RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST SHARON ARANDA AND SUSAN MAESTAS FOR VIOLATION OF
THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Sharon Aranda and Susan Maestas, ZCV #0900283, are allegedly in violation
of the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 8th day of December, 2009, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Susan Maestas, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until January 8, 2010, in order to allow adequate time for the property owners to
submit an application for a Use by Special Review permit.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV #0900283 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Sharon Aranda and Susan Maestas to remedy the violation of the
Weld County Code, and any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties, with
an instruction for delay of action upon such referral until January 8, 2010, in order to allow
adequate time for the property owners to submit an application for a Use by Special Review permit.

REMEDY
As we have discussed the operation of Country Paws Kennel, LLC requires a Use by Special Review
(USR) permit. My records indicate a Pre -Application Request meeting was conducted on April 3, 2009 at
which point staff explained the Use by Special Review (USR) process. In order to avoid the December
Violation Hearing, I would recommend the USR application be assembled and 4 packets be submitted to
the Department of Planning Services by next week. Planning Department Staff will review your packets
and respond within 7 working days outlining any missing paperwork or necessary corrections. The
remaining packets and any other requirements as outlined in Staffs follow up 7 Day Completeness Review
memorandum and fees shall be submitted prior to the hearing in order to cancel the Violation Hearing. If
you are unable to meet this timeline, I would recommend you or a representative attend the December 8th
Violation Hearing to request additional time from the Board of County Commissioners.
RECOMMENDATION
The Department of Planning Services staff recommends that this case be forwarded to the County
Attorney's Office for immediate legal action.

November 2nd deadline date. Kim tried to forward her to
me, but she had hung up. Kim stated that she had
informed him that someone had told her she could turn it in
1 (one) item at a time. I pulled the Pre -Application minutes
which clearly explain the 7 day completeness submittal
process - not 1 (one) page at a time.
I tried to call Sue Maestas (303-857-3808) back. I was
informed she had just left to take her grandkids to school
and then she had an appointment with a vet and then a
personal doctor"s appointment. The woman indicated that
Ms. Maestas would be back in the early afternoon. She
asked if I would be available for her return call this
afternoon. I stated I would be. I gave my phone number
and direct extension.
Sue Maestas called back. She explained that Ben
Hansford is helping her out with her USR application. She
stated that she understood that she could submit 1 page at
a time. She said when she came in for the pre -app the
ladies told her not to get overwhelmed and just to take it 1
item at a time. I said that is correct, but it all needs to be
submitted at the same time. She apologized for the
mis-understanding. I explained that was fine and I as well
apologized. She said there was no way she was going to
make the November 2nd hearing date. I explained that
was not a hearing date, but simply the violation notification
deadline. I told her my next step was to schedule a
hearing, but the hearing would be until December 8, 2009
and as long as a complete application was submitted prior
to the 8th, the hearing would cancel. I explained that she
needed to try to have everything (the 4 packets) completed
by November 16, 2009 so staff could review them and she
could have enough time to gather any missing information
before the 8th. She said she would try. I re-itterated the
Planner On -Call (either via telephone or in person - I also
reminded her that the SW office had been closed). She
said she would get to work.

On Friday, April 3, 2009 an informal discussion took place at the Greeley Administrative Offices
Conference Room regarding a kennel and grooming facility. (The legal description is Lot 4,
Block 43, 2nd Aristocrat Ranchettes being in Section 27, Township 2 North, Range 66 West of
the 6th P.M.; Situs Address is 15169 Lamb Ave)
Background Information:
The applicant has 12 pug dogs and 4 cats and operates a grooming business on site. Grooming
is set by appointment only and on average may have up to 10 dogs per day.
Four employees operate the grooming facility with the step -sister helping in the office and 2
other contract laborers who come in when needed.
The grooming facility is operated in the shop.
Public Works
Access to the site is from Lamb Avenue. The applicant indicated that there are 4 parking stalls.
The parking area consists of layers of crushed asphalt and crushed concrete.
No Traffic Study is required.
No Drainage Report is required; however the applicant was directed to visit with Clay Kimmi for
further clarification.
The site is not located in a FEMA floodplain, therefore no Flood Hazard Development Permit is
required.
No Geotechnical Report is required.
Planning Department
The applicant provides a port -a -potty for the public to use. The applicant does allow clients to
use the restroom in the house if needed. The applicant was advised to talk to Lauren Light of
the Health Department for further instructions.
There is a bathtub in the shop. The bath water in the shop is released into a French Drain.
The applicant stated that the animal waste is disposed of in a dumpster located on site and then
hauled away on a regular basis. Staff indicated that they will request screening around the
dumpster.
Staff informed the applicant of the possible change of use to the shop which would require a
building permit. Associated costs with the permit include: Building Permit fees, Road Impact
Fees, and Capital Expansion fees. The applicant was advised to talk to the Building Department
for further direction and estimation of fees.
The dogs are housed at night in the mobile home. The applicant indicated that there are dog
runs along the side of her property.
Staff asked the applicant to identify on the Site Plan where the existing lighting is and a
description of the type of lighting as well.
The applicant stated that she has a current kennel license and complies with all PACFA
regulations. Staff requested the applicant to provide that information in the application packets.
Staff advised the applicant to refer to the County Assessor's office for a listing of the mineral
owners for her property. The applicant will need to provide notification to the mineral right
owners 30 days prior to a public hearing.
Staff urged the applicant to contact staff for any questions:
Planner On Call (Greeley office) Monday through Thursday 7:30 to 11:30 a.m.
Planner On Call (Longmont office) Monday through Thursday 12:30 to 4:30 p.m.
Staff explained the USR process - that the applicant shall submit 4 packets for a 7 day
completeness review. Once the 7 day completeness review is complete the applicant will be
informed of what items are still required to make the application complete. After the completed
application is submitted it will be sent out for referral for 28 days. The applicant will then meet
with their Planner to discuss the referrals and address as many of the referrals as possible. At
the meeting the Planning Commission hearing will be scheduled. The Board of County
Commissioners hearing typically follows approximately 3 weeks after the Planning Commission
hearing.

this property lead me to the Colorado Secretary of State website showing Country Paws
Kennel, LIc being operated from this property. Upon further research, my records indicate
that a Pre -Application Request meeting was held with Susan Maestas on April 3, 2009 at
which point staff explained the Use by Special Review (USR) process. However, to date, I
have been unable to locate any evidence that a Use by Special Review (USR) application
has been submitted to this office.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this violation. You have until
11/02/2009, to correct this zoning violation. Failure to do so will result in this office scheduling the
violation before the Board of County Commissioners to consider whether to refer the violation to the
County Attorney's Office for legal action.
