I spoke with the CDOW this weekend and discussed their referral comment on USR 1666. I confirmed for the
CDOW that Ottertail, our 3rd party environmental consultant did not deem a full PMJM or burrowing owl study be
conducted on the Milky Way site. Additionally, no cottonwood trees or wetlands were disturbed for the drilling of
the Milky Way wells. Below please find the CDOW e-mail confirming the above.

Mr. Spencer,
On August 9, 2008 a land use comment letter regarding U.S.R. 1666 located at hwy 119 and W.C.R. 7.5 was sent
to the weld county planning department by the Division of Wildlife. In it, it presents concerns regarding various
wildlife species and their habitat.
I have been informed per our conversation on June 20, 2009 that after receiving results from 3rd party wildlife
consultants there are no prebles meadow jumping mice or burrowing owls present on the proposed location for
the oil and gas production facility.
I have also been informed that no cottonwood trees on the proposed location will be disturbed.

Thanks for putting so much effort into finishing these up.
In regards to USR-1666
I will have the paper copy with corrections for you to pick up at the south office tomorrow (7:30-4:30 — we are
closed for lunch between 11:30-12:30). I am requesting a second set of paper copies for review prior to making
the mylar.
The only remaining condition of approval left is sign off from Public Works which consists of them reviewing the
second set of paper plats and approving them.
In regards to USR-1664
I only received one copy of the drawings for the SE4 and SW4 but not the NW4 and NE4. I will need two sets of
each to review.
The remaining Conditions of Approval are items 1E and 1.F regarding evidence of an access permit from CDOT.

The applicant has not submitted a final plat for review so it is unknown if the plat has been amended to show
items 1A(4) and 1A(5) of the BOCC Resolution.
Item 1A(4) states that the applicant shall provide a tracking control pad at the entrance location that extends
100 feet from the access point to the west and then install 2 cattle guards back to back. On, May 14, 2009
Public Works performed a site visit to the Milky Way site to inspect the tracking pad. Public Works found the
tracking pad to be acceptable.
Item 1B states that the applicant shall address the Public Works comments outlined in the July 30, 2008
referral. The only items that have not been adequately addressed are shown below:
• The access width requirements for emergency equipment (fire department) are a minimum of 20 feet.
The applicant shall provide documentation showing that it has been cleared with the fire department
and emergency services that the width and weight capacity of the access lane are adequate for
emergency purposes.
• Access road shall be shown on the plat as a 30 foot easement.
It appears that the other comments in the memo have been addressed or are general comments that do not
need to be addressed.

Below are the items that are still remaining for the following cases.
USR-1653
Two sets of paper plats have been submitted and reviewed but the changes were not made to the plat
The changes were —
1. show the full access fro Piedra River Road all the way to the site
2. show the tracking pad on the access to Piedra River Road
3. show the full access from Lake Catamount Parkway
4. show the gates for access to the facility (on the north and south side)
5. increase the scale of the map so 1 "=60' to make it easier to read
6. include the legal description of the property
7. print the names of the property owners underneath the signature lines
8. label the USR boundary on the plat
Condition of Approval number 1.A also needs to be addressed regarding sign off from the Mountain View Fire
Protection District regarding that the accesses to the site meet the width and weight capacity for emergency
purposes.

This letter serves as Kerr-McGee Oil and Gas OnShore LP's ("KMG") official response
to the resolution approved by the Weld County Board of County Commissioners on Use -by -
Special Review #1666. Attached please find a copy of the approved resolution for your
reference.
1. Prior to recording the plat:
A. The plat has been amended to delineate the following items that the Weld County
Board required: Attachment of the Development Standards, that the plat shall
comply to section 23-2-260.D of the Weld County Code and all sheets of the Mylar
Plat shall be labeled USR-1666. Additionally, KMG has provided for a paved
tracking control pad at the entrance location which extends from County Road 7.5
for a minimum of 100 feet down the access road. At the end of the pavement, the
applicant shall install two (2) cattle guards, back to back. This installation has been
inspected and approved by Clay Kimmi of Weld County Public Works. The access
road shall be shown as a 30 foot recorded easement on the recorded Mylar Plat

