Garcia, Chair Commissioner Douglas Rademacher, Pro-Tem Commissioner Sean P. Conway Commissioner Barbara Kirkmeyer Commissioner David E. Long Also present: Acting Clerk to the Board, Esther Gesick County Attorney, Bruce Barker Director of Finance and Administration, Donald D. Warden The following business was transacted: I hereby certify that pursuant to a notice dated November 10, 2009, and duly published November 12, 2009, in the Windsor Beacon, the Annual Meeting of the Southwestern Weld County Law Enforcement Authority (LEA) Board was conducted to consider the Southwestern Weld County Law Enforcement Authority 2010 Budget. Donald Warden, Director of Finance and Administration, stated the only order of business for the Annual Meeting is to approve the minutes from last year's meeting. In response to Commissioner Kirkmeyer, Mr. Warden explained the Pioneer LEA is specific to the Pioneer development near the Towns of Keenesburg and Hudson, whereas the Southwestern LEA is located in the vicinity of Interstate 25 and State Highway 119, near the Carma development, and was created so that it can be expanded as more development happens in the area. Commissioner Conway move to approve the minutes from the 2008 Annual Meeting. Commissioner Kirkmeyer seconded the motion, which carried unanimously. Pursuant to a notice dated November 10, 2009, and duly published November 12, 2009, in the Windsor Beacon, a public hearing was conducted to consider the proposed 2010 Budget for the Southwestern Weld County Law Enforcement District Authority. Mr. Warden stated the voters created a 7.0 mill levy and De-Bruced the LEA. He stated this year the 7.0 mills will raise an estimated $10,839.00 in property taxes, and he anticipates $900.00 in specific ownership taxes, for a total of $11,739.00 in revenue. Responding to Commissioner Kirkmeyer, Mr. Warden stated there are very few homes in the area, and the County can only assess up to 7.0 mills, pursuant to State statute. He explained the District was created as a condition of the development when there were very few voters, because it would be difficult to go back and establish when votes of numerous residents are required to impose a tax upon themselves. He stated now potential residents are aware of the tax prior to purchasing their property. He further confirmed the authority was created with 7.0 mills, which is paid in addition to the mills established for the Metropolitan District, which can go up to 50.0 mills. 2009-3250 SD0118 HEARING CERTIFICATION - SOUTHWESTERN WELD COUNTY LAW ENFORCEMENT AUTHORITY PAGE 2 No public testimony was offered concerning this matter. Commissioner Kirkmeyer moved to approve the Resolution to Adopt Budget, in the amount of $11,739.00. The motion was seconded by Commissioner Long, which carried unanimously. Commissioner Kirkmeyer moved to approve the Resolution to Appropriate Sums of Money. The motion was seconded by Commissioner Conway, and it carried unanimously. Commissioner Kirkmeyer moved to approve the Resolution to Set the Mill Levy, at 7.0 mills. The motion was seconded by Commissioner Rademacher, and it carried unanimously. Commissioner Kirkmeyer moved to approve the Law Enforcement Agreement and authorize the Chair to sign. Commissioner Long seconded the motion, which carried unanimously. Long 2009-3250 SD0118 2010 FINAL BUDGET SOUTHWESTERN WELD COUNTY LAW ENFORCEMENT AUTHORITY WELD COUNTY COLORADO 2009-3250 BUDGET MESSAGE SERVICE: Service to be delivered by the Southwestern Weld County Law Enforcement Authority (Southwestern Weld County LEA) in Weld County for 2010 will be the provision of law enforcement services through a contract with the Weld County Sheriff. The contract will fulfill the intent of the creators of providing more adequate law enforcement for persons residing in the district, to prevent the crime rate from rising within the district, and to better assist law enforcement agencies in the prevention of crime and in the detection and apprehension of criminal offenders. BUDGETARY ACCOUNTING BASIS: The Southwestern Weld County LEA budgetary procedure uses the following Basis of Accounting. Basis of Accounting refers to when revenue and expenditures or expenses are recognized in the accounts and reported in the financial statements. Basis of Accounting relates to the time of the measurements made, regardless of the measurement focus applied. The Southwestern Weld County LEA utilizes the modified accrual Basis of Accounting. Under this method revenue is recognized in the year in which it becomes both measurable and available as net current assets. Revenue susceptible to accrual, that is, measurable and available to finance the district's operations or of a material amount and not received at the normal time of receipt, primarily consists of property taxes assessed in 2009 and payable in 2010. Unbilled charges for services are recorded in the appropriate funds at year end. Expenditures are generally recorded when the related fund liability is incurred.
