This amended site plan review is approved with the attached
conditions:
1. The Amended Site Plan Review Map shall be prepared in accordance with Section 23-2-
160.V of the Weld County Code. The applicant shall submit three sets of a paper copy
of the plat for preliminary approval to the Weld County Department of Planning Services.
Upon approval of the paper copy the applicant shall submit a Mylar plat along with all
other documentation required as Conditions of Approval. The Mylar plat shall be
recorded in the office of the Weld County Clerk and Recorder by Department of Planning
Services' staff within 30 days of the approval and with payment of eleven ($11.00)

2. Prior to recording the Amended Site Plan Review plat, the applicant shall address the
following to the Department of Planning Services' satisfaction:
A. The applicant shall submit evidence of a Colorado Discharge Permit System
(CDPS) from the Water Quality Control Division of the Colorado Department of
Health and Environment for any proposed discharge into State Waterways, if
applicable. Evidence of such shall be submitted in writing to the Weld County

B. The applicant shall provide the Department of Planning Services with a
completed property maintenance plan in accordance with Section 23-2-250.6.7

C. The applicant shall address the requirements (concerns) of the Weld County

2009. Evidence of such shall be submitted in writing to the Weld County

applicant may submit evidence that all the work has been completed and

The plat shall be amended to delineate the following:

1. In accordance with the Weld County Code, no land, building or structure
shall be changed in use or type of occupancy, developed, erected,
constructed, reconstructed, moved or structurally altered or operated in
the PUD Zone District until a Site Plan Review has been approved by the

2. The application does not propose any portion of the leased area of the
site to be leased to another party. In the event that a portion of the
building or lot is proposed to be leased to another party in the future, the

5. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, fugitive particulate emissions, blowing debris, and

7. This facility shall adhere to the maximum permissible noise levels allowed
in the Residential Zone as delineated in Section 14-9-30 of the Weld

8. Adequate drinking, handwashing and toilet facilities shall be provided for

9. Sewage disposal for the facility shall be by septic system. Any septic

11. All pesticides, fertilizer, and other potentially hazardous chemicals must
be stored and handled in a safe manner in accordance with production

12. If applicable, the applicant shall obtain a stormwater discharge permit
from the Colorado Department of Public Health & Environment, Water

required to adhere to the fee structure of the Weld County Road Impact

be required to adhere to the fee structure of the Capital Expansion Impact

at the time of permit application. Currently the following has been
adopted by Weld County: 2006 International Building Code; 2006
International Mechanical Code; 2006 International Plumbing Code; 2006
International Fuel Gas Code; and the 2008 National Electrical Code and

3. Upon approval by the Department of Planning Services, the Site Plan Review shall be
prepared per Section 23-2-160.V of the Weld County Code and submitted to the

4. Prior to the release of building permits:
A. A Final Site Plan and building construction plans must be submitted to the
LaSalle Fire Protection District for review and approval. The applicant shall
submit written evidence of approval to the Department of Building Inspection.

B. A plan review is required for each building for which a building permit is required.
Plans shall include a floor plan. Plans shall bear the wet stamp of a Colorado
registered architect or engineer. Two complete sets of plans are required when

C. Each building will require an engineered foundation based on a site -specific
geotechnical report or an open hole inspection performed by a Colorado

I'm so sorry that my hearing is such that I could not make out your name correctlyt. Please set
me straight.
Attached is the sign (2 required) that we propose to use in the Sports Court/Play Area that we are
planning in the water retention area adjacent to the pool and community center. Since it is a
pedestrian sign we are proposing for it to be a 12"w x 18"h sign with the yellow danger warning
symbol. Locations for placement would be (1) on the path entering the area and the other (2) on
the court fence adjacent to the main gate opening nearest the entry. (The other gate is primarily
for a quicker access to tennis balls that go over the fence and land in the play area.)
We would appreciate your professional opinion in regard to the design and verbiage of the sign as
well as the placement locations.

On Thursday, March 12, 2009 an informal discussion took place at the Greeley Administrative
Offices Conference Room regarding a proposed amended Site Plan Review. (The legal
description is Section 8, Township 3N North, Range 65 West of the 6th P.M.)
Background Information:
Beebe Draw Farms Metropolitan District would like to propose to expand the original SPR-379 to
include a Sports Court, 1500 square foot putting green and also an area designated for team
sports such as football and soccer.
The Sports Court would consist of a concrete foundation and manufactured surface for a tennis
court, basketball court and multi -purpose courts. The Sports Courts would be surrounded by a
chain link type fence.
The 1500 square foot putting green will have artificial grass surfacing.
All of these proposed areas will be located in a floodplain of an existing retention pond.
The applicants assured staff that the courts are designed to withstand the amount of water
expected as they have perforations which allow the surface to be cleaned by pressure washers
or by air pressure. According to some recent perk tests of the area the proposed site is very
sandy and drains out in approximately 4 hours.
Public Works
Staff advised the applicants to talk to Clay Kimmi of the Public Works Department for further
direction on drainage.
Health Department
The applicants are not proposing any additional sanitation facilities as the Clubhouse and
Pool/Cabana have facilities to accommodate the already existing and expected population of the
subdivision. Staff stated that they will need to evaluate the facilities on site. Upon preliminary
research staff found the following septic permits: No. G19890060 for 40 people for the
Equestrian Center, No. SP0400426 for 54 people for the Pool/Cabana, and No. SP9900115 for
14 people for the Club House.
Planning Department
The applicants are proposing some heavy landscaping to the west of the proposed sporting
facilities to help with wind and debris. Staff advised the applicant to visit with the Fire District for
further direction on access to the facilities.

