Home My WebLink About20093072.tiff157 RESOLUTION RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL FOR FINAL PLAT, S #381 - WEST HILL -N -PARK, INC., FOURTH FILING WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated August 30, 1995, the Board approved the application of West Hill -N -Park, Inc., Fourth Filing, on the following described real estate, to wit: Part of the SW1/4 of Section 26, Township 5 North, Range 66 West of the 6th P.M., Weld County, Colorado, and WHEREAS, on September 9, 1996, the Board of County Commissioners of Weld County, Colorado, approved an Improvements Agreement According to Policy Regarding Collateral for Improvements (Public Road Maintenance), between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and West Hill -N -Park, Inc., Fourth Filing, with terms and conditions being as stated in said agreement, and accepted Letter of Credit #141, drawn on Independent Bank, 1503 9th Avenue, Greeley, Colorado 80631, in the amount of $6,000.00, and WHEREAS, staff from the Weld County Departments of Public Works and Planning Services have conducted a visual inspection and, along with the Weld County Attorney, recommend release of said collateral. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Letter of Credit #141, drawn on Independent Bank, in the amount of $6,000.00 be, and hereby is, canceled and released. Good Luck. Collateral is s00000 fun. We have received two letters on two different cases that indicate they will not renew the letter of credit. Attached is a copy of both letters. I will also send a hard copy to you. Would you please check and see if the work is complete and if we can release these or will you see about getting a new letter if applicable. Also, please check on Mcstain Enterprises. We are holding three letters of credit - one for 92,088., one for 6,260. and one for 569,085.00 S#378. According to our records they should be reduced to 15% and held for one year. Do you agree? Have they completed the work required and if so, please notify them and get the new letters of credit so we can start closing these out. If not, we should get new letters as all have expired now. The Letters of Credit or collateral is being held as follows: McStain Enterprises, S-378: Phase III: Improvements to WCR 3.5 represents a retainage of $92, 088. This portion of WCR 3.5 has been completed and is on the Weld County road system. The collateral may be released. Phase IV and VII: A letter of credit in the amount of $569.085 is being held. The transportation improvement has been completed for more than one year. The sewer and water appear to be in place. The remainder of the required items shall be verified by Planning Services. A Letter of Credit in the amount of $6,260 was requested by Left Hand Water District and St. Vrain Sanitary Sewer District. The sewer and water appear to be in place. This item shall be verified by Planning Services. Jubiliee Acres Minor Subdivision, S-448: The Letter of Credit expired as of July 1, 1999. On March 3, 2000, a final inspection was performed, and it was determined that no repairs are needed. The $817 retainage shall be released. Please refer to the Clerk to the Board memo dated April 3, 2000. 1 West Hill -n -Park Fourth Filing, S-381: A retainage of $6,000 is being held as collateral for the installation of the irrigation system and seeding for the parks located in the third and fourth filing of West Hill -n -Park. It appears that buffalo grass or clumped grass has been seeded in the park locations. Planning Services shall verify the irrigation system through the applicant the installation of the irrigation system to service the parks.
