RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST HOWARD BINDER FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Howard Binder, ZCV #0900119, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 14th day of July, 2009, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Howard Binder, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until August 29, 2009, to allow adequate time for the property owner to remove the two mobile homes to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. It is my understanding that Wendi has approved the re -justification for 3 of the 5 mobile homes situated on the property; however, she is awaiting additional information on the 2 (two) that you indicated work for your on Denver rental properties. Wendi Inloes and I called him back on speaker phone. We advised him that he needed to submit re -justification for all the mobile homes. He indicated this was the first notice he received. He stated that he moved not that long ago and maybe the notifications got lost in the mail. Wendi advised him that he would need to fill out an "Accessory to the Farm Certification" for each mobile home and when completed submit it back to this office along with supporting documentation (such as W -2"s and/or pay stubs). He asked us to fax it to him (303-857-1587) - Which we did. I also advised him that I would be sending a 30 day Violation Notice. I also brought up the mobile home on 10 (in the back). He said when he got denied, he simply moved it back there and it has been there every since. I told him it could not stay there. He said he would start working on its removal. He indicated that on the CR 10 property 2 of the employees work part time for him and part time for his wife (she has some rental homes in Denver and he does maintenance on them). We told him to put all that in writing. He said he was confused and a little bit scared. He said the mobile home that was sitting out back had been torn down and removed within a couple weeks of my initial letter. He started to explain about the mobile home up by the road. I explained that I determined it was pre-existing as well. He said it was there when he purchased the property. He said he tries to make everyone keep the property clean. I told him that I would base how I proceed upon Wendi"s findings regarding the re -justification of those 2 remaining mobile homes. 06/26/2009 Phone Call I called Howard Binder (303-717-6377). Two of these homes, (referred to as #1 and #5), you have stated that the occupants work for your wife, and not necessarily on the property full time. Per Section 23-4-170.1.of the Weld County Code, the mobile homes shall be occupied by those associated with the operation on which the homes are located, and these two homes are not, as again you stated the help works for your wife in another city. Dear Mr. Binder On December 17'", 2008, you were sent a letter regarding the above permits for Accessory to the Farm. The letter stated that our office is requiring written notice of evidence within 30 days, that the need for the additional mobile home still exists. To date, our office has not received any new information. Evidence shall be submitted by the applicant or property owner for review and acceptance on a yearly basis to the Department of Planning Services verifying that the mobile home occupant is principally employed at or engaged in the farming operation on the subject property. The evidence shall consist of tax records, employment agreements or other documentation as determined suitable by the Department of Planning Services. Failure to submit the required documentation may result in cessation of the allowance of the mobile home for temporary accessory farm use. If the use of the mobile home has changed or been removed, please contact me at the above address or phone number. If our office does not hear from you within 10 days of receipt of this letter, your Zoning Permit will be turned over to our Zoning Compliance Officer, as it will be in violation with the Weld County Code Section 23-4-170.