Section 23-2-160 Application requirements for site plan review.

E. The original Site Plan Review No. 379 was for a swimming Pool, Cabana, and
Playground Area. The proposed use is to expand the playground area to include a
Sports Court comprised of a single slab of concrete with a manufactured surface
that will be installed on the concrete slab making up a tennis court, a basketball and
multi -purpose court, and a shuffle board court. The tennis and basketball courts
will be fenced with a chain link type fence. In addition to the above, a 1500 square
foot putting green will be developed adjacent to the concrete slab that will have
artificial grass surfacing, and an area adjacent to the south of the concrete slab will
be designated as an "Activity Area" for team type sports such as football and soccer.
All of these facilities will be placed in the flood plain of an existing Retention Pond.
None of these facilities are expected to be impacted by the event of being flooded,
except for some additional minimal maintenance.
F. Evidence that the USE in the zone district shall have adequate source of potable
water and meet the requirements of the zone district.
The proposed facility will be served by the Central Weld County Water District
system that currently serves Beebe Draw Farms Filing 1. The water usage for the
proposed facility will be limited to an irrigation sprinkler system for the Activity
Area. This can be served through the existing taps at the Community Building and /
or Pool which are connected to a 10" water main. See Site Map.
G. Evidence that the USE in the zone district shall have adequate sewage disposal
facilities and meet the requirements of the zone district.
The proposed facility shall be served by the existing restroom facilities that are
located in the Pool building which has an engineered septic system that meets the
requirements of the Weld County Health Department's regulations. This system
was designed for the maximum anticipated number of users of the Pool and
Playground facility on a daily basis. The total recreation facilities included in the
Playground Area are for the use of Pelican Lake Ranch residents. Approval of the
original SPR # 379 was based on 188 plated lots in Filing 1. This number remains
the same. The total number of users are not anticipated to increase with the
addition of the proposed recreation facilities.

J. A statement indicating that the proposed USE meets the required SETBACK and
OFFSET requirements of the zone district.
The Setback requirement for the zone is 20 feet. The offset requirement for the
zone is 20 feet. Both setback and offset requirements will be met.

construction materials of the buildings proposed in sufficient detail to exhibit the
relative compatibility of the proposed site with the character of the surrounding

The anticipated signage for this project will consist of two signs placed on the chain
link fence warning prospective users to vacate the premises during inclimate
weather. These signs will be approximately 24" x 36" in size on a weather proof
type material, installed in a conspicuous location.

maintain the landscaped areas.
N. A statement accompanied by evidence explaining how the storm water runoff will be
handled.

the Off-street Parking Requirements listed in Article IV, Division 1 of this Chapter
or a more restrictive ordinance. Sufficient SCREENED, off-street, paved parking

The proposed facilities are for the use of existing residents. The existing parking for
the Community Building and the Pool adjacent to these proposed facilities will

provide the parking required. This parking has been landscaped to meet County
requirements.

A statement explaining that the LOT shall have safe access to an approved public or
private STREET. The design designation of a STREET or highway as to type shall
be in conformance with that shown on the Transportation Plan and / or the
MASTER PLAN of the affected municipality.
There are no additional access points planned to serve the proposed facility. The
proposed access to Beebe Draw Parkway is via the two current access points
provided for the Community Building. There are no horizontal or vertical sight
distance problems associated with the current access points. An emergency vehicle
and maintenance access road with base course surface will be provided off of the
existing pavement within Lot 1 to the west side of the concrete courts and activity
field.

T. A statement explaining that the trash collection areas or facilities are located,
designed and USED in a manner that shall meet the requirements of the zone
district.
The existing trash enclosure serving the Community Building and Pool shall be used
for the proposed facility.
U. A statement explaining that the USE is compatible with the existing or future
development of the surrounding areas as permitted by the existing zoning and with
the future development of the area as projected by the Comprehensive Plan or
Master Plan of affected municipalities and any Intergovernmental Agreement.
Such use shall adhere to the following operation standards, to the extent that they
are affected by location, layout and design prior to construction and operation.
Once operational, the operation shall conform to the standards listed below:
1. Noise.
Noise will be mitigated with landscaping and distance from any proposed or
existing residential structure. The nearest existing or future home will be in
excess of 250 feet in proximity to the facility. The facility is planned to be
placed in the bottom of a Retention Pond.

