and during my ownership of the farm, I got into a sideline venture of hog farrowing operation, that has been in existence for approximately sixteen years. I now have an opportunity to sell approximately three acres, more or less, to- gether with the hog farrowing operation. I will continue to retain the balance of the irrigated farm, but due to the trends in agriculture today, improvements of this nature are not necessary to obtain good farmers. The work load and responsibility of the hog operation have become too great for me, due to my age. These are the reasons that I am requesting this pending recorded exemption and I am wanting to sell it to a young man by the name of Randy Thoutt. He has no intention of increasing his hog farrowing operation. At your request, I have contacted the town of Kersey and a member of their city planning staff, Mr. Bashford. He assured me that there was no opposition.
