RE: APPROVE MEMORANDUM OF UNDERSTANDING FOR EXTENSION PROGRAM -
COLORADO STATE UNIVERSITY EXTENSION
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Memorandum of Understanding for the
Extension Program between the County of Weld, State of Colorado, by and through the Board of
County Commissioners of Weld County, and Colorado State University Extension, commencing
upon full execution, with further terms and conditions being as stated in said Memorandum of
Understanding, and
WHEREAS, after review, the Board deems it advisable to approve said Memorandum of
Understanding, a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Memorandum of Understanding for the Extension Program between the
County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld
County, and Colorado State University Extension be, and hereby is, approved.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 23rd day of March, A.D., 2009.

Enclosed you will find three originals of the Memorandum of Understanding setting forth
the relationship between Weld County and Colorado State University (CSU) Extension.
The documents have been executed by CSU Extension and are ready for your final
review and execution.
Once executed, please retain one original as a reference for the County. The remaining
two executed originals are to be returned to me at the address provided below. If you
have any questions regarding the document, please let me know.
I will be in touch with Commissioner Kirkmeyer to discuss strategies to inform staff and
the Weld County community about CSU Extension - Weld County, our continuing
partnership and joint commitment to providing quality programming.

between Colorado State University Extension (hereinafter referred to as "Extension") and
Weld County_ Colorado (hereinafter referred to as "County")
WI IIREAS_ County desires to participate in the educational programs as authorized by the Smith -Lever
Act, as amended, and other acts supporting Extension programs,
WI IEREAS, Extension is authorised by State and Federal lass to conduct Extension educational
programs in the State of Colorado_ and.
WI IEREAS, Iivension programs are developed in response to local needs, Extension plans O1 work and
program prioritization are determined jointly hs the County Extension Advisory Committee, County
Commissioners, and ('SG Extension Iaculty and staff.
WI IERE-AS, the Parties recognize that Extension has discretion concerning funding for and the
provision of Extension education programs, which may include youth development, consumer sciences,
family development, health education, community and economic development, agriculture_ horticulture.

supporting cooperative extension work,
\A I IEREAS, Extension and County desire to enter into this Memorandum of I_Inderstanding ("A1O1 j") to
set out the nature of the program and the relationship of the Parties

Extension program in the County under the following terms and conditions

(c) to pros ide necessary and adequate clerical and secretarial personnel
(d) The County mac, at its sole discretion, employ additional paraprofessional and support
personnel in the Counts. Extension Office at its own expense

accordance with Colorado State I niyersity Extension Personnel Policies and Procedures

(e) To submit to the Director of Colorado Extension a copy of the County budget approving
expenditures for items above_ The budget will he certitied as true and correct by the responsible Countv
officer and will be submitted prior to the beginning of each calendar year
(I) To annually review this MOE: at the beginning of each calendar year, and affirm or appoint
members of the County Extension Advisory Committee as needed the County Extension Advisory
Committee membership will he representatise of Weld County -
(g) To appoint a County Commissioner who will serve as a liaison to Extension. participate on
the Advisory Committee, and provide regular updates to the Hoard of County Commissioners
concerning Extension programming and operations
Section 2. Extension agrees.
(a) To provide leadership and administration for the Colorado State University Extension
programs and staff
(b) To provide the total salary of two professional stall; designated in the areas 014 -II youth
development and animal .sciences. including nployer binge benefit costs

(d) With the approval of the County. recruit. appoint and supervise professional staff to serse in
the County
(e) To provide qualified state and regional specialists in the areas of animal science and T-Il
youth development who are available to train and assist County staff in the conduct of County extension
educational programs
(II Extension may, at its sole discretion, employ additional professional personnel in the County
Extension thrice at its own expense.
Section 3. Extension and County mutually agree
(a) To place and support three (3) professional staff personnel who will implement the Extension
program set forth in this X101' in the County
(b) The personnel costs of these three (3) professional staff personnel will he provided by the
Parties as described in Section I and 2 above
(c) To notify the other party in writing at least sixty (6(I) flays prior to any expected major change
in funding or program that world affect the professional personnel or support of the program

in compliance with the Civil Rights ,Act of 1961_ lit le IN of the (Education Amendments of 1972, and

(e) Nothing herein shall abrogate. affect or v5 ive any notice requirements. defenses.
immunities. and limitations to liability that Extension. County. or their officer ,s and employees. may
have under the Colorado Governmental Immunity Act, C R S Section 24- I fl-IHI. et seq ("COI \-). and
to any other defenses, immunities, and limitations to liability availahle to the same under the law
Nothing in this \101 shall he deemed or applied as an express or implied vsaiyer by Extension or
County of its governmental and sovereign immunities, as an express or implied acceptance by Extension
or County of liabilities arising as a result of actions which lie in tort or could lie in fort in excess of the

iabilities allowable under the CGIA. as a pledge of the full faith and credit of the State of Colorado, or
as the assumption by any of the parties of debt, contract or liability of each other in violation of ,Article