Dear Mr. Kimme,
Per our meeting with you regarding the addition of a Sport Court facility in the retention pond
located just south of the community building on Lot 1 of the referenced subdivision, we have
included herein the information requested.
1. A percolation test was performed on 2-8-09 at the location shown on the Site Plan. The
result was a pert rate of 2 minutes per inch. We applied a safety factor of 2 to obtain a
perc rate of 4 minutes per inch. Given an average depth of four feet, not including the
sidewalls of the retention pond, the percolation time for the entire pond, assuming it was
full, would be calculated as follows:
4' x 12" = 48 inches x 4 minutes per inch = 192 minutes divided by 60 minutes = 3.2
hours which is less than the maximum time allowed of 72 hours to drain a retention pond.
2. The intent is to remove as much or more soil from the retention pond as will be
introduced into the pond in the way of construction materials in the way of volume.
Therefore, 650 cubic yards of dirt will be removed from the retention pond.
3. As suggested, a berm will be created on a temporary basis along the east side of the
courts to contain any movement of soil during construction from the construction site to
the lower portion of the pond. All disturbed areas will be reseeded upon completion of
the construction.

The following is in response to the comments received regarding the referenced project. Our
response is in the order presented.
1. Please find included herewith three (3) stamped copies of the ArnSPR Review Map
prepared in accordance with the Weld County Code.
2.A. Please find attached a copy of the response from CDPS regarding the discharge of
water into the States Waterways.
2.B. Please find included herewith a copy of the maintenance plan in regards the to proposed
facility.
2.C. A copy of the letter presented to the Weld County Department of Public Works
regarding their concerns is attached. In response to this letter, additional concerns were
presented as per the attached. Final Plat concerns have been addressed by the signing of the
plans by a professional engineer licensed to practice in the State of Colorado and by placing
the note regarding the County will not be responsible for the maintenance of drainage
facilities in the Notes on Sheet 1 of 3, and also on Sheet 3 of 3. Per your instructions, notes
were not duplicated otherwise. Drawing concerns have been addressed by adding and/or
revising details of erosion control on the plan Sheet 3 of 3. Also, the Warning sign has been
revised and its proposed locations shown on the plans. The road base for the Emergency
Access Road has been identified on the plans. Per item 2.A. above, see attached response
from the CDPS regarding Storm Water Permit. Finally, a grading permit will be applied for
by the Contractor prior to beginning construction.
2.D. The Contractor shall be required to obtain a permit from the Weld County Building
Department for the concrete slab to be constructed for the Sport Court, as discussed with
Frank Piacentino of the Weld County Building Department.
2.E. Please find included herewith signed copies of Exhibit A and Exhibit B of the Private
Improvements Agreement. The Private Improvements Agreement and form of collateral will
be provided for review and approval prior to recording of the Use by Special Review plats if
required. However, if allowed, the improvements will be completed under the review of
County Staff and approved in leiu of the previous.
2.F. Please find included herewith a copy of water bills from Central Weld County Water
District indicating their existing water service to the facilities.
2.G. Please find included herewith written evidence that Christine Hethcock has the
authority to sign for Beebe Draw Farms Metropolitan District No. 2.
2.H.1. The Amended Site Plan Review Plat shall include Sheets 1, 2, and 3 of 3 and shall be
prepared in accordance with Section 23-2-160.V of the Weld County Code.
2.H.2. The Amended Site Plan Review Plat shall include all the facilities on site within the
boundary.
2.H.3. Accepted.
2.H.4. No new electrical Lighting shall be placed on the site. However, low level solar
lights shall be placed along the sidewalk for safety purposes and decoration.
2.H.5. An existing dumpster enclosure is shown on the plans within Outlot 1. This dumpster
is centrally located to all facilities and was accepted as the dumpster facility as part of the
original SPR for the Pool and Playground. A copy of photograph of this facility is included
herewith as well as a letter from the trash hauler indicating approval of the facility. Given
the above, a detail of this facility has not been placed on the plans.
2.H.6. The duplication of maps, notes, and signature blocks have been deleted from the
plats.
2.H.7. The scale of the proposed facility has been increased to 1 "=40' on Sheet 2 of 3.

BEEBE DRAW FARMS METROPOLITAN DISTRICT NO. 2
The Metro District employs a full time Property Manager (DeWayne Colby 303-807-
6234) on -site to provide maintenance of District facilities. In addition, a landscape
contractor (currently Alpine Gardens 970-506-2727) is engaged by contract to provide
on -going maintenance and repair of District landscaping. The Property Manager is
equipped with a John Deere tractor with attachments used to mow large areas, spray for
weeds, and provide grading. The landscape contractor maintains the grass lawns,
sprinkler systems, and monitors the health of all trees and shrubs. The Property Manager
will be in charge of maintaining the Sport Court area in accordance with Weld County
Code Sec. 23-3-250 B. 7.

In response to your comments on the submittals for the referenced project, we have provided you
the following information:
1. The current volume of Retention Pond # 1 as determined by field survey is approximately
26.064 Acre Feet. Per the existing drainage plans for Filing 1 of the Beebe Draw Farms
& Equestrian Center, the average volume to be provided for in this pond is 26.09 A.F. A
copy of our calculations have been included herein and placed on the plans. Please
advise if we should include these calculations on the plans or remove them. A copy of
the information from the drainage plans is also included herein.
2. We have calculated the volume of the improvements to be placed in the Retention Pond #
1 as approximately 650 cubic yards, which includes 0.026 A.F. difference in the required
volume of Retention Pond # 1 and the field calculated volume.
3. We have shown Silt Fence to be used in the pond to control the movement of silt in the
pond. A detail of the silt fence installation has been included on the plans.
4. A note stating that Weld County will not be responsible for drainage related facilities has
been included on the plans.
5. A legend identifying line types and symbols has been included on the plans.
6. Cross sections identifying Sections A -A and B -B have been added to the plans.
7. A concrete wash out area has been identified on the plans and a detail has been added to
the plans.

