RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST THOMAS AND CONNIE JOHNSON FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Thomas and Connie Johnson, ZCV #0800287, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 10th day of February, 2009, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Thomas Johnson, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until April 10, 2009, to allow adequate time for the property owners to move from the
site, removing the violation and bringing the subject property into compliance and for an inspection
of the property by the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV #0800287 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Thomas and Connie Johnson to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an interest
in the properties, and any persons acting in active concert with the identified parties, with an
instruction for delay of action upon such referral until April 10, 2009, to allow adequate time for the
property owners to move, bringing the subject property into compliance.

REMEDY
During my last inspection I noted at least 1 semi trailer still situated on the property. My records
indicate that I sent a ZPAS application back in October, but I have been unable to locate any evidence
that a complete application has ever been received by this office. Furthermore during my last
inspection I noted a camper/trailer-RV which is expanded, skirted and appears to be connected to
utilities. Utilizing a camper/trailer-RV as a dwelling unit (even if temporarily) is not an approved use in
Weld County unless it is situated at an approved camp ground.
RECOMMENDATION
The Department of Planning Services recommends this case be forwarded to the County Attorney's
Office for immediate legal action.

10/08/2008 Phone Call Thomas Johnson (303-709-5972) called. He said he
received my letter. He asked why now I was dealing with
this. I explained that I have been trying to slowly work
my way through Aristocrat and I just ran across his
property. He explained that he was in a bad accident
and as a result, is on a fixed income. He said he used to
drive over the road (that's where the trailers came from).
He said the accident caused him to remove most of the
furniture from the house and replace it (the furniture) with
medical equipment. He said that is what's in the semi
trailers (furniture and household products). He said he's
had trailers on the property for about 10 years. I
explained the code and prior to 2006, it wasn't an
allowed use at all. I explained the ZPAS application. I
told him I would send a 60 day letter along with a ZPAS
application.
12/22/2008 Property Inspected Upon a visual inspection of the property, the following
items were noted: 1+ semi trailer noted and 1
camper/trailer-RV that was extended, skirted and
apparently connected to utilities. No pictures were taken
during this inspection.

adoption of any regulations controlling subdivisions; and more than two (2) semi -trailers on
agricultural parcels not in an approved or recorded subdivision plat of LOTS which are part of a
map or plan filed prior to the adoption of any regulations controlling subdivisions in the A
(Agricultural) Zone District.
1. The applicant shall adhere to the zoning permit requirements of Section 23-4-165 of this
Code.
To bring your property into compliance with the Weld County Code:
As we discussed over the phone, I noted 3 semi trailers situated on the property. Based
upon our conversation, I understand due to an accident, the semi trailers are currently being
utilized for storage purposes (medical supplies moved into the house and furniture and other
household items stored in the trailers). Therefore, there are a couple of options available to
correct this violation:
1.) Removal of 2 semi trailers, thus maintaining 1 (one) on the property for storage
purposes. This option would require a Zoning Permit for an Accessory Structure (ZPAS) -
$75 - For your convenience, I have included this application with this letter.
2.) Continued maintenance of all 3 semi trailers. This option would require a Use by

Special Review (USR) permit - $2500 This process requires 2 (two) public hearings.

however, we have no discretion in this matter if you fail to correct this violation. You have until
12/09/2008, to correct this zoning violation. Failure to do so will result in this office scheduling the
violation before the Board of County Commissioners to consider whether to refer the violation to the

ZONING PERMIT ACCESSORY STRUCTURE (ZPAS) SUBMITTAL
APPLICATION REQUIREMENTS:
One original application form plus four copies
One original drawing plus four copies. A scaled drawing of the property (1"=50') needs to show the
proposed location of the accessory structure. Include distances between the property lot lines and
proposed accessory structure and all other existing structures on the property; access to the property
(indicate whether it is existing or proposed) ; County, State, or Federal road rights -of -way; amount of road
frontages; location and measurements of any easements; and any proposed structures to be located on the
property.
One original Weld County Road Access Information Sheet plus one copy
One copy of deed or legal instrument identifying applicant's interest in the property. Copy of recorded
instruments may be obtained from Weld County Clerk and Recorder's Office or a title or abstract company.
One copy of affidavit and certified list of the names, addresses and the corresponding Parcel Identification
Number assigned by the Weld County Assessor of the owners' of property (the surface estate) within 500 feet of
property being considered. This list shall be compiled from the records of the Weld County Assessor,theWeld
County Website, www.co.weld.co.us. , or a person qualified to do the task, and shall be current as of a date no
more than thirty days prior to the date the application is submitted to the Department of Planning
Services.

Application fee $75.00
$37.50 investigation fee. An additional investigation fee shall be added to the cost of the permit application
when specific land, uses, building, manufactured homes, mobile homes, and structures that require a
permit by the Weld County Code are located, moved, operated, or constructed prior to obtaining a permit.
The investigation fee shall be fifty percent of the fee established by separate action by the Board of County
Commissioners for land -use applications. The payment of such investigation fee shall not relieve any
persons from fully complying with the requirements of the Weld County Code, nor from any other penalties.
One each of the application and scaled drawing shall be collated into four complete application packets and
bound with binder clips or paper clips only. The original copies shall be placed in one packet (includes
additional items below if applicable). Applications bound in any other fashion than binder or paper clip will
be returned to the applicant without review. Additional required information shall be kept separate to be
collated by Planning Staff. The Department of Planning Services may request additional information,
application packets and/or fees that will aid in the review of the Zoning Permit application.

PRE -APPLICATION REVIEW REQUEST

The pre -application request is the preliminary review of a land use proposal. Pre -application reviews are required
prior to beginning the application process;. however, this review is not an application.
Pre -application reviews are held with the Weld County Departments of Public Works and the Public Health and
and Environment. The second and fourth Friday of any given month pre -applicant reviews are held in the
Southwest Service Center office at 10:30 a.m., 11:30 a.m., 1:00 p.m., 2:00 p.m. and 3:00 p.m. Pre -Application
reviews are held Thursday of any given week in the Greeley office. To be on the pre -submittal agenda, the request
and required checklist items must be received one week prior to the review date, and shall include at a minimum, a
description of the property including surrounding lands and land uses, property owners name and contact
information, a brief narrative and a map delineating the property location, in addition to the other items listed.
