RE: APPROVAL OF RECORDED EXEMPTION NO. 395 - BUD AND JOYCE
HUNZIKER.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held
on the 30th day of May, 1979 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of land, as shown on the plat known as Recorded
Exemption No. 395, being the property of Bud and Joyce Hunziker,
described as the Southeast Quarter of Section 28 , Township 2
North, Range 67 West of the 6th P.M. , Weld County, Colorado,
being more particularly described as follows :

does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of land
from the definitions of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973,
as amended, and Section 2-lA(3) of the Weld County Subdivision
Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Bud and Joyce Hunziker be, and hereby is,
exempt from the definition of the terms "subdivision" and "sub-
divided land" pursuant to its authority under Section 30-28-101
(10) (d) , CRS 1973, as amended.

Dear Commissioners:
The attached application, plat and related items are in reference to
a request from Bud and Joyce Hunziker for a recorded exemption. The
parcel of land on which this request has been made is described as
the SE* Section 28, T2N, R67W of the 6th P. M. , Weld County, Colorado.
This property is located approximately 1 mile east of the Town of
Frederick. The property contains 160 acres of Class II and III ir-
rigated soils and Class III , IV and VI non-irrigated soils as clas-
sified by the Soil Conservation Service. The request is to split the
property into parcels of 1. 5 acres and 158. 5 acres.
The Hunziker's intent is to convey the title of the 1. 5 acre parcel to
their daughter and son-in-law which will be used as a building site
for a new residence. The 1. 5 acre parcel is currently being used as
pasture land.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends the re-
quest be approved for the following reasons:
1. The request conforms with the intent clause of the recorded
exemption procedure (Section 9-2 of the Weld County Subdivision
Regulations) , the intent clause of the Agricultural Zone District
(Section 3. 3 A. of the Weld County Zoning Resolution) , and the
Weld County Comprehensive Plan in that the use will be compatible
with the surrounding agricultural uses. The request will allow
agriculture and related uses to be the predominant land uses.
There will be no reduction in the amount of land currently being
used for agricultural production.

2. The Tri-Area Planning Commission has set forth no objections to
this request ,
3. The request complies with the provisions of Section 9-4 A. of the
Weld County Subdivision Regulations.

Dear Sirs :
We, Larry Richmeier and Kim Hunziker are writing this
letter to get your approval on letting us build a house
in Weld County.
Bud Hunziker owner of the property on which we want to
build has agreed to give us the land and because land
is so expensive we have decided that this would be a
great opportunity.
The acre we would be building on has been surveyed and
is pasture land and has been for many, many years .
This way we would not be interfering with the crops
grown of the farm.
We have checked with The Weld County Water District
and have their ok on tapping into a water line that runs
down road 16 , that the house would be built on. This
would save digging a well.
Also because Larry is a carpenter he will do most of
the work on the house by himself which will help us
considerably.
We would very much like to live in the country and
hope you will take all things into consideration.