Weld County Public Works Department has reviewed this Amended Site Plan Review
(SPR) request. Comments and concerns identified during this phase of the process
may not be all-inclusive, as other concerns or issues may arise during the remaining
application process.
Requirements
On July 21, 2009, the Public Works Department received an updated submittal from J.L.
Walter Consulting regarding the above mentioned amended SPR. The submittal
contained Sheet 3 of 3 Site and Grading Details, responses to the April 15, 2009 memo,
calculations showing that the pond will drain in 72 hours, and retention pond volume
calculations. A Final Plat was not provided for review. Sheets 1 and 2 of 3 were not
included for review.
The following concerns identified by Weld County Public Works shall be resolved
prior to recording the final plat for this Site Plan Review:
Final Plat:
1. Final Plat and all drawings shall be stamped by a registered professional engineer,
licensed to practice in the state of Colorado.
2. Per the meeting notes from the February 4, 2009 meeting between Public Works
and the applicant, the Final Plat and all drawings shall include a note that Weld
County will not be responsible for the maintenance of drainage related facilities.
The applicant has provided the note on sheet 3 of 3 but has not provided a copy of
the Final Plat for review.
Drawings:
1. Weld County has found that the type of tracking pad shown on the drawing does
not adequately keep material from being tracked onto our roads. Please increase
the size of material to be substantially larger (3 to 4 inch range) and more angular
in shape. See the attached vehicle tracking pad detail.
2. The purpose of the tracking pad is to create a rough surface which will bounce the
vehicle enough to remove accumulated material from the wheels.

3. The message on the warning sign needs to indicate that the fields and courts are
located in a stormwater retention pond. The rest of the language is appropriate.
4. The locations of the warning signs need to be shown on the drawings.
5. The surface material for the emergency access road needs to be identified.
6. It appears that more than 1 acre of land will be disturbed with this project. Prior
to the issuance of a grading permit, the applicant will have to provide a copy of
the approved construction stormwater permit from the Colorado Department of
Public Health and Environment.
7. A grading permit application must be submitted and approved prior to the start of
construction.

This letter will serve as confirmation that Christine Hethcock is the duly elected
President/Chair of Beebe Draw Farms Metropolitan District No. 2 (the "District"), and as
such is an authorized signatory of all contracts, deeds and other documents on behalf of
the District. Such authority is given pursuant to Section 8.g of the District Bylaws (a

BEEBE DRAW FARMS METROPOLITAN DISTRICT NO. 2
BY-LAWS
Section 1. Authority. Beebe Draw Farms Metropolitan
District No. 2 ("District") is a governmental subdivision of the
State of Colorado and a body corporate with those powers of a
public or quasi -municipal corporation which are specifically
authorized by, and in compliance with, Section 32-1-101 et seq.,
C.R.S.
Section 2. Purpose. It is hereby declared that the
By -Laws hereinafter set forth will serve a public purpose.
Section 3. Policies of the Board. It shall be the policy
of the Board of Directors ("Board") of the District, consistent
with the availability of revenues, personnel and equipment; to
use its best efforts to provide street improvements and
drainage, traffic and safety controls, parkand recreation,
transportation, mosquito control, and water services, and all
other improvements, facilities, and services authorized under
the District Service Plan or by law.
Section 4. Board of Directors. All powers, privileges and
duties vested in, or imposed upon, the District by law shall be
exercised and performed by and through the Board, whether set
forth specifically or impliedly in these By -Laws. The Board may
delegate to officers, employees, and agents of the District any
or all administrative and ministerial powers.
Without restricting the general powers conferred by these By
Laws, it is hereby expressly declared that the Board shall have
the following powers and duties:
a. To confer upon any appointed officer of the
District the power to choose, remove or suspend employees or
agents upon such terms and conditions as may seem fair and just
and in the best interests of the District.
b. To determine and designate, except as otherwise
provided by law or these By -Laws, who shall be authorized to
make purchases, negotiate leases for office space, and sign
receipts, endorsements, checks, releases and other documents.
c. To create standing or special committees and to
delegate such power and authority thereto as the Board deems
necessary and proper for. the performance of such committee's
functions and obligations.
d. To prepare financial reports, other than the
statutory audit, covering each year's fiscal activities, and
such reports, if requested, shall be submitted to the Board and
made available for inspection by the public.
Section S. Office.
a. Business Office. The principal business office
of the District shall be at the offices of Collins and Cockrel,
390 Union Boulevard, Suite 400, Denver, Colorado, until
otherwise designated by the Board.
b. establishing Other Offices and Relocation. The
Board, by resolution, may from time to time, designate, locate
and relocate its executive and. business office and such other
offices as, in its judgment, are necessary to conduct the
business of the District.
Section 6. Meetings.
a. Aegular Meetings. Regular meetings of the Board
shall be scheduled as needed, and conducted at the business
office, unless otherwise noticed and posted.
b. Meeting Public. All meetings of the Board, other
than executive sessions, shall be open to the public.
c. Notice of Meetings. Section 6.a shall constitute
formal notice of regular meetings to Board members, and no other
notice shall' be required to be given to the Board, other than
the permanent posting. Written waivers of notice by Board
members are not necessary.
d. Special Meetings. Special meetings of the Board
may be called upon seventy-two (72) hours written notice, which
shall be posted in three places within the District and at the
County Clerk and Recorder's offices.
e. No Informal Action by Director@. All official
business of the Board shall be conducted at regular or special
meetings. All matters concerning personnel, litigation and real
estate acquisitions will be addressed in executive session of
the Board, unless otherwise provided.
f. pdiournment and Continuance of Meetings. When a
regular or special meeting is for any reason continued to
another time and place, notice need not be given of the
continued meeting if the time and place of such meeting are
announced at the meeting at which the continuance is taken,
except as required by law. At the continued meeting, any
business may be transacted which could have been transacted at
the original meeting.
Section 7. Conduct of Business.
a. Quorum. All official business of the Board shall
be transacted at a regular or special meeting at which a quorum
(i.e., three) of the Directors shall be present in person or
telephonically, except as provided in Section 7.b.
b. Vote Requirements. Any action of the Board shall
require the affirmative vote of a majority of the Directors
present and voting. When special or emergency circumstances
affecting the affairs of the District and the health and safety
of District residents so dictate, then those Directors available
at the time may undertake whatever action is considered
necessary and may so instruct the District's employees, agents
and contractors. Such actions shall later be ratified by the
Board.
c. Order of Business. The business of all regular
meetings of the Board shall be transacted, as far as
practicable, in the following order:
(1) Reading and approval, or approval as
submitted, of the minutes of the previous
meeting;
(2) Approval of bills and appropriations;
(3) Hearings;
(4) Reports of officers, committees and profes-
sional consultants;
(5) Unfinished business;
(6) New business and special orders; and
(7) Adjournment

