the Planning Commission hearing will be continued until April 7, 2009 at the March 3rd PC
hearing. This case is scheduled for a March 18th Board of County Commissioners hearing.

Attached is the affidavit but I am sure we have to do another one when we contact them
again to let them know the hearing has been continued to a different date. I have also

extension/continuance as we work with the neighbors and objectors.

Friday and hope to have Mr. Lemons sign the letter agreement this week. I will get a copy of the signed
agreement to you later in the week but wanted to keep you informed of our progress. We are also meeting with
Public Works tomorrow at the intersection of WCR 53 and WCR 58 to discuss the left turn lane.

RE: USR-1687 Journey Ventures, LLC — Landscape/Screening Fence Letter Agreement
Dear Mr. Lemons:
Journey Ventures, LLC will be implementing a landscape/screening fence plan to screen the
access adjacent to your east property line into the proposed Journey Ventures Pit and your
north property line that is adjacent to the pit. Per our conversations on April 7, 2009 Journey
Ventures, LLC will agree to install a solid vinyl screening fence. On Friday, April 10, 2009 the
distances of fence needed were measured by you and J.C. York with J&T Consulting, Inc. 573
feet of six (6) foot and 98 feet of three (3) foot tall vinyl screening (solid) fence manufactured by
EXACT Fencing per the attached product detail sheets will be installed. The fence details and
location will be included with our landscape/screening fence plan that will be submitted to Weld
County as part of our USR 1687 permit. The fence will be located on your property as discussed
and the fence will be installed prior to mining. After the fence is installed you will assume all
maintenance and repair of the fence.

I left you a phone message earlier regarding Condition of Approval #1.A, which is Prior to the BOCC hearing.
Does it need to be removed?
Also, Condition of Approval #1.L.1 and #1.L.2 are the same as #6.A and #6.B. Should the text remain under
Prior to Recording the Plat, or Prior to Operation. I don't think they need to be listed twice. Let me know which
place they should remain.

resolutions under L. as follows:
3. The applicant and Weld County Public Works shall negotiate an agreement included within the Long -
Term Maintenance and Improvements Agreement document for the following and Weld County Public
Works shall approve all items listed below.
Safety improvements:
• Construction of adequate turning radii at the intersection of WCR 58 and WCR 53.
• Construction of acceleration and deceleration lanes at USR entrance on WCR 58.
• Construction of road improvements to WCR 58.
With the following supporting information regarding safety improvements:
Construction of adequate turning radii at the intersection of WCR 58 and WCR 53.
• CR 53 is posted at 55 mph, the 8591 percentile speed limit is 62 mph
• CR 53 has 3,780 AADT taken in April 2009, with 26% truck traffic
• CR 58 has no shoulders
Construction of acceleration and deceleration lanes at USR entrance on WCR 58.
• CR 58 is posted at 55 mph, the 85th percentile speed limit is 57 mph observed April 2009
• CR 58 has no shoulders with 18% truck traffic
• There will be 192 truck trips per day using the site access off CR 58 at full build out
Construction of road improvements to WCR 58 between the USR site and WCR 53 (approximately 1.2 miles).
• CR 58 is posted at 55 mph
• CR 58 has no shoulders, paved width is 24 feet.
• CR 58 is not designed to take the heavy gravel hauling traffic without improvements and
shoulders
• CR 58 in its existing condition will deteriorate rapidly, the edges of the roadway will slough off
creating a reduced lane width, a hazard for the traveling public

MEMORANDUM OF
SURFACE USE AGREEMENT
WI IEREAS on the day of April 8, 2009, Petroleum Development Corporation, whose address is
1775 Sherman Street, Suite 3000, Denver, Colorado 80203 hereinafter referred to as "Operator"
entered into a Surface Use Agreement (hereinafter the "Agreement") with Journey Ventures
LLC, whose address is P.O. Box 129 Greeley, Colorado 80632, hereinafter referred to as "Land
Owner," covering and affecting property with the legal description identified as the following
("Property"):
Township 5 North, Range 64 West, 6th P.M.
Section 7: Part of the SE
WHEREAS said Agreement provides for, among other things, the right to enter upon and use the
Operators' rights and lease for the purpose of mining gravel and to perform other services and
other functions described in the Agreement, and it also sets forth payment of specific amounts to
cover damages resulting thereto. The Agreement, with all of its terms, conditions, covenants and
other provisions, is referred to and incorporated into this Memorandum for all purposes.
NOW Tl IEREFORE this Memorandum is placed of record for the purpose of giving notice of
the Surface Use Agreement. Any person having the lawful right or legitimate interest therein
may examine a copy of the Surface Use Agreement in Petroleum Development Corporation's
office or in Journey Ventures LLC office during normal business hours.
