HomeMy WebLinkAbout20092695.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO OCTOBER 14, 2009 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, October 14, 2009, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner William F. Garcia, Chair Commissioner Douglas Rademacher, Pro-Tem Commissioner Sean P. Conway - EXCUSED Commissioner Barbara Kirkmeyer Commissioner David E. Long - EXCUSED Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Jennifer VanEgdom Controller, Barb Connolly MINUTES: Commissioner Kirkmeyer moved to approve the minutes of the Board of County Commissioners meeting of October 12, 2009, as printed. Commissioner Rademacher seconded the motion, and it carried unanimously. AMENDMENTS TO AGENDA: There were no amendments to the agenda. PUBLIC INPUT: No public input was given. CONSENT AGENDA: Commissioner Rademacher moved to approve the Consent Agenda as printed. Commissioner Kirkmeyer seconded the motion, and it carried unanimously. PRESENTATIONS: RECOGNITION OF SERVICES, SHERIFF'S OFFICE - THELMA HIGGINS: Chair Garcia read the certificate into the record, recognizing Thelma Higgins for 21 years of service with the Sheriffs Office. John Cooke, Sheriff, stated he will miss Ms. Higgins, and she has been a loyal, dedicated, enthusiastic employee. He indicated Ms. Higgins is a fan of the Kansas City Chiefs, and he has jokingly fired Ms. Higgins many times over the past years when the Chiefs have beat the Broncos. He confirmed one of her work duties was to read through all of the incoming mail for the inmates, and he reiterated she has been a wonderful employee. Kim Higuera, Sheriff's Office, indicated she has worked side -by -side with Ms. Higgins, and Ms. Higgins has been a "Cadillac" employee during her tenure at Weld County. Ms. Higgins expressed her appreciation to those in attendance for their support, and indicated her time at Weld County has been a great opportunity and privilege. She confirmed she has enjoyed her work as support staff for the Deputies and Correctional Officers. Chair Garcia indicated employees like Ms. Higgins make Weld County a great place to work, and he hopes that she has trained her successor well. He indicated it is evident that Ms. Higgins made a lot of friendships within Minutes, October 14, 2009 2009-2695 Page 1 BC0016 !x /27 (c the office, which is confirmed by the number of people present for her retirement celebration today. Commissioner Rademacher expressed his appreciation to Ms. Higgins for her service and wished her the best in her retirement endeavors. Commissioner Kirkmeyer further expressed her appreciation to Ms. Higgins, and indicated a standing ovation of appreciation is appropriate at this time. COMMISSIONER COORDINATOR REPORTS: Commissioner Rademacher stated the Rural Task Force held its last meeting on Monday evening, and the meeting went very well. He indicated meetings took place for over three months, and the end product will be presented in a work session within the next few weeks. Commissioner Rademacher further indicated a new Director has been selected for the Department of Planning Services, and Trevor Jiricek began his new duties as of last week. He expressed his appreciation to those involved in the selection process and indicated he hopes Mr. Jiricek enjoys a successful career. BIDS: PRESENT BID #B0900155, CABLING FOR COMMUNITY CORRECTIONS BUILDING - DEPARTMENT OF PHONE SERVICES: Barb Connolly, Controller, indicated three vendors submitted quotes for this bid, and said bid will be presented for approval on October 28, 2009. Commissioner Rademacher indicated he is pleased that the presented quotes all appear to be close in price. Responding to Commissioner Rademacher, Ms. Connolly confirmed H and H Data Services has performed cabling services for Weld County numerous times in the past. NEW BUSINESS: CONSIDER TEMPORARY CLOSURE OF CR 62 BETWEEN CR 47 AND ENTRANCE TO GREELEY- WELD COUNTY AIRPORT: Janet Carter, Department of Public Works, stated GLH Construction has requested the closure of County Road 62, from October 19, 2009, to November 18, 2009, for the installation of a new sewer main. She confirmed there is no specified detour route; however, all residents and businesses have been notified of the closure and will be given alternative accesses during the closure. She indicated standard road signs and barricades will be utilized, and in response to Chair Garcia, Ms. Carter indicated the closure is adjacent to the Greeley -Weld County Airport, more specifically, on the east side of the airport, perpendicular to the runways. Further responding to Chair Garcia, Ms. Carter confirmed there are two residences affected by the closure; however, one residence is currently abandoned, and the other residence is currently for sale. Commissioner Rademacher moved to approve said temporary closure. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. CONSIDER AGREEMENT TO MINE WITHIN 200 FEET OF PERMANENT MANMADE STRUCTURES AND AUTHORIZE CHAIR TO SIGN - LAFARGE WEST, INC.: Bruce Barker, County Attorney, stated a portion of the Poudre River Trail travels through property owned by Lafarge West, Inc. He indicated Lafarge is seeking to obtain a mining permit, and signoff must be provided by the owner of each property which has a structure within 200 feet of the mining site. He further indicated Lafarge intends to mine approximately 80 feet from the trail and the fence, therefore, the mining activities are not expected to affect the trail improvements. He stated the language within the agreement indicates the placement of the trail does not preclude any mining activities, and the Poudre River Trail Board has stated there are no concerns, therefore, he recommended approval the agreement. In response to Commissioner Kirkmeyer, Mr. Barker clarified if the trail becomes damaged as a result of the mining activities, Lafarge is required to repair or replace the damaged portions, or provide compensation at a standard replacement value. He further clarified State statute requires that the trail must be restored to an "as -is" condition, since the "structure" is a slab of concrete and fence. Commissioner Kirkmeyer indicated if Lafarge replaces the concrete, and it is not of the same quality as previously constructed, it will create problems. Mr. Barker concurred and indicated he will modify the language to specifically reflect that any repair work to the trail must be completed to the same specifications the trail currently has. In response to Commissioner Rademacher, Mr. Barker indicated the fence has already been constructed, and has been in existence for a number of years already. Commissioner Rademacher moved to Minutes, October 14, 2009 2009-2695 Page 2 BC0016 approve said agreement, with the modifications deemed necessary by Mr. Barker, and authorize the Chair to sign. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