d. Motions and Resolutions. Each and every action
of the Board necessary for the governance and management of the
affairs of District, for the execution of the powers vested in
District, and for carrying into effect the provisions of Article
1 of Title 32, C.R.S., shall be taken by the passage of motions
or resolutions.
e. Minute Book. Within a reasonable time after
passage, all resolutions, motions and minutes of Board meetings
shall be recorded in a book kept for that purpose and shall be
attested by the Secretary.
Section 8. Directors. Officers and Personnel.
a. Director Oualifications and Terms. Directors
shall be electors of the District. The term of each Director
shall be determined by relevant statutory provisions with
elections held in even numbered years and conducted in the
manner prescribed by Articles 1 through 13, Title 1, and Part 8,
Article 1, Title 32, C.R.S. Each Director shall sign an oath of
office and, at the expense of the District, furnish a faithful
performance surety bond in a sum of not less than $1,000.
b. pirector's Performance of Duties. A Director of
the District shall perform all duties of a Director, including
duties as a member of any committee of the Board upon which the
Director may serve, in good faith, in a manner which the
Director reasonably believes to be in the best interests of
District, and with such care as an ordinarily prudent person in
a like position would use under similar circumstances. In
performing the Director's duties, the Director shall be entitled
to rely on information, opinions, 'reports, or statements,
including financial statements and other financial data, in each
case prepared or presented by persons and groups listed in
subparagraphs 1, 2 and 3 of this subsection b. The Director
shall not be considered .to be acting in good faith if he has
knowledge concerning the matter in question that would cause
such reliance to be unwarranted. A person who so performs the
Director's duties shall not have any liability by reason of
being or having been a Director of District. Those programs and
groups upon whose information, opinions, reports, and statements
a Director is entitled to rely are:
(1) One ormore officers
District whom the
believes to be reliable
matters presented;
or employees of the
Director reasonably
and competent in the