B. The Office of Weld County Public Works has inspected or is in the process of
inspecting the above referenced site. KMG has complied with the Stormwater
drainage, overweight county permits, emergency access requirements for this

facility and received an approved Flood Hazard Development Permit as mentioned
by Weld County Public Works in their referral of July 30, 2008. We take pride at
Kerr McGee in building our facilities to meet or exceed Colorado Oil and Gas
Commission regulations and look forward to maintaining a long standing
cooperative relationship with Weld County Public Works. Attached please find the
approved Fire Plan signed by the Mountain View Fire Protection district.
C. The Colorado Department of Transportation (CDOT) has not responded to ICMG's
efforts to contact them regarding the above referenced oil and gas facility and the
CDOT referral dated July 14, 2008. Their presence was not noted at the Weld
County Board hearing. As recommended by CDOT in their referral, KMG did
employ traffic control in regards to the movement of equipment in and out of the
above referenced site. We take pride at Kerr McGee in building our facilities to
meet or exceed Colorado Oil and Gas Commission regulations and look forward to
maintaining a long standing cooperative relationship with the Colorado Department
of Transportation.
D. The Army Corp of Engineers has responded to KMG's efforts to contact them
regarding the above referenced oil and gas facility. Attached please find the
confirmation from the Army Corp of Engineers that a permit is not necessary from
their agency.
E. The Colorado Division of Wildlife (CDOW) has not responded to KMG's efforts to
contact them regarding the above referenced oil and gas facility and the CDOW
referral dated August 9, 2008. Their presence was not noted at the Weld County
Board hearing. As recommended by the CDOW, KMG conducted wetland
clearance and a wildlife study. Attached please find those studies and clearances
for your records.
F. KMG will furnish the Department of Planning services with a digital/electronic
copy of the Use -by -Special Review in one of the acceptable formats requested by
Weld County.

Sorry it has taken me a bit to respond to the mylars that were dropped off last week. Prior to recording the mylars
for both cases the conditions of approval need to be completed.
In regards to USR-1666 the following items need to be completed prior to recording the mylar.

Clerk and Recorder by Department of Planning Services' Staff. The plat shall be prepared in accordance

The Planning Department and Public Works will review the draft paper copies and provide comments back
regarding them. If no changes are recommended than most likely the existing mylars in my office can be utilized.
The mylars will need to be signed by the property owner. There is also an eleven dollar fee for recording for each

On October 8, 2008 for USR-1664 and USR-1664 and on July 9, 2008 for USR-1653 your applications for
a Use by Special Review for Oil and Gas Production Facilities in a PUD Zone District were approved by
the Board of County Commissioners with specific Conditions of Approval.
One of the Conditions of Approval grants applicants sixty (60) days to submit a Mylar Plat.
I am aware of the difficulty and associated delays in meeting the conditions of approval normally
associated with land use cases, and I'm willing to work with you in completing your application. Please

Re: Revised Flood Hazard Development Permit application (FHDP-533) — Milky Way Oil and Gas
Facility
Dear Mr. Spencer,
This letter serves to amend FHDP-533 to be consistent with the conditions of approval for USR-1666,
approved by the Board of County Commissioners on October 8, 2008. At the Board meeting, the
Commissioners directed Public Works to revise the conditions of approval on FHDP-533 to allow a six
foot chain link fence around the tank battery facility. The Board's opinion was that the chain link fence
around the tank battery facility in an open space area with a wide floodplain would not cause an
adverse impact to adjacent properties.
Condition 2 of the Public Works Conditions of Approval is hereby modified to allow a 6 foot high chain
link fence around the tank battery facility. All other conditions of approval remain in effect as stated in
the FHDP Conditional Approval Letter dated August 12, 2008.

Ms. Light:
Staff Scientist Justin Theodorakos with OtterTail Environmental, Inc met with Travis
DePorter with Anadarko on 3/10/2008 to discuss the potential for impacts to wetlands
from establishing drill sites at Milky Way 3-10, 18-10, 21-10. After completing an
environmental assessment of the proposed sites, it was decided that the wetlands could be
avoided and would not be impacted. Anadarko agreed to install a silt fence between the
proposed drill pad and the wetlands to ensure no impacts will occur. Please contact me at