(2) Counsel, public accountants, or other
persons as to matters which the Director
reasonably believes to be within such
persons' professional or expertise; and
(3) A committee of the Board upon which the
Director does not serve, duly designated in
accordance with the provisions of the By -
Laws, as to matters within its designated
authority, which committee the Director
reasonably believes to merit confidence.
c. Oath of Office. Each member of the Board, before
assuming the responsibilities of his office, shall take and
subscribe an oath of office in the form prescribed by law.
d. Rlection of Officers. The Board of Directors
shall elect from its membership a President, Vice President,
Secretary, Treasurer, Assistant Secretaries and Assistant
Treasurers, who shall be the officers of the Board of Directors
and of the District. The Assistant Secretaries and Assistant
Treasurers shall have all the powers of the office of Secretary
and Treasurer, in their absence. The officers shall be elected
by a majority of the Directors voting at such election. The
Board may, from time to time, appoint an acting officer in the
absence of any individual officer. The election of the officers
shall be conducted biennially at the first regular meeting of
the Board following the regular biennial election of the
Directors held in May of even numbered years. Each officer so
elected shall serve for a term of two years which term shall
expire upon the election oftheir successor or upon their
reelection to that office.
e. Vacancies. Any vacancy occurring on the Board
shall be filled by an affirmative vote of a majority of the
remaining Directors,, as prescribed by law. The appointed
individual must meet the statutorily prescribed qualifications
for Directors and shall serve until the next regular election.
f. Resignation and Removal. Directors may be
removed from office only by recall as prescribed by statute.
Any Director may resign at any time by giving written notice to
the Board, and acceptance of such resignation shall not be
necessary to make it effective, unless the notice so provides.
g. President and Chairman. The President shall be
the Chairman of the Board and preside at all meetings; the
President shall also be the chief executive officer of the
District and shall generally supervise the manager or
administrator, as appropriate. Except as otherwise authorized,
the President shall sign all contracts, deeds, notes,
debentures, warrants and other instruments on behalf of
District.
h. Secretary. The Secretary shall be responsible
for the records of the District; may act as Secretary at
meetings of the Board and record all votes; shall be responsible
for composing a record of the proceedings of the Board in a
minute book kept for that purpose, which shall be an official
record of the Board; and shall perform all duties incident to
that office. The Secretary shall be the designated election
official of the District and the custodian of the seal of
District and shall have the power to affix such seal to and
attest all contracts and instruments authorized to be executed
by the Board.
i. Treasurer. The Treasurer shall be authorized to
invest all surplus funds or other available funds of the
District in permitted investments authorized by law or as
specified by the Board. The Treasurer shall be chairman of the
Budget Committee and of the Audit Committee. The Treasurer
shall keep or cause to be kept strict and accurate accounts of
all money received by and disbursed for and on behalf of
District in permanent records. The Treasurer shall file with the
Clerk of the Court, at the expense of the District, a corporate
fidelity bond in an amount determined by the Board of not less
than $5,000, conditioned on the faithful performance of the
duties of the Treasurer's office.
j. Recording Secretary. The Board shall have the
authority to appoint a recording secretary who need not be a
member of the Board of Directors, and who will be responsible
for recording allvotes and composing a record of the
proceedings of the Board in the minute book. The recording
secretary shall not be required to take an oath of office, nor
shall the recording secretary be required to post a performance
bond.
k. Additional Duties. The officers of the Board
shall perform such other duties and functions as may from time
to time be required by the Board, by the By -Laws or rules and

regulations of District, by law, or by special exigencies, which
shall later be ratified by the Board.
1. Manager or Administrator. The Board may appoint
a manager or contract with an administrator to serve for such
term and upon such conditions, including compensation, as the
Board may establish. Such manager or administrator shall have
general supervision over the administration of the affairs,
employees and business of the District and shall be charged with
the hiring and discharging of employees and the management of
District properties. Such manager or administrator shall have
the care and custody of the general funds of the District and
shall deposit the same. in the name of District in such banks or
savings associations as the Board may select. Such manager or
administrator will approve all vouchers, orders and checks for
payment, and shall keep regular books of account of all District
transactions and shall obtain, at the District's expense, such
bond for the faithful performance of its duties as the Board may
designate.
m. Personnel Selection and Tenure. The selection of
agents, employees, engineers, accountants, special consultants
and attorneys of the District by the Board will be based upon
the relative qualifications and capabilities of the applicants
and shall not be based on political services or affiliations.
Agents and employees shall hold their offices at the pleasure of
the Board. Contracts for professional services of engineers,
accountants, special consultants and attorneys may be entered
into on such terms and conditions as may seem reasonable and
proper to the Board.
Section 9. Financial Administration.
a. Fiscal Year. The fiscal year of the District
shall commence on January l of each year an end on December 31.
b. Budget Committee. There shall be a permanent
Budget Committee composed of the Treasurer, _a member of the
Board appointed by the President, and the administrator, which
shall be responsible for preparation of the annual budget of the
District and such other matters as may be assigned to it by the
President or the Board.
c. budget. On or before October 15th of each year,
the Budget Committee shall prepare and submit to the Board a
proposed budget for the ensuing fiscal year. Such proposed
budget shall be accompanied by a statement which shall describe

the important features of the budget plan and by a general
summary wherein shall be set forth the aggregate features of the
budget in such manner as to show the balanced relations between
the total proposed expenditures and the total anticipated income
or other means of financing the proposed budget for the ensuing
fiscal year, as contrasted with the corresponding figures for
the last completed fiscal year and the current fiscal year. It
shall be supported by explanatory schedules or statements
classifying the expenditures contained therein by services,
subjects and funds. The anticipated income of the District
shall be classified according to the nature of receipts.
d. Notice of Budget. Upon receipt of the proposed
budget, the Spard shall cause to be published a notice that the
proposed budget is open for inspection by the public at the
business office; that the Board will consider the adoption of
the proposed budget at a public hearing on a certain date; and
that any interested elector may inspect the proposed budget and
file or register any objections thereto at any time prior to its
final adoption. Notice shall be posted or published in
substantial compliance with law.
e. Adoption of Budget. On the day set for
consideration of such proposed budget, the Board shall review
the proposed budget and revise, alter, increase or decrease the
items as it deems necessary in view of the needs of the District
and the probable income of the District. The Board shall then
adopt a budget setting forth the expenditures to be made in the
ensuing fiscal year. The Board shall provide, for sufficient
revenues to finance expenditures in the budget with special
consideration given to the proposed property tax levy.
f. Levu and Collection of Taxes. On or before
December 15th of each year, unless an election for an increased
operating tax levy is held, the Board shall certify to the Board
of County Commissioners of the County in which the District was
formed the mill levy established for the ensuing fiscal year, in
order that, at the time and in the manner required by law for
the levying of taxes,. such Commissioners will levy such tax upon
the assessed valuation of all taxable property within District.
g. Filing of Budget. On or before January 30th of
each year, the Board shall cause a certified copy of such budget
to be filed with the Division of Local Government in the State
Department of Local Affairs.

h. Appropriating Resolution.
(1) At the time of adoption of the budget, the
Board shall enact a resolution making
appropriations for the ensuing fiscal year.
The amounts appropriated thereunder shall
not exceed the amounts fixed therefor in the
adopted budget.
(2) The income of the District, as estimated in
the budget and as provided for in the tax
levy resolution and other revenue and
borrowing resolutions, shall be allocated in
the amounts and according to the funds
specified in the budget for the purpose of
meeting the expenditures authorized by the
appropriation resolution.
(3) The Board may make an appropriation to and
for a contingent fund to be used in cases of
emergency or other unforeseen contingencies.
i. No Contract to Exceed Appropriation. The Board
shall have no authority to enter into any contract, or otherwise
bind or obligate the District to any liability for payment of
money for any purposes, for which provision is not made in
appropriation resolution, including any legally authorized
amendment thereto, in excess of the amounts of such
appropriation for that fiscal year. Any contract, verbal or
written, contrary to this Section shall be void ab initio, and
no District funds shall be expended in payment of such
contracts, except as follows:
j. Contingencies.
(1) In cases of emergency caused by a natural
disaster, public enemy, or other contingency
which could not reasonably have been
foreseen at the time of the adoption of the
budget, the Board may authorize the
expenditure of funds in excess of the budget
by resolution duly adopted by a two-thirds
vote of the Board. Such resolution shall
set forth in full the facts concerning the
emergency and shall be included in the
minutes of such meeting.

(2) If so enacted, a copy of the resolution
authorizing additional expenditures shall be
filed with the Division. of Local Government
in the State Department of Local Affairs and
shall be published in compliance with
statutory requirements.
k. payment of Contingencies.
(1) If there is unexpended or uncommitted money
in funds other than those to which the
emergency relates, the Board shall transfer
such available money to the fund from which
the emergency expenditure is to be paid.
(2) To the extent that transferable funds are.
insufficient to meet the emergency
appropriation, the Board may borrow money
through (a) the issuance of tax anticipation
warrants, to the extent that the mill levy
authority of the District is available as
provided by law, or (b) the issuance of bond
anticipation notes payable from future bond
proceeds or operating revenue, or (c) any
other lawful and approved method.
1.. Annual Audit.
(1) The Board shall cause an annual audit to be
made atthe end of each fiscal year of all
financial affairs of the District through
December 31st of such fiscal year. In all
events, the audit report must be submitted
to the Board within six months of the close
of such fiscal year. Such audit shall be
conducted in accordance with generally
accepted auditing standards by a registered
or certified public accountant, who has not
maintained the books, records and accounts
of District during the fiscal year. The
auditor shall prepare, and certify as to its
accuracy, an audit report, including a
financial statement and balance sheet based
on such audit, an unqualified opinion or
qualified opinion with explanations, and a
full disclosure of any violation of State
law pursuant to statutory requirements.

(2) A copy of the audit report shall be main-
tained by the District as a public record
for public inspection at all reasonable
times.
(3) A copy of the audit report shall be
forwarded to the State Auditor or other
appropriate State official pursuant to
statutory requirements.
Section 10. Corporate Seal. The seal of the District
shall be a circle containing .the name of the District and shall
be used on all documents and in such manner as seals generally
are used by public and .private corporations. The Secretary
shall have custody of the seal and shall be responsible for its
safe keeping and care.
Section 11. Disclosure of Cflict of Interest. A
potential conflict of interest of any Director shall be
disclosed in accordance with State law, particularly Article 18
of Title 24, C.R.S., and Sections 32-1-902(3) and 18-8-308,
C.R.S.
Section 12. Compensation. Each Director shall receive the
maximum compensation authorized by statute, unless otherwise
determined by the Board. No Director shall receive compensation
as an employee of the District, except as may be provided by
statute.
Section 13. Indemnification of Directors and Employees.
The District shall defend, hold harmless and indemnify any
Director, officer, agent, or employee, whether elective or
appointive, against any tort or liability, claim or demand,
without limitation, arising out of any alleged act or omission
occurring during the performance of official duty, as more fully
defined by law or by an indemnification resolution. The
provisions of this Section shall be supplemental and subject to
and, to the extent of any inconsistency therewith, shall be
modified by the provisions of the Colorado Governmental Immunity
Act, 24-10-101, et seq., C.R,S.
Section 14. bidding and Contracting Procedures. Except in
cases in which the District will receive aid from a government
agency, a notice shall be published for bids on all construction
contracts for work or material, or both, involving an expense of
$25,000 or more of District funds. The Board may reject any and

all bids, and if it appears that the District can perform the
work or secure material for less than the lowest bid, it may
proceed to do so in accordance with law. All other statutory
requirements relating to performance bonds, retainage, and
similar matters shall also be complied with.
Section 15. Modification of By -Laws. These By -Laws may be
altered, amended or repealed at any regular or special meeting
of the Board to become effective immediately or at a subsequent
date.

Weld County Public Works Department has reviewed this Amended Site Plan Review

On July 21, 2009, the Public Works Department received an updated submittal from J.L.
Walter Consulting regarding the above mentioned amended SPR. The submittal
contained Sheet 3 of 3 Site and Grading Details, responses to the April 15, 2009 memo,
calculations showing that the pond will drain in 72 hours, and retention pond volume
calculations. A Final Plat was not provided for review. Sheets 1 and 2 of 3 were not
included for review.
The following concerns identified by Weld County Public Works shall be resolved
prior to recording the final plat for this Site Plan Review:
Final Plat:
1. Final Plat and all drawings shall be stamped by a registered professional engineer,
licensed to practice in the state of Colorado.
2. Per the meeting notes from the February 4, 2009 meeting between Public Works
and the applicant, the Final Plat and all drawings shall include a note that Weld
County will not be responsible for the maintenance of drainage related facilities.
The applicant has provided the note on sheet 3 of 3 but has not provided a copy of
the Final Plat for review.
Drawings:
1. Weld County has found that the type of tracking pad shown on the drawing does
not adequately keep material from being tracked onto our roads. Please increase
the size of material to be substantially larger (3 to 4 inch range) and more angular
in shape. See the attached vehicle tracking pad detail.
2. The purpose of the tracking pad is to create a rough surface which will bounce the
vehicle enough to remove accumulated material from the wheels.

3. The message on the warning sign needs to indicate that the fields and courts are
located in a stormwater retention pond. The rest of the language is appropriate.
4. The locations of the warning signs need to be shown on the drawings.
5. The surface material for the emergency access road needs to be identified.
6. It appears that more than 1 acre of land will be disturbed with this project. Prior
to the issuance of a grading permit, the applicant will have to provide a copy of
the approved construction stormwater permit from the Colorado Department of
Public Health and Environment.
7. A grading permit application must be submitted and approved prior to the start of
construction.

Environmental Health Services has reviewed this proposal to amend Site Plan Review
#379 to expand the playground area to include a Sport Court (basketball, tennis,
shuffleboard and a putting green). The proposed facility will be served by the existing
Central Weld County Water District system and by the existing restroom facilities that
are located in the pool building which has an engineered Individual Sewage Disposal
System (ISDS Permit No. SP -0400426). The septic permit indicates that the system
was designed for 54 persons per day. However, the actual septic absorption field
installed is oversized by approximately 75%. The septic system design calculations
provided by the engineer, JL Walter Consulting for this proposal, indicates an occupant
load of 81 persons per day. Based on the engineer's calculations and the actual
installed septic system under permit no. SP -0400426, this existing ISDS appears to be
adequately sized and may be utilized.
We have no objections to the proposal, however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be incorporated into the permit as a
condition that must be met one month prior to construction activities:
1. The applicant shall submit evidence of a Colorado Discharge Permit System or
CDPS permit from the Colorado Department of Public Health and Environment
(CDPH&E), Water Quality Control Division, to cover stormwater discharges from
construction sites (5 CCR-1002-61) Alternately, the applicant can provide
evidence from CDPH&E that they are not subject to the CDPS requirements.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not meant
to include those wastes specifically excluded from the definition of a solid waste in
the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as
amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
5. This facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in Section 14-9-30 of the Weld County Code.
6. Adequate drinking, hand washing and toilet facilities shall be provided for
employees and patrons of the facility, at all times.
7. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
8. The facility shall utilize the existing public water supply (Central Weld County
Water District).
9. All pesticides, fertilizer, and other potentially hazardous chemicals must be stored
and handled in a safe manner in accordance with product labeling and in a
manner that minimizes the release of hazardous air pollutants (HAP's) and volatile
organic compounds (VOC's).
10. If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
11.The operation shall comply with all applicable rules and regulations of state and
Federal agencies and the Weld County Code.

1. Building permits shall be obtained prior to the construction or change of use of any building .
2. A plan review is required for each building except for buildings that meet the definition of Ag Exempt
buildings. Plans may require the wet stamp of a Colorado registered architect or engineer.
3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit
application. Current adopted codes include the 2006 International Building Code; and Chapter 29 of the
Weld County Code.
4. Each building will require an engineered foundation based on a site -specific geotechnical report or an
open whole inspection performed by a Colorado registered engineer. Engineered foundations shall be
designed by a Colorado registered engineer.
5. Based on the Site Plan Review Application the proposed building will be classed as an
A-3 Occupancy, storage buildings.
6. Buildings shall conform to the requirements of the various codes adopted at the time of
